8. PROJECT SUMMARY: The applicant is proposing to insta112 new slips with the

9. Narrative Description:
The Melba and Grayden Tripp project is located at 551 Neptune Dr. in Cape Carteret, Carteret
County. Neptune Dr. is found by turning south off of Hwy 24 east onto Yaupon Drive then west
at the second entrance for Neptune Drive. The site lies on the north side of Bogue Sound in this
area.
The subject property is 38,158.6 square feet in its entirety and ranges from 2'to 5.7' in
elevation above NHW. There are not any structures on the high ground portion of the site.
Along the shoreline of this property is a 15 wide by 180' long fringe of Coastal Marsh that
contains Smooth Cordgrass (~artina alterniflora). The high ground portion of the track is
vegetated with Loblolly Pine (Pinus taeda) and Wax Myrtle (Myrica cerifera).
There is an existing basin, which is shared by the applicants and the adjacent owner. The
basin currently measures 210' in length and and at its widest point 50' narrowing to 37'. The
current channel measures 115' in length and 130' narrowing to 65' in width. At this time the
adjacent owner currently has 3 existing boatlifts, and a bulkhead. The applicant wishes to add
two slips on their side of the basin with the total for the basin becoming five. They are also
asking for vinyl bulkhead, high ground deck, a boatlift, a high ground retaining wall parallel
and alongside the high ground deck and an additional retaining wall on the southwest corner
of the property to help prevent storm water from affecting the neighbor to the west. The
shoreline has a total length along the NHW line of 285 ft. There are single-family homes with
private docks on both sides of the proposed project along Bogue Sound.
The Division of Water Quality classifies this area as SA, ORW waters. This area is not a
Primary Nursery Area. No shellfish or SAV's were observed during site visits. This portion of
Bogue Sound is open to the taking of shellfish and is roughly a mile wide in this area. Cape
Carteret's Land Use Plan dated 2007 classifies this area as Residential. There are no shellfish
leases in this area.
10. Proiect Description:
This property shares an existing high ground basin with the adjacent property to the east. The
adjacent owners currently have three existing slips with boatlifts, dock and bulkhead. In order
for the applicants to have slips within the existing basin they are proposing two additional
slips and also to maintenance excavate the basin and channel, perform new dredging for the
new slip areas, install a 300' bulkhead, a 6'x60' high ground deck, install a 12'x12' boatlift in
one of the new slip areas, construct a high ground retaining wall measuring 70'x1' parallel and
along the sides of the high ground deck, and an additional 50' x 1' retaining wall on the
southwest corner to prevent storm water from affecting the neighboring property to the west.

In order to accomplish what is proposed the applicants are proposing to use a track hoe for the
excavation with the spoils stored a minimum of 30' above NHW. They are asking to maintenance
dredge the existing basin and channel. The basin is irregularly shaped and measures 210' in length
and 50' at its widest point. The narrowest portion is 37'. The access channel is 115' long and at its
widest point is 130' with it narrowing to 65'.
They are also proposing new dredging in a small fringe of coastal wetlands. In order to accomplish
this, they are requesting to excavate a 7' wide fringe of Coastal wetlands for a length 60'. The cubic
yards to be excavated for the total project will disturb 1179 ft2, which includes the high ground
excavation. Water depths in the existing basin are at -2.3' NLW. The final depth for the excavation
area in the existing basin will not exceed -3.9 feet below NLW. The channel is at a depth of -2.5'
and will be -3.9' at NLW when the project is complete. The connecting waters are at a depth of -
3.9ftbelow NLW. Substrate composition is mostly silt.
The applicant is also requesting a vinyl bulkhead measuring 300'. It will be installed along the
eastern and southern shorelines of the property. It will be installed landward of the NHW and
remaining coastal wetlands.
Two retaining walls are also being proposed. One retaining wall measuring 50'x 1' and will be
installed on the southwest upland corner to help prevent storm water from impacting the neighboring
property to the west. The second retaining wall will be installed parallel and along side the high
ground deck which will be 6' x 60' at grade near the head of the basin.
A 12' x 12' boatlift is requested for part of this area where the high ground deck is being proposed. A
second smaller area at this deck is also being requested as a wet slip.
11. Anticipated Impacts:
This proposed installation of the new boatlift and pilings would result in temporary turbidity
and would incorporate 169 square feet of Public Trust Area. An increase in turbidity will also
occur during excavation and incorporate 984 ft2 of shallow bottom. The area proposed for
excavation is a silt shallow bottom habitat. A small fringe of coastal marsh would be
excavated during this project and would incorporate 423 ft2. However there should be no
adverse impacts. Through site observation and aerial photos this small fringe volunteered after
the high ground basin was dredged in. There is not a potential to impact SAV's or shellfish
with docking ingress and egress due to the lack of SAV's and shellfish in this area.

