Sneed Box 47 08-244.T THIS GRANT OF EASEMENT, made and entered into this c.3 day of Gac-Us7 , 201 to , by and between CORNUCOPIA COTTAGES, LLC, owners of that property described in Deed Book 4144 at Page 1656, Buncombe County Registry, hereinafter called Grantor, and The Town of Black Mountain, a North Carolina municipal corporation, hereinafter called Grantee. WITNESSETH: That the Grantors, for and in consideration of the sum of One Dollar and other good and valuable consideration in hand paid by the Grantee, the receipt of which is hereby acknowledged, have given, granted, bargained, sold and conveyed, and by these presents do give, grant, bargain, sell, convey and confirm unto the Grantee, its successors and assigns, a non- exclusive easement for the purposes of construction, use and maintenance of a concrete sidewalk said permanent easement being described as follows: LYING AND BEING in the Town of Black Mountain, Black Mountain Township, Buncombe County, North Carolina along and with the southeastern side of Montreat Road and being more particularly described as follows: BEGINNING at a number 5 rebar set in the eastern margin of the right of way of Montreat Road, said rebar being the western common corner of those properties described in Deed Book 1803 at Page 172 and Book 4144 at Page 1658, Buncombe County Registry; thence from said Beginning and with the edge of the right of way of Montreat Road North 28 ° 42' 08" East 70.29 feet to a point; thence leaving said right of way and running South 27' 15'20" West 34.53 feet to a point; thence South 27' 22' 21 " West 35.72 feet to a point in the southern boundary of the property described in Book 4144 at Page 1656; thence with said boundary North 63' 38' 47" West 1.70 feet to the BEGINNING. The Grantors herein do further give, grant, bargain, sell and convey unto the Grantee, its successors and assigns, a non-exclusive temporary construction easement for the purposes of excavating, digging ditches, storing dirt, supplies and materials, moving and using equipment and generally carrying out the completion of the construction of said sidewalk, together with the full right of reasonable access to and egress from said temporary construction easement over and upon the above -referenced Property or other property of Grantor, for all purposes in connection with said construction and installation, it being understood that this right of use as set out in this paragraph shall terminate upon the final completion of the entire project, said temporary construction easement being more particularly described as follows: BEGINNING at a point in the common boundary of those properties described in Deed Book 1803 at Page 172 and Book 4144 at Page 1658, Buncombe County Registry, said point being located South 63' 38'47" East 1.70 feet for the western common corner of said properties; thence from said Beginning North 27' 22' 21 " East 3 5.72 feet to a point; thence North 27' 15' 20" East 3.47 feet to a point in the eastern edge of the right of way of Montreat Road; thence with said right of way North 28' 42' 08" East 38.47 feet to a number 5 rebar marking the western common corner of those properties described in Book 4144 at Page 1658 and Book 2384 at Page 772, Buncombe County Registry; thence with the common boundary of said properties South 56' 32' 17" East 27.89 feet to a point; thence leaving such common boundary and running South 26' 17' 25" West 17.14 feet to a point; thence North 51 ° 48' 00" West 11.19 feet to a point; thence South 27 ° 15' 20" West 54.99 feet to a point; thence South 27' 22'21 " West 3 5.40 feet to a point in the common boundary of those properties described in Deed Book 1803 at Page 172 and Book 4144 at Page 1658, Buncombe County Registry, thence with said boundary North 63 ° 3814711 West 18.00 feet to the BEGINNING. TO HAVE AND TO HOLD the above described easement with all appurtenances thereunto belonging or in any wise appertaining, unto the Grantee, its successors and assigns forever.
