The applicant is proposing to repair the Onslow Beach Bridge located within Onslow County, NC. Four pilings will be temporarily added to the bridge during repair activities. Since the bridge will not be used during repair work, two floating dock structures will be constructed to temporarily provide ferry access between the mainland and the island. A barge will be used to move vehicles between an existing boat ramp on the mainland side and a dirt road on the island side. Pre-stressed concrete will be temporarily placed on coastal wetlands on the island side so that vehicles can safely offload. The proposed project will temporarily impact 0.005 acre of coastal wetlands. Wetland impacts were minimized to the maximum extent practicable. However, wetlands exist all along the fringe of the island where the barge will need to dock. The applicant chose to place the impact where a road currently exists to minimize disturbance. Fabric will be placed in between the wetlands and the concrete to reduce compaction. The area will be restored to natural grade after the bridge is repaired. The applicant has also requested a CAMA Consistency Determination from the NC Division of Coastal Management. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps maybe included at the applicant's discretion, so long as the property is clearly defined. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It maybe useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation maybe required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Updated 11/1/2005 Page9of12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stnngide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. This bridge crosses over the Atlantic Intracoastal Waterway at mile 240.7 and provides access between Camp Lejeune and Onslow Beach. The bridge was constructed in the 1950's and is in need of maintenance. Four pilings will be temporarily added to the bridge to provide support during repair activities. In addition, rivets and bearing plates will be changed and the bridge will be painted. To facilitate rivet repairs, scaffolding equipment will be used on the bridge, which will reduce the available vertical clearance by approximately three feet to nine feet above mean high water. This work will not interfere with the operation of the swing span. The applicant has contacted the U.S. Coast Guard regarding this project. Because the pilings are temporary in nature, an application submittal was not required. However, the USCG has issued a safety broadcast notice to mariners for the project. The applicant is required to place an all around white light at the corner of the floating docks that protrude into the waterway. The bridge will be closed to traffic for approximately 30 days during this repair work. Two vessels will provide temporary access between the mainland and Onslow Beach during the bridge closure; a ferry for people and a barge for vehicles. Two floating docks that will be 8' x 30' will be attached to the embankment of both sides of the waterway east of the bridge to accommodate the landing of the temporary ferry service. The ferry will run between these floating dock structures. These docks will be located outside of the U.S. Army Corps of Engineers' 80' federal channel setback. The mainland dock will be located adjacent to an existing boat ramp. People will walk down the boat ramp and onto a fixed pier, and then onto the floating dock. The floating dock on the Onslow Beach side will be tied to an existing pier. A barge will be used to move vehicles between the existing boat ramp on the mainland side and a dirt road that comes almost to the edge of the water on the island side. The proposed project will temporarily impact 0.005 acre (232.6 sf) of coastal wetlands. Wetland impacts were minimized to the maximum extent practicable. However, coastal wetlands exist all along the fringe of the island where the barge will need to dock. The applicant chose to place the impact where a road currently exists to minimize disturbance. Fabric will be placed in between the wetlands and the concrete to reduce compaction. The area will be restored to natural grade after the bridge is repaired and the concrete is removed; approximately 30 days. The applicant has applied for Nationwide 33 and General 197800056 permits through the U.S. Army Corps of Engineers. Areas of Environmental Concern A. Coastal Wetlands The administrative Code 15A NCAC 07H .0205 describes coastal wetlands as those salt marshes or other marshes subject to regular or occasional flooding by tides, including wind tides and includes some if not all 10 species. Although the wetlands on the mainland side of the project area have not been delineated, it appears that the location of the proposed structures will not be in wetlands. Furthermore, the fixed pier and ramp will be elevated (Figure 9). Wetlands within the Onslow Beach side of the project area were delineated by Versar, Inc. and approved by the U.S. Army Corps of Engineers on December 6, 2004 (Action ID# 20040005). These wetlands are adjacent to the AIWW and are influenced by the tides. As noted above, a small amount of coastal wetlands (0.005 ac) will be temporarily impacted in order to allow vehicles access to a barge. B. Estuarine Waters Estuarine waters are defined in 15A NCAC 07H .0206 as all of the waters of the Atlantic Ocean within the boundary of North Carolina and all of the waters of the bays, sounds, rivers, and tributaries thereto seaward of the dividing line between coastal fishing waters and inland fishing waters. The proposed project includes the temporary installation of four pilings on the existing Onslow Beach Bridge and the construction of two 8' x 30' temporary floating docks with associated fixed piers and ramps. The pilings, floating docks, and ramps will be located within estuarine waters. C. Estuarine Shorelines Coastal shorelines are defined in 15A NCAC 07H .0209 as estuarine shorelines and public trust shorelines. Estuarine shoreline areas of environmental concern are those .non-ocean shorelines extending from the normal high water level or normal water level along the estuarine waters, estuary sounds, bays, fresh and brackish waters, and public trust areas for a distance of 75 feet landward. Although the normal high water level for the project area has not been surveyed, we assume that the proposed fixed pier on the mainland side and the temporary wetland impact on the Onslow Beach side will both be located within 75' landward of mean high water. 2 D. Public Trust Waters Public trust areas are defined in 15A NCAC 07H .0207 as waters of the Atlantic Ocean and lands thereunder from the mean high water mark to the seaward limit of the State jurisdiction, including all natural bodies of water subject to measurable lunar tides and lands thereunder to the mean high water mark. These public trust areas include all navigable water bodies and lands thereunder to the normal high water level or mean water level. The proposed project includes the temporary installation of four pilings on the existing Onslow Beach Bridge and the construction of two 8' x 30' temporary floating docks with associated fixed piers and ramps. The pilings, floating docks, and ramps will be located within estuarine waters. E. Outstanding Resource Waters Outstanding Resource Waters (ORW) are those waters classified by the NC Environmental Management Commission pursuant to T15A NCAC .021B upon finding that these waters are of exceptional State or National recreational or ecological significance. The AIWW in the project area is not classified as ORW. Therefore, no impact to an ORW will occur from this project. F. Conclusion The proposed project contains the following areas of environmental concern: coastal wetlands, estuarine waters, estuarine shoreline, public trust waters. However, any intrusion will be minimal in size and temporary in nature. General Policy Guidelines The General Policy Guidelines (15A NCAC 07M) for the coastal area have been reviewed and it has been determined that the proposed project is consistent with these guidelines. Most guidelines were found to be irrelevant to the project except for the following: Section 7M .0600: Floating Structure Policies This policy declares that floating structures used for residential or commercial purposes should not infringe upon the public trust rights nor discharge into the public trust waters into the coastal area of NC. The proposed floating docks will be located close to the shoreline and will not affect public trust rights. Furthermore, no discharges will be associated with these structures. Finally, these structures will be temporary. Therefore, this project is consistent with this policy. 3 Section 7M .0700: Mitigation Policies This policy requires that adverse impacts to coastal wetlands or waters be mitigated or minimized through proper planning. Section 7M .0800: Coastal Water Quality Policies This policy guideline states that no land or water use shall cause the degradation of water quality so as to impair the traditional uses of coastal waters. This project is temporary and will not permanently increase impervious surface. All proposed floating docks and concrete will be removed. Therefore, the project is consistent with this policy. Conclusions Based on the review of the General Policy Guidelines for Coastal Areas, we believe that the proposed project is consistent with T15A NCAC Subchapter 07M. Land Use Plan Review The main purpose of the project is to repair the existing Onslow Beach Bridge in order to maintain it as a safe travel corridor for travelers. The proposed project will impact a small amount of coastal wetlands (0.005 ac). In addition, floating docks will be located within other areas of environmental concern.
