PROJECT SUMMARY: The applicant proposes to construct a 48-Lot residential subdivision including infrastructure, amenities, utilities, timber-bridge, boardwalks, retaining wall and kayak launching facility. Watermark New Hanover, Lp Page Two PROJECT DESCRIPTION: McKim and Creed, P.A., representing Watermark New Hanover, Lp, has requested that the attached application be processed under the Express Permit Review Program. The project site is located along River Road, adjacent to the Cape Fear River, in New Hanover County. To get to the property take College Road south from Wilmington and turn right (west) onto Sanders Road. Continue west on Sanders and the road will dead end at the intersection of River Road. Turn left onto River Road and the property will be located on the right hand side, approximately 3.5 miles from the intersection of Sanders Road and River Road (directly across from the The Cape Boulevard). The entire property is 32.94 acres in size, however, only approximately 10.0 acres is high ground. Roughly two-thirds of the site is comprised of both "404" and Coastal Wetlands. High ground vegetation at the site consists of Live Oak, Laurel Oak, Magnolia, Pine, Maple, Cedar and Sweet Gum. Understory vegetation consists of Red Cedar, Wax Myrtle and Baccharis. The upland portions of the property are bordered by either "404" or Coastal Wetlands. Coastal Wetlands species include: Smooth Cordgrass (S artina alterni ora), Black Needle Rush (Juncus roemarianus) and Salt Meadow Grass (~artina patens), Giant Cordgrass Martina cynosuroides) and Cat-tails (T has ..The site is currently undeveloped, with the exception of a gravel entrance drive and timber bridge. The Wilmington-New Hanover County Land Use Plan classifies the area as Conservation. The waters of the Cape Fear River are classified SC, by the Division of Water Quality. The area is designated as a Primary Nursery Area (PNA), by the Division of Marine Fisheries and is CLOSESD to the taking of shellfish. PROPOSED PROJECT: The applicant proposes to construct a 48-Lot residential subdivision including infrastructure, amenities, utilities, timber-bridge, boardwalks, retaining wall and kayak launching facility. Beginning along the western side of River Road, the applicant proposes to install three entrance drives for subdivision access. Diligence Trail, Marada Way and Bimini Lane would be constructed within a 40' right-of--way and consist of a 20' wide paved asphalt drives. Utilities to the subdivision would run within the right-of--way, beneath the proposed roads. Both Diligence Trail and Bimini Lane would provide access to two isolated peninsulas and Marada Way would provide access to the far western portions of the subdivision. Marada Way would intersect Scotia Run, which would provide access to Skipjack Trail and Laynards End (i.e. other remaining peninsulas). The construction of Scotia Run would result in the filling of approximately 8,276 sq. ft. of "404" wetlands. The U.S. Army Corp of Engineers, on 2/28/07, approved this fill activity under Nationwide Permit 14 (AID#2001-1253-065), however, the Nationwide Permit has recently expired. Prior to any filling, the applicant proposes to install a 36" x 36' RCP culvert in the center of the proposed fill area. A retaining wall (See Sheet E6 for detail) would be installed along the upper "404" wetlands limits of each peninsula, or island, to retain the fill material being brought onsite. In addition to the Nationwide Permit 14, the County of New Hanover issued a CAMA Minor Permit (#07- 063)for the construction of a 26' x 134' timber access bridge that crosses both "404" and Coastal Wetlands. The CAMA Minor Permit was issued on 10/3/07. The approved vehicular bridge, once constructed, would connect Skipjack Trail to Scotia Run, providing access to the far western peninsula. Planned utilities to Skipjack Trail would be connected to the bridge and no directional boring would be required. The applicant does however; propose to remove an old culvert from the area beneath the bridge. The culvert would be removed via a pulley system that would be connected to an excavator. This process would be performed to eliminate any disturbance to the surrounding Coastal Wetland vegetation. Watermark New Hanover, Lp Page Three The remaining upland development being proposed under this application includes the construction of a swimming pool, pool house, clubhouse, parking areas and pump station. The pool, clubhouse and club parking area would be located along the northern side of Marada Way, at the entrance of the subdivision and the pump station would be located at the intersection of Marada Way and Scotia Run. As proposed, each peninsula and/or island would be connected by a maze of boardwalks (See Sheet E4 for details). Nearly all of the boardwalks would be constructed over "404" wetlands with a small portion being constructed over Coastal marsh. A viewing platform (6' x 50') would be constructed above "404" wetlands, between Marada Way and Bimini Lane. The boardwalk, to which this platform is connected, would provide