Our office has met with the City of Durham Stormwater Division in order to reconcile the requirements of both your agency and the Stormwater Division. Per GC3402, "site specific stormwater management shall be designed to remove 85%TSS according to latest version of DWQ's Stormwater Best Management Practices manual at a minimum." This requirement was discussed with David Brown of the City of Durham Stormwater Services Division at a meeting on Friday, September 22, 2006. It is the feeling of the Stormwater Division that, given the site characteristics, constructed wetlands are not the best BMP to achieve the 85%TSS removal. Per discussions at this meeting, we would propose to work closely with the City of Durham Stormwater Division to design a series of BMPs to accomplish the 85%TSS removal as required by GC3402. These BMPs may include, but are not limited to, bio-retention areas and pocket wetlands. The constructed wetlands as indicated in your letter would not be used, however the requirement of 85%TSS removal would still be satisfied. In addition, the developer feels that it is necessary to culvert the entire rip-rap ditch on the property. The rip-rap ditch (man-made by NCDOT) is culverted at both ends and poses a safety issue. This area of the development is designated "open space" with a basketball court and picnic facilities. The developer is concerned with children and others getting hurt in the rip-rap ditch and/or the culverts and the liability associated with leaving the ditch open. ~~ ~3~~ E N G I N E E R I N G P L A N N I N G L A N D S C A P E A R C H I T E C T U R E Page 2 If this solution is not acceptable, we would like to schedule a meeting with DWQ in order to further discuss these issues. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require five copies of the additional information requested in order to process your application to impact protected wetlands and/or streams on the subject property. This project has been placed on hold until the following criteria has been meet. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide detail for the stormwater management practices as required by GC3402. This General Certification requires your proposed dry detention basins be converted to constructed wetlands since this is a "NSW" watershed. Please submit revised plans for the stormwater management. 2. This Office believes that the impacts (200 linear feet) to the rip rap stream on the property should be minimized. It appears unnecessary to impact that length. Please revise the plans to minimize the impacts. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and that you remain interested in continuing to pursue permitting of your project and will be providing the DWQ the requested information at a later date.
