This is my observations and comments, based on the site visit:
1)The Corp verification was expired
2)There WAS FLOW throughout the channel/wetland proposed for impact
3)Therefore, at this time, based on the above, it is my opinion that the channel be considered perennial and
subject to mitigation, which would also include the previous impact at the site. Same project, same owner,
same property.
4)It appears that the layout of the facility did not take into account the stream during the initial
construction/planning phase and there are questions of avoidance and minimization.
5)Based on observation, there are options. A breeze way could be constructed, “attaching” the buildings. The
buildings could be pushed back more. A slight realignment of the road connecting to parking. It appears the
concept of design was more fluid/circular which may require greater use of land. These are just quick thoughts
of possibilities.
Not being involved in the first permit, I am not sure what was discussed as to the plans for the future at that time. If
there were plans for expansion, it might have been prudent to have DWR involved from the beginning. Thanks, Alan