The proposed project will allow for daily boating use of an existing highground boat basin
located at 551 Neptune Drive, Cape Carteret, North Carolina. The project site is located adjacent
Bogue Sound and is currently undeveloped. The property shares an existing high-ground basin
with the adjacent property located to the east.
The basin was dug from high ground portions of the two lots that now share the basin. The two
residential lots adjoining the basin are shown on the original subdivision plat for the Cape
Carterett Subdivision Part-B Section IV, Block Q as Lots 5 and 6. The plat, recorded on June 11,
1964, does not show the basin. The current area of the basin is shown as high ground areas of
Block Q, Lots 5 and 6 on the original plat.
The neighbor on the east has an existing bulkhead, dock, and three boatlifts in the basin. There
are no existing structures on the west side of the basin adjoining the Tripps' property. General
permits have been issued in recent years to the adjacent neighbor for maintenance excavation of
the basin and channel, but it is our understanding that the work was not performed.
The Tripps are applying for permits to maintenance excavate the basin and access channel and
perform new dredging within the basin near their property, install a bulkhead and boatlift, and
construct ahigh-ground deck and adjacent retaining wall. The project also includes spreading de-
watered dredge spoils on the high-ground area of the Tripps' property.
As previously noted, the shared boat basin currently contains three boat lifts/slips for use by the
neighboring property owner. The proposed work will accommodate two additional boats on the
west side of the basin, for a total of five boat lifts/slips in the shared basin.
The irregularly shaped high-ground boat basin measures 210' in length and at the widest point will
measure 50'. The narrowest portion of the basin will measure 37' in width. The access channel is
115' long and measures 130' narrowing to 65'. A trackhoe will remove a total of 984 cubic yards
of sand and mud below Normal High Water for the access channel and boat basin. High-ground
excavation will remove 195 cubic yards of sand and mud. Approximately 47 cubic yards of spoil
material will be deposited on the project site in an area located more than 30' from the shoreline
and will be contained by a sediment fence until dry. Once dry, the de-watered spoils will be
spread on low areas of the property and will also be used as backfill for the bulkhead. The
remaining spoils (approximately 1132 cubic yards) will be trucked off-site to apre-approved
disposal site.
The applicants are requesting to dredge a fringe of coastal wetlands measuring approximately 60'
in length near the head of the basin. The wetlands appear to have "volunteered" after the basin
was dredged from high ground. The purpose of dredging in this area is to allow sufficient width
to maneuver a small boat within the basin and to avoid the boat lift pilings from infringing upon
the one-quarter rule for construction within a water body.
Representatives of the NC Divisions of Marine Fisheries and Water Quality have been on-site tp g ;; ~ .~

meetings that the representatives will not object to dredging in the wetland fringe. Approximately
423 square feet of wetlands will be impacted by the work.
It should be noted that a much wider area of coastal wetlands adjoins the Tripps' property near
the mouth of the basin, as shown on the project plans. No excavation within the wider area of
wetlands is proposed.
A high-ground deck measuring 6' x.60' is proposed for construction "at grade" near the head of
the basin. The deck will be used for access to the proposed boatlift measuring 12' x' 12'. A
second small boat will be accommodated by use of a spring line attached to the deck. A retaining
wall (72' x 1') is proposed for installation parallel and along the sides of the high-ground deck.
A vinyl bulkhead measuring 300 linear feet will be installed along the eastern and southern
shorelines of the property. The bulkhead will be installed landward of Normal High Water and
the remaining wetlands. An additional retaining wall measuring 50' x 1' will be installed on the
southwest upland corner of the property to prevent stormwater from adversely affecting the
neighboring property to the west.
