Klimek, P.E., Director August 24, 2004 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Brandywine, LLC Attn: John Myers 3209 Gresham Lake Road Raleigh, NC 27615 DWQ EXP No. 04-1223 Wake County Subject Property: Bedford at Falls River, Phases 37, 38 and 39 REQUEST FOR MORE INFORMATION EXPRESS REVIEW PROGRAM `~ Dear Mr. Myers: On August 11, 2004, the Division of Water Quality (DWQ) received your application dated August 11, 2004 to.impact 265 feet of stream and 26,137 square feet (ftZ) of protected riparian buffers to construct the proposed subdivision. On August 19, 2004, the requested additional information was submitted responding to the "Request for more information" sent on August 13, 2004. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H -A506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information: 1. Outlet Protection at Culverts: NCDOT Hydraulic Design Guidelines (http://www.doh.dot.state. nc. us/preconstruct/hig hway/hydro/g 10399web/) specify that the outlet velocities are designed for the Q10 discharge. If this velocity exceeds the scour velocity for the receiving stream, rip rap outlet protection is required. DWQ is concerned that outlet protection is needed and that these impacts have not been included on the table of stream impacts on the PCN form. Level Spreaders Please place drainage easements around the four (4) level spreaders for future maintenance activities. Please respond within three days of the date of this letter by sending this information to me via e-mail or fax and afollow-up copy in writing. The Express Review Program is a process that requires all parties to participate in a timely manner. If the DWQ feels the Express Review Program is the incorrect review program for your project, then we may have to return your application and have it reviewed through our regular 401 Water Quality Certification Program. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
