Stevens, Director a NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES January 17, 2001 Johnston County DWQ Project # 010016 APPROVAL OF 401 Water Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules Riverwood on the Neuse, LLC 400 Riverwood Drive Clayton, NC 27520 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to fill 0.1 acres of wetlands and to impact 76 linear feet of stream channel and the associated riparian buffers in Johnston County for the purpose of road crossing and sewer line crossing construction, as you described in your application received by the Division of Water Quality on January 4, 2001. After reviewing your application, we have decided that this action is covered by General Water Quality Certification Numbers 3288 and 3287. This certification allows you to use Nationwide Permit Numbers 12 and 39 when the Corps of Engineers issues them. This approval is also valid for the Neuse Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAiw1A permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this - Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Since permanent stream and jurisdictional impacts are well less than 150 linear feet and 1/3-acre, no notification to the NCDENR-DWQ is required for the Nationwide Permit, so this is a request for buffer approval only. A pre-construction notification form is attached. The proposed residential subdivision, Riverwood on The Neuse, consists of construction of houses and their required roads and utilities. The 320-acre property is located approximately 3500 ft. north of the intersection of SR 1700 and the Neuse River in Johnston County, NC, immediately west of the intersection of SR's 1700 and 1714 (see attached USGS site vicinity map). The property contains approximately 5 acres of bottomland hardwood jurisdictional wetlands. Proposed impacts include 0.045 acres of jurisdictional wetlands and 76 linear feet of channel to be permanently impacted for a perpendicular road crossing under NWP 39. 0.0466 acres of jurisdictional wetland and 400 linear feet of stream channel will be temporarily impacted for perpendicular utility line crossings under NWP 12 (see site wetland impact map). Please note that a site meeting was conducted in July 1998 with Jean B. Manuele, who agreed with the wetland delineation performed by Soil & Environmental Consultants (AID # 199821098). Additionally, a site meeting was conducted with Danny Smith from NCDENR to evaluate streams subject to Neuse River buffers (NBRRO-99-034). The project will use the mechanical equipment typically associated with such work. 13. Purpose of proposed work: This residential project will provide housing in the area, and the sewer lines and subdivision roads will provide sanitary sewer and public road access for the proposed house lots. 14. State reasons why it is believed that this activity must be carried out in wetlands (include any measures taken to minimize wetland impacts): The applicant requested a delineation of the property's onsite wetlands prior to developing a site plan in order to avoid and minimize jurisdictional waters of the U.S. and wetland impacts. Channel and wetland impacts as a result of Roadway Crossing 1 were necessary in order to provide the subdivision with public road access to SR 1700. Utility Crossings 1-10 all cross streams perpendicularly, and the construction corridors associated with each crossing impact 40 linear feet of stream or less. All other wetlands areas on the property were avoided. 15. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding the presence of any federally listed or proposed for listing endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project.
