C:- SE/a RICHLANDS IS OUADRANCLE N3445-W7730/7.5 isso SEc.T1oN ~ gl ve, G'e,e4L F~A~^S DMA 5453 I SE-SERIES V842 Blue Creek Farms, Section II Impact Justification & Narrative Blue Creek Farms, Section II is a proposed 961ot, low density, residential subdivision off of Blue Creek Road in Onslow County, North Carolina. This subdivision will consist of 20 foot wide strip pavement with roadside swales. All Streets are to be constructed to meet NC DOT Standards. Street construction will impact wetlands in locations 1 through 4. Locations 5 and 9 through 13 will be for lot development and the construction of septic systems. Locations 6 through 8 are for restoration areas. To minimize the overall impacts to the wetlands, the street layout was optimized to reduce the number of crossings while yielding the maximum number of lots. IMPACT #1: (Pictures 1 &2) This road crossing location is at an existing ford. The ford will be upgraded with a culverted crossing. The road profile is as low as possible to reduce the length of stream impacts and minimize the amount of fill placed in the wetlands. IMPACT #2: This road crossing is entirely new. The road is designed as low as possible and nearly perpendicular to the wetlands to minimize the stream and wetlands impacts. The crossing will consist of a culvert with headwalls and fill IMPACT #3: This Road Crossing is entirely new and required to gain access to the high ground on the opposite side. Impacts are minimized by crossing nearly perpendicular to the wetlands and designing the road as low as possible to reduce the fill area. IlVIPACT #4: (Picture #5) This road crossing is located at the current location of an existing ford. The ford will be replaced with a culvert and the minimum fill needed to cross the wetlands. IlVIPACT #5: This is a driveway crossing to gain access the buildable area across the wetlands. The impact is minimized by having lots 9 and 10 share a common driveway across the wetlands. RESTORATION AREA #6: This is an existing culverted crossing consisting of a clogged 12" corrugated plastic pipe. The clogged pipe has caused water to back up into the wetlands and water now is overflowing the existing dirt road. To restore the area it is proposed to remove the pipe, and fill material down to the native soils. Once the native soils are reached, the natural ground will be prepped and seeded with a wetland mix, prior to placing American excelsior curlex blanket to inhibit erosion while vegetation is established. RESTORATION AREA #7: (Picture #6) This is an existing culverted crossing consisting of a steel 36" diameter pipe and two smaller, 6" or 8" pvc pipes and wooden retraining walls. To restore the area it is proposed to remove the pipes, and fill material down to the native soils. Once the native soils are reached, the natural ground will be prepped and seeded with a wetland mix, prior to placing American excelsior curlex blanket to inhibit erosion while vegetation is established. r' RESTORATION AREA #8: (Pictures 4 & 6) This is an existing ford that was still considered wetlands during the delineation. IMPACTS #9-13: These proposed culverted crossings are to allow the construction and maintenance of septic systems. When possible, the lots share common crossings to reduce the total number of crossings. WETLANDS AND CONSERVATION SPECIAL PROVISIONS: A. Compliance with Wetlands Regulations: It shall be the responsibility of each owner, prior to alteration of any lot, to determine if any portion of the Lot shall have been determined to meet the requirements for designation as a regulatory wetland, Any subsequent f 11 or alteration ofthis wetland shall conform to the requixennents of state wetland rules adopted by the State ofNorth Carolina in force at the time of the proposed alteration. The intent of this deed restriction is to prevent additional wetland X11, so the property Owner should not assume that a future application for fill will be approved. The property Owner shall report the name of the subdivision, in any application pertaining to wetland rules, This covenant is intended to insure the continued compliance with wetland rules adopted by the State of North Carolina, therefore benefits may be enforced by the State of North Carolina. This covenant is to run with the Iand and shall be binding on all parties and all persons claiming under them. B. Conservation Areas: The areas shown on that plat recorded in Map Book Page as conservation areas shall be maintained in perpetuity in their natural or mitigated condition. No person or entity shall perform any of the following activities ozt such conservation area: (1} fill, grade, excavate or perform any other land disturbing activities (2) cut, mow, burn, remove, or harm any vel;etation (3} construct ar place any roads, trails, walkways, buildings, mobile homes, signs, utility poles or towexs, or any other permanent or temporary structures (4) drain or otherwise disrupt or alter the hydrology or drainage ways of the conservation area (5) dump or store soil, trash, or other waste (6) graze or water animals, or use for any agricultural or horticultural purpose This covenant is intended to ensure continued compliance with the mitigation condition of a Clean Water Act authorization issued by the United States of America, U.S. Army Corps of Engineers, Wilmington District, AI,D# and therefore may be enforced by the United States of America. Term: These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of twenty (20) years from the date these covenants are recorded, after which time such covenants shall be automatically extended for successive periods often (10) years. Section 2. Enf rcement: In the event of a violation or breach of a:ay of these restrictions, covenants, agreements and conditions by any person or concern claiming by, through or under the undersigned, or by virtue of any judicial proceedings, the Declarant, its successors and assigns and the owners of the number lots in the subdivision, or any of them, jointly or severally, shall behave the right to proceed at law or in equity to compel compliance with the terms thereof or to prevent the violation or breach of any of them, Costs and reasonable attorney fees shall be recoverable by the person or party seeking to compel compliance with these restrictive covenants as part of any judgment or order issued. The failure to enforce any right, reservation, restriction or condition con- tained herein, however loztg continued, shalt not be deemed a waiver of the right to do so thereafter as to the same breach or as to a breach occurring prior or subsequent thereto and shall not baz or affect its enforcement. Remedies Extended to the State of Nort Carolina• To ensure that this subdivision is maintained consistent with the laws of the State ofNoxth Carolina, the State of North Carolina is specifically empowered to take such acts necessary by and through its officers to enforce any of these covenants against an Owner, The State of North Carolina is specifically made a beneficiary of these covenants.