access to the kayak launching facility located along the southern shoreline, bordering a narrow tributary of the Cape Fear River. Additionally, this boardwalk would provide access, via an elevated boardwalk, to a separate island located south of the tidal creek. As proposed, the elevated boardwalk would be constructed approximately 6' above Normal High Water (NHW) along the entire width of the navigable waterbody (See Sheet E12 for details). The remaining sections of boardwalk would be constructed a minimum of 3' above the marsh substrate. A viewing platform would be constructed along the western side of the property in the Cape Fear River. This platform (6' x 10') would be fixed and extend just beyond the NHW line. As mentioned, the applicant proposes to construct a 10' x 30' fixed kayak launch platform along the southern portion of the property. The platform would extend beyond the Normal Low Water (NLW) contour, within `/4 of the width of the waterbody. Water depths in the vicinity of the proposed launch range from -0.6 to -2.0' below NLW. ] 0. ANTICIPATED IMPACTS: As proposed, the planned pier and boardwalk development would be located within the applicant's area of riparian access. Additionally, the proposed structures do not appear to extend beyond'/4 of the width of the waterbody. As proposed, the boardwalks and high ground platforms are located within New Hanover County's Conservation Overlay District. Approximately 1,236 sq. ft. of estuarine and public trust waters would be incorporated as a result of platform construction. The construction of the proposed roadways, parking area, homesites, boardwalks and platforms, including all fill activities would result in the disturbance of approximately 422,096 sq. ft. of high ground. Approximately 13,252 sq. ft. of "404 type" and coastal wetlands would be shaded as a result of the boardwalk and platform installation. The proposed fill activities would result in the disturbance of 8,276 sq. ft. of "404" wetlands. If applicable, each individual lot owner would be responsible for obtaining his or her own CAMA Minor Permit for residential construction. Submitted by: Jason Dail Date: March 25, 2008 Office: Wilmington Watermark Landing LAMA Major Project Narrative Feb/08 Project Description Watermark Landing is a 32.94 acre tract of land, located in New Hanover County at the 8400 River Road (SR 1100), approximately 3.5 miles south of the intersection of River Road (SR 1100) and Sanders Road (SR 1187). T`he existing site is undeveloped and sparsely to moderately wooded with undisturbed upland and wetland areas with mature trees and under story growth. Adjacent to Watermark Landing is the residential subdivision, The Cape. Along the north and south perimeter of the site, there are several undeveloped wooded areas which abut the Cape Fear River. Watermark Landing will consist of 48 single family home sites. These homes will be constructed within the upland pockets throughout the site in order to avoid impact to the coastal wetland areas as well as 404 wetland areas. No homes will be built within the 75' Area of Environmental Concern along the normal high water line of the site. Coastal wetlands, 404 wetlands, mean high water line, and areas of environmental concern have been established and are depicted on the site plan in this package. All required permits to construct these homesites have been obtained. As granted by an existing' CAMA Minor Permit, there will be a timber deck bridge connecting two upland pockets. There is an existing culvert to be removed from this area in order to construct the bridge. The existing deteriorating culvert will be removed by hand tools. Sidecast will be placed in the uplands. The pipe will be pulled and the area will be restored to match surrounding contours and grades. Regulations for building in and around Areas of Environmental Concern have been adhered to in the development of this project. The 6' wide boardwalks are for pedestrian use to promote exercise and appreciation for the natural environment. There will be a community clubhouse with a pool and adequate parking for residents and their guests. The density calculation is 1.457 homes per acre. Features One of the main features of the site is the elevated boardwalks. The boardwalks are to be constructed out of timber decking and piles. The 6' wide boardwalks are for pedestrian use to promote exercise and appreciation for the natural environment. Along the board walks, there are "tree save areas" that also allow for the viewing of the preserved wetlands. /rte ~~ i 1,~~~ ~ ~ F~~ 2 ~ ZOQB ~~~f~sEON ~F ~;C)ASTAL MANAGEMENT A second feature of the site is the bulkhead surrounding the upland areas. In order to provide wetland. protection and a safe finished floor elevation, the existing uplands will be built above the 100-year flood elevation (10.0') with the installation of 5,615' of 18" wide vinyl sheet pile retaining walls. Improvements will consist of the clearing and grubbing, wall installation, and fill material. . ,w .. ; °.a .. ...,; ~ ~~ . A third feature of the site