Subject: Proposed replacement of existing structure on SR 1333 (Hester Road)
conveying Reedy Creek in Warren County. WBS Element No. SB.209311
The North Carolina Department of Transportation (NCDOT) proposes to replace the
existing structure on SR 1333 (Hester Road) conveying Reedy Creek in Warren County
(Figure 1). The existing structure is a 5 foot x 4 foot metal pipe that is 36 feet long. A
very large blow hole has formed at the outlet of the structure and the outlet is perched
above the ordinary high water mark. The proposed replacement structure is an 81 inch x
59 inch corrugated metal pipe arch (CMPA) that is 60 feet long.
Please note that the outlet of the proposed structure will be located inside the limits of
this blowhole making it impractical to bury the replacement pipe one foot in the stream
bed that now exists a e ottom o t e lowhole. A itionally, there is a significant
e c ange in stream bed elevation on either side of the pipe structure which will affect
invert burial in the streambed. The Department proposes to bury the inlet one foot in the
streambed but cannot guarantee the outlet will be buried a full foot in the streambed. As
noted, this is due to blowhole at the outlet and the significant grade change in streambed
elevation.
Impacts to Waters of the United States
The removal of the existing structure and subsequent installation of the CMPA will result
in impacts to Reedy Creek (NCDENR-DWQ Index No. 28-79-25-5, Best Usage
Classification C NSW, HUC 03020102) in the Tar-Pamlico River Basin.
Permanent Impacts
Installation of the replacement structure will result in impacts to Reedy Creek. This impact is
summarized below:

Bank stabilization activities will result in impacts to Reedy Creek. This impact is
summarized below:
• 10 linear feet of bank impact at inlet of the replacement structure and 10 linear feet of
bank impact at outlet of structure.
Temporary Impacts
The NCDOT proposes to temporarily dewater the work zone during construction for
approximately two weeks. This will involve the temporary placement of sand bags or
sheet piling 25 linear feet upstream of the existing inlet and SO linear feet downstream of
the existing outlet. This will result in 31 linear feet of non-concurrent temporary stream
impacts. To maintain water flow during construction, water upstream of the sand bags or
sheet piling will be temporarily pumped out by a hose and conveyed downstream of the
construction activity where it will be allowed to filter through vegetation before flowing
into the stream. The effluent from the work area will be pumped into a prefabricated silt
bag allowing water to slowly filter out of the bag in a dispersed manner and the sediment
to be captured in the bag. The temporary sand bags or sheet piling will be removed after
construction.
Riparian Buffer
Construction at this site involves the road crossing of a stream that is subject to the
Tar-Pam Riparian Buffer Rules. The stream is depicted on the most recent version of the
Warrenton topographic quadrangle (1970) (Figure 1). Construction impacts at this site
tota14,577 square feet in Zone 1 and 2,038 square feet in Zone 2 (totaling 75 linear feet
of riparian buffer impacts). Based on th mie pacts to the riparian buffer at this site, this
crossing is ALLOWABLE. Temporary erosion control measures will be installed as
required within the permitted buffer footprint.
Waters of the U.S. Mitigation
Avoidance:
Permanent impacts to Reedy Creek cannot be avoided. The existing pipe structure is
rusted. The NCDOT hydraulics unit has determined that the proposed CMPA is a
suitable replacement for the existing structures.
Minimization:
The proposed rip rap at the inlet and outlet of the structure has been minimized as much
as possible while providing the required long-term stability.
Compensatory Miti ation:
Compensatory mitigation will be provided at the request of the regulatory agencies.
Protected Species
Plants and animals with federal classifications of Endangered, Threatened, Proposed
Endangered and Proposed Threatened are protected under provisions of Section 7 and.
Section 9 of the ESA. As of March 26, 2008, the bald eagle (Haliaeetus leucocephalus),
dwarf wedgem~ussel (Alasmidonta heterodon) and Tar spinyrnussel (Elliptio
steinstansana) are listed as federally protected species in Warren County. Large open
water systems that are required for the bald eagle are_ not present at the site. The small
stream located at the project does not provide adequate habitat for dwarf
wedgemussel or Tar spinymussel.
Summary
The NCDOT proposes to replace the existing structure on SR 1333 (Hester Road).
Application is hereby made for a NCDENR-DWQ Section 401 Water Quality
Certification (WQC) 3687, 3689 and Tar-Pamlico Buffer Authorization. The NCDOT
proposes to use Department of the Arrny Section 404 Nationwide Permit (NWPs) 3 and
13; however, these permits do not require notification to the USACE. An automated
payment procedure has been implemented between the NCDOT and NCDENR-DWQ.
This procedure will enable the Division to apply for the 401 WQC without submitting a
check for this permit application. This procedure will provide payment to the NCDWQ
by charging the permit application fee directly to the appropriate NCDOT WBS Element
No. SB.209311. Apre-construction notification and permit drawings are attached with

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

VII. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from

VIII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It maybe useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

Avoidance•
Construction of the project cannot avoid impacts to waters of the United States. The NCDOT
hydraulics unit has determined that the CMPA is a suitable replacement for the existing
structure.
Minimization
The posed rip rap at the inlet and outlet of the structure has been minimized as much as
possible while providing the required long-term stability. NCDOT will implement best
mana ement practices for the protection of surface waters in accordance with the most recent
version of the "North Carolina Sediment and Erosion Control Planning and Design Manual"
duringdesign and construction phases of the project.
IX. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that maybe appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o. enr.state.nc.us/ncwetlands/strmgide.html.

much information as possible, including, but not limited to: site location (attach directions and/or
map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of
mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description
of the current site conditions and proposed method of construction. Please attach a separate
sheet if more space is needed.

XI. Proposed Impacts on Riparian and Watershed Buffers (required by DWQ)
