Cyndi/Eric,
First, this email is to let you know that I received you letter dated August 28, 2006 and that we are going to
continue to pursue the permits. If you would like a letter mailed to you stating this, please let me know.
I was also hoping you could help me out with something. Your first comment on the letter deals with converting
the dry detention ponds into constructed wetlands due to it being a NSW watershed. We are in the Cape Fear
River Basin, which I thought was not a NSW. We have also met all City of Durham stormwater requirements for
the site. We are not in any Durham watershed overlay districts, and being in the Cape Fear, we are not required
to provide any water quality treatment, only detention of peak discharge. We are also going above the City of
Durham requirement of detaining the 2-year and 10-year storms, by detaining the 25-year storm as well. Please
give me some clarification on this comment. Am I wrong in assuming the Cape Fear is not a NSW? If not, can I
leave the dry detention ponds as designed?
