On October 9, 2015, Niki Maher and Shelton Sullivan of DWR conducted an on-site determination to review features located on the subject property for applicability to the Neuse Riparian Buffer Rules (15A NCAC 2B.0233). The feature that was evaluated is labeled as "A" on the attached map initialed by Niki Maher on October 9, 2015. During their review, Ms. Maher and Mr. Sullivan evaluated the feature using the DWR Stream Classification Form and assessed a score of 27.5 points. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent." The form is attached to this letter. The DWR has determined that the feature labeled as "A" on the attached map is at least "intermittent" and is subject to the Neuse Buffer Rule. This determination shall replace the determination originally performed by the DWR Raleigh Regional Office on August 24, 2015 and shall expire five years from the date of this letter. This determination can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH) within sixty (60) calendar days. This law changed the application of the Neuse Riparian Buffer Rules (.15A NCAC 0213 .0233) and Tar-Pamlico-.R'iparian Buffer Rules (15A NCAC 02B.0259). If all of the previously listed requirements are met, what does that mean for my property? .The protected riparian buffer has not changed with this law. The 30 feet closest to the water or coastal marsh (Zone 1) must remain undisturbed, the outer 20 feet (Zone 2) may be managed vegetation. She determined that stream on the north property boundary was intermittent and required a minimum 50 foot buffer from the top of the stream bank per DEHNR watershed rules. This lot is located in the Ellerbe Creek Watershed. A 50 foot stream buffer will make this lot unbuildable for us. Ms Smith said that her determination was border -line and advised that we should appeal to you and that you might determine otherwise. And so Durham Habitat for Humanity respectfully appeals this decision, and requests your soonest consideration.