is the floating kayak launch with adjacent picnic area. This floating platform area is connected to a pier which is a part of the 6' wide boardwalk. The kayak launch is to promote active and passive recreation as well as to provide residents the ability to enjoy their beautiful community. The launch is located within a navigable channel which runs perpendicular to the Cape Fear River. Permits The project has received all site development permits except for NCDOT. The limited uses include elevated boardwalks, kayak launch and a vehicular bridge. This request pertains to SAW 2001 1253 065. This is needed to meet the open space requirements for New Hanover County as shown in the County approved plan. These features contribute to the open space requirement. January 2007 Introduction The Watermark Landing tract is located in the vicinity of Carolina Beach, approximately 1.0 mile north of the confluence of Snows Cut and the Cape Fear River in New Hanover County, North Carolina (Figure 1). Through early coordination with the State Historic Preservation Office (SHPO), it was determined that the tract contained one previously recorded archaeological site for which no recommendation of significance had been advanced, and two landforms that were considered to have high potential for the presence of cultural remains (Figure 2). Mr. Nathan Henry, SHPO Archaeologist, requested that an archaeological survey of the high potential landforms in the tract be conducted. He further requested that the previously recorded site, 31NH133, be relocated and evaluated for its potential eligibility for the National Register of Historic Places (NRHP). Site 31NH133 was recorded in 1977 by Mark Wilde-Ramsing (site form on file). He described the site as a Woodland Period (1000 BC - 1100 AD) artifact scatter situated on a rise overlooking a marsh that was bisected by State Route 1100/River Road. Based on this fact, only a portion of the site would be situated in the Watermark Landing project area. He collected three pieces of pottery and 12 pieces of lithic debitage from the ground surface but did not conduct any subsurface excavations. Based on the presence of the lithic artifacts, Wilde-Ramsing recommended that the site be investigated further to determine the extent of the deposits present. Archaeological Investigation Survey Areas. Archaeological Consultants of the Carolinas, Inc., conducted an intensive survey of the high potential landforms delineated by Mr. Henry. This survey consisted of 20 meter interval shovel testing and comprehensive examination of all exposed ground surface. Landform 1, in the northwestern corner of the project tract is a subtle rise surrounded on three sides by marsh. This Landform extends northward beyond the tract boundaries. This Landform is wooded with light undergrowth (Figure 3). Landform 2 is situated in the northeast corner of the tract. This Landform is also wooded with light to moderate undergrowth (Figure 4). Landforms 3 and 4 are sparsely wooded with light undergrowth (Figures 5 and 6). Although not delineated as a high potential area, Landform 3 was accessible via a dirt road that ran through Landform 4, and was also examined. Four archaeological sites were identified during this investigation. Each site was fully defined and evaluated for its further research potential and eligibility for the NRHP. Field Site 1 is located on Landform 1 (see Figure 2). This site is a subsurface scatter of historic and prehistoric artifacts. Shovel tests were excavated at 10 meter intervals to define the site boundaries. Ten tests yielded artifacts and site dimensions of 40 by 30 meters were established based on the distribution of these positive tests. Historic artifacts recovered from shovel tests include lead fragments, unidentifiable metal fragments, two pieces of annular whiteware, one piece of undecorated porcelain, and numerous brick fragments. Prehistoric artifacts recovered consist of three metavolcanic flakes, one cordmarked sherd, two fabric impressed sherds, and five residual sherds (<2 cm in diameter). To further explore the site deposits, two 50 by 50 cm units were excavated beside shovel tests that had the highest artifact density. The first of these larger units was placed near the center of the site and yielded four metavolcanic flakes and four residual sherds. The second 50 by 50 cm units was placed along the western edge ofthe site and yielded one metavolcanic flake and one piece of unglazed redware. The cordmarked and fabric impressed sherds represent a Woodland occupation at the site and the historic ceramics indicate a 20`h century occupation. There has been mixing of the historic and prehistoric material. Based on these factors, this site is unlikely to add significant information to our understanding of prehistoric and historic settlement in the site area. We consider Field Site 1 to be ineligible for the NRHP and recommend that no further work be required. Field Site 2 is located on Landform 2 (see Figure 2). This site is situated on the crest of the landform and is bordered by River