Enclosed is a NWP 29 Application submitted on behalf of Brian and Kathleen Kowalski for their lot
located at 5005 Dockside Drive (Lot 62) within the Helms Port Subdivision in Wilmington, NC. The
applicants wish to construct a house, swimming pool, and detached garage within the lot, which will
result in 0.05 acre of wetland impact. They propose to purchase 0.10 acre of non -riparian wetland
credit from the Lower Cape Fear Umbrella Mitigation Bank to mitigate for these impacts. Note that the
developer of the subdivision obtained a CAMA Major Permit (#24-81), 401 WQC, and GP 291 that
authorized impacts to 0.041 acre of coastal wetlands (for the upland basin marina) and 0.038 acre of
RPW for lot development. Other lot owners have recently applied for NWPs to fill wetlands.
Cumulative impacts for the subdivision are still below 0.5 acre.
