Modification of Impacts to Crossing #2 and Special Condition "L"
Dear Mr. Thomas & Ms. Higgins:
Please consider this letter our formal request on behalf of the Permittee for a modification to
Crossing #2 and to Special Condition "L" of the approved Individual Permit No. SAW -2008-01712
issued on April 22, 2010 & January 9, 2013 and Individual Certification No. 3766 (DWQ Project
#20061804, Ver.3) issued on March 15, 2010 & February 22, 2013.
Crossing #2
In our original approvals, the permittee was authorized to impact 115 linear feet of permanent and
20 linear feet of temporary Important/Perennial stream for Crossing #2. It was understood at that
time, that the project engineer would not be able to provide a final design of the stream
crossing(s). At this time, the project engineer has been able to re -review Crossing #2 and is
proposing to reduce the permanent impacts to the stream by 29 linear feet. In addition, proposed
riparian buffer impacts have been reduced by 3,423 ft2. Please see table below summarizing
previously approved and the proposed modifications to Crossing #2.
Special Condition "L"
Special Condition "L" currently reads as follows:
"L. In order to compensate for 0.0122 acre of permanent impacts to wetlands, 0.005 acre of temporary
impacts to wetlands, 868 linear feet of permanent impacts to streams, and 220 linear feet of temporary
impacts to streams the permitee shall make payment to the North Carolina Ecosystem Enhancement
Program (NCEEP) in the amount determined by the NCEEP, sufficient to perform the restoration of
0.214 acre of non -riparian wetland and 868 linear feet of warm water stream in the Neuse River Basin,
Cataloging Unit 03020201.

Construction within jurisdictional areas on the property shall begin only after the permittee has made
payments per the below mitigation table to the NC EEP and provided a written confirmation the Corps
that it agrees to accept responsibility for the mitigation work required, in compliance with the MOU
between the North Carolina Department of Environment and Natural Resources and the United States
Army Corps of Engineers, Wilmington District, dated November 4, 1998.
The Applicant will make phase mitigation payments to the NCEEP as listed in the table below. The cost
of credits will be the current price at the time of payment, not the current price at the time the permit was
issued. No work on any phase of the project shall begin until the payment for that phase has been
issued to the NCEEP.

In an effort to follow current mitigation policies, the Permittee has authorized us to contact private
mitigation banks. Agreements have been made with the sponsor of the Neu -Con Wetland &
Stream Umbrella Mitigation Bank, Environmental Banc & Exchange (EBX), as outlined in the
table below and attached reservation letter.
Please send us confirmation that this proposal to reduce impacts and to pay into the Neu -Con
Wetland & Stream Umbrella Mitigation Bank vs. the NC Ecosystem Enhancement Program is

Re Project: Village at Flowers Plantation -Crossing #2
This document confirms that River Dell Company, Inc. (Applicant) for the Village at Flowers
Plantation -Crossing #2 (Project) has expressed an interest to utilize 86 Stream Mitigation Credits from
the EBX-Neuse sponsored Neu -Con Wetland & Stream Umbrella Mitigation Bank, specifically the
Buffalo Branch Site in Neuse HUC 03020201. As the official Bank Sponsor, EBX, attests to the fact that
mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