Road. Three shovel tests, excavated at 10 meter intervals, yielded prehistoric ceramics. Additional shovel tests were excavated at 5 meter intervals around the original positive tests. None of these subsequent shovel tests contained artifacts. Site dimensions of 5 by 20 meters were established based on the placement of the three positive tests. Two of the shovel tests yielded three and four ceramic sherds, respectively. These sherds are cordmarked and plain with grog and sand temper. Twenty-two sherds were recovered from the third shovel test, nearest to River Road. Fourteen of those are residual. The remaining eight include cordmarked and plain with limestone or grog temper and plain with sand temper. Wilde-Ramsing stated that he recovered one shell tempered White Oak sherd from site 31NH133. However, recently the White Oak ceramic type has been shown to actually be limestone tempered is not called Hamps Landing. As we recovered Hamps Landing wares, we considered that this site could be that previously recorded resource. The topographic map does not shown the geographic detail present on the project map that Mr. Henry reviewed and this site's termination at the road matches the description of 31NH133. In order to evaluate the overall integrity of the site deposits, we excavated two 50 by 50 cm units between the positive shovel tests. Both of these units were excavated to a depth of 1 meter. Neither yielded artifacts. A 1 by 2 meter unit was placed beside the high density shovel test near the road. This unit was excavated in eight 10 cm levels. Artifact density was very low except in Level 4 (30 to 40 cm below surface [curbs]). This level yielded 32 sherds from at least three different vessels, half of which are residual. One vessel is plain with limestone temper, another is plain with sand temper, and the third is eroded with coarse sand temper. One of the sherds from the third vessel has partial mend hold. Anon-diagnostic milky quartz projectile point base was also recovered from this level. No artifacts were recovered below 50 curbs. As noted, this site may be 31NH133. The site deposits are most dense right at the road, which has bisected the landform. The close interval shovel testing confirms that the site deposits are limited to a narrow sliver along the top of the landform and the density at the road strongly suggests that the larger part of this site once extended to the east. We did not recover any preserved organic material or find any evidence of intact features. Due to the likelihood that we have defined only a portion of a once larger site and the lack of organic material, issues of intrasite patterning, subsistence, and site dating cannot be addressed. We therefore considered that Field Site 2 has fulfilled its research potential at this level of investigation and will be recommending it ineligible for the NRHP. ~~ D 6 ~~~ 1 2 ~~QOS ~lv ~sloN o~ GOASTAI-- MANAGEMENT Field Site 3 is located near the western tip of Landform 4 (see Figure 2). A total of four sherds were recovered from three shovel tests. One of these sherds is residual. The other two are fabric impressed with sand and limestone temper. These three tests are situated in an area between a modern trash dump and a large pile of downed trees and stumps. As with Field Site 2, shovel tests were excavated at 5 meters intervals around and between the positive shovel tests. No additional artifacts were recovered and site dimensions of 5 by 25 meters were established based on the distribution of the three artifact bearing tests. Due to the limited nature of the site deposits and the high level of disturbance to the area, this site is not considered to have sufficient research potential to meet NRHP eligibility criteria. Field Site 4 is located at the eastern edge of Landform 4 (see Figure 2). This landform has been cut for River Road and there is an approximate 2-meter difference in elevations between the remnants ofthe landform and the road bed. One shovel test at the road edge yielded a quartzite flake. Supplemental shovel tests were placed around the initial positive at 5 meter intervals. One of these shovel tests yielded one residual sherd; the other yielded six plain sherds, all of which mend. It is likely that this site once continued along the landform eastward before it was bisected by River Road. As with Field Site 3, the Field Site 4 deposits are very limited and unlikely to yield significant information on prehistoric settlement in the project area. This site has fulfilled its research potential at this level of investigation and will be recommended ineligible for the NRHP. Conclusions This investigation has resulted in the identification and documentation of four archaeological sites. It is our contention that our Field Site 2 is the previously recorded 31NH133. None of these sites have retained sufficient integrity or contain significant enough deposits to be able to contribute important information to our understanding of past lifeways in the project vicinity. As such, none of these sites meet NRHP eligibility criteria.
