On May 26, 2016, Charlotte -Mecklenburg Storm Water Services (CMSWS) is requested the re -authorization of the
Louise Avenue capital improvement project (Project). The purpose and need for the Project is to improve the storm
drainage infrastructure (i.e. pipe systems and culverts) to reduce flooding and to enhance degraded stream reaches to
reduce erosion and improve water quality. This project is located in Charlotte, North Carolina, just east of
downtown along an unnamed tributary to Little Sugar Creek (Project Vicinity Map, enclosed). CMSWS is hereby
submitting an addendum to the aforementioned re -authorization request in an effort to provide more accurate and
complete information.
A Jurisdictional Determination and Nationwide Permit (Action ID 2011-00366) were issued for this project by Ms.
Amanda Jones on March 2, 2011. Ms. Coleen Sullins issued Water Quality Certifications (DWQ No. 11-0022) for
the project on January 13, 2011. The project was delayed in order to allow time to update the plans to meet new
design standards from various agencies and City Departments. This included updated NCDOT standards, updated
and new City of Charlotte storm water and stream restoration details and standards, and new CDOT handicap
accessibility standards. With each update of standards there were delays for negotiating design fees, field surveys,
plan revisions, and subsequent City reviews. Both the jurisdictional determination and the nationwide permits
expired during this lengthy construction plan update process. Proposed impacts remain unchanged from the
originally permitted impacts. Project impacts are proposed to perennial RPW streams and include pipe extension,
placement of plunge pools and rip rap energy dissipaters, longitudinal channel adjustments to accommodate pipe
system upgrades, and stream enhancement activities. Proposed project impacts are illustrated in the newly annotated
Louise Avenue CIP Construction Plans (enclosed) and overall project area map and are summarized in Table 1
below.
As additional clarifying information, the existing culvert under Louise Avenue is shown as buried 1 foot on the
construction plans from that culvert installation; therefore, the extension of this culvert will be constructed to match
the existing elevation of the culvert. If the culvert was originally installed correctly, the extension should also be
buried 1 foot to allow for aquatic life passage. The step -pool sequence described as impact S2 is proposed to have a
maximum drop of 12" to the water surface elevation at any point. This can be seen in the attached permitting plan
set on detail sheet 2R.

The original pre -construction notification noted that stream enhancements associated with the Louise Avenue CIP
would provide mitigation for cumulative permanent impacts within the watershed; however, it was recently
discovered that easements acquired during the real estate process are inadequate to support a mitigation project. As
such, the revised Louise Avenue CIP mitigation plan consists of purchasing 198 SMUs from the City of Charlotte
Umbrella Mitigation Bank to offset permanent impacts of 198 linear feet (1:1 ratio confirmed by Ms. Amschler on
7/19/16). 42 SMUs will be purchased to offset permanent impacts associated with the Siegle Avenue Culvert
Replacement project (USACE Action ID: 2009-00680) and 156 SMUs will be purchased to offset the permanent
impacts associated with the Louise Avenue CIP.
CMSWS respectfully requests re -authorization of the project under the USACE Wilmington District's nationwide
permit program. Potential adverse water quality impacts associated with construction storm water runoff will be
managed in accordance with NCDENR NPDES General Construction Storm water Permit, NCGO1000, and the
