Dear Mickey,
I am in receipt of your documentation requesting for additional inforn~ation and I have
included revised drawings as part of this submittal package. The area requested to be impacted
has been reduced from 0.069 acres to 0.0466 acres by proposing wooden bulkheads,
approximately thirty feet from the buildings. The thirty feet of impact from the south side of the
buildings on Lots 6 and 7 are being justified from the setback requirements of Environmental
Health. The septic field locations shown on the attached drawings are the approved locations;
however, additional setbacks from ditches and swales may be applicable, which could result in a
twenty foot maximum shift of the parking and building toward the wetlands. This building shift
would leave approximately ten feet to the proposed wooden bulkheads, leaving a practicable
distance from the building foundation to the bulkhead.
In regards to the continent on the mitigation plan, the remaining wetlands are proposed as
being restricted {not a conservation easement) within the covenants of the subdivision as
indicated on Sheet 4 of 4. The language found on this sheet will be incorporated within the
covenants and recorded. I have also proposed to "create" an area of wetlands adjacent to the
existing wetlands on proposed Lots 8 and 9. This wetland creation, approximately 3600 square
feet, can be found on Sheet 3 of 4 of the submittal as well as a detail of this area. if you have any
other questions or comments, please do not hesitate to contact me.

Location/Description of Proposed Activity: The 9.77-acre project site, known as Mariners Bav, is
located on the south side of NC Ilwy 24, lust east of USMC Bogue Airfield, adjacent to Goose
Creek, in Bogue Community, Carteret County, North Carolina. Please reference the March 15,
2008 permit application to impact 0.069 acres of jurisdictional wetlands subject to our permitting
authoritYi and my March 31, 2008 telephone conversation with Ms. Turner concerning your
application submittal and the need for additional information.

REMARKS:
-As discussed in the telephone conversation, you must answer question VII regarding impact
'u~ stification, including the use of retaining walls/bulkheads to reduce the footprint of the wetland
impact area. This information is imperative in our decision-making process for your proposal. If
avoidance and minimization is not adequately explained, then your request will not meet the terms
and conditions of the nationwide permit. Please provide our office with this information in order
for us to verify your eligibility for NWP #18.
-Although you have complied with NWP #18 regarding the submittal of a mitigation plan with the
application. there are some questions concerning your proposal. In question VIII (1). it is stated
that the remaining wetlands will be placed within a conservation easement. It is commendable that
you propose to preserve the remaining wetlands & waters, but it is uncertain if you are referring to
a conservation easement or restrictive covenants. Conservation easements involve a third party
agreement with anon-profit organization; and restrictive covenants are generally included in the
subdivision/development declarations that are recorded with the county register of deeds. Attached
is a copy of the restrictive covenant language that must be included in the subdivision declarations
if youu choose that option. Also, please be aware that you must explain why other onsite and offsite
mitigation alternatives are not available. Guidance dictates that an applicant must first pursue
onsite vs. offsite alternatives. in-kind vs. out-of--kind, and wetland restoration vs.
enhancement/creation/preservation. With your preservation proposal, you must include why other
mitigation means were not practicable.
