PROJECT SUMMARY: The applicant proposes to construct an elevated boardwalk access over Coastal Wetlands, construct 2 platform access areas for kayak launching, and construct a single boatlift in the Currituck Sound. Twiddy Family Partnership, LLC c/o Hadley Twiddy Currituck County Express Permit Review Program Project setting Warren Eadus with Quible & Associates, on behalf of Twiddy Family Partnership, LLC (c/o Hadley Twiddy), has requested the attached application be processed under the Express Permit Review Program, for a boardwalk and kayak launch under the name of Coastal Explorations. The ±10.9 acre project site is located on Lot 2 in the Lighthouse Club Subdivision on SR 1185 (Corolla Village Road) in the Village of Corolla immediately north of the Corolla Lighthouse on Currituck Sound in Currituck County. The tract averages ±275' wide by ±1,721' deep and extends from Corolla Village Road to the Currituck Sound. With the exception of a small irregularly shaped area of uplands (±12,723 ft2) adjacent Corolla Village Road, the majority of the property (±427,222 ft2) has been delineated as Section 404 wetlands by Tom Steffens of the US Army Corps of Engineers (USACOE). Additionally, most of the wetland area is Coastal Wetlands dominated by Spartina cvnosuroides with a small amount of S.patens and Juncus roemerianus adjacent the waters edge. The upland area adjacent Corolla Village Road is vegetated with oaks, some pines and has an under story of herbaceous shrubs, vines, and upland grasses, and then transitions into a wooded wetland as you move towards the Sound. The wooded wetland quickly transitions to Coastal Wetlands. A large "pond" with connection to Currituck Sound encroaches onto the property along the northwest property line with the remainder of the property to the upstream (northwest) side being undeveloped and vegetated similarly to the applicant's. The adjacent property to the downstream (southeast) side is also undeveloped and vegetated similarly to the applicant's. The property has ±315' of shoreline along Currituck Sound and according to the applicant, water depths approximately 200' offshore are ±3' below the normal water level (NWL). The near shore area at the project location is known to have a significant amount of submerged aquatic vegetation (SAV). Elevation of the property is ±1' above the NWL. Currituck Sound at this location is classified as SC by the Environmental Management Commission. Currituck Sound at the project location is Joint Waters but is closed to shell fishing. Project Description The applicant proposes to develop an Eco-tourism business at the site with kayak rentals and education programs. A ±6' wide by ±1,495' long boardwalk from the upland area at Corolla Village Road across the Coastal Wetland out to Currituck Sound is proposed for access. The boardwalk will be elevated a minimum of 4' above the wetland substrate as measured to the bottom of the decking. The boardwalk will run adjacent to the "pond" and a ±14' by ±22.5' platform is proposed at this location. Two - ±2' 7" wide by ±8' long cantilevered kayak racks are proposed at this location off the boardwalk to provide storage for 14 kayaks. Three - ±1'6" wide by ±3' long cantilevered gear rest are proposed along the boardwalk to provide a rest area when transporting the kayaks out to the platforms. At the NWL of Currituck Sound, the boardwalk will change to a ±6' by ±200' pier including a ±20' by ±24' platform at the terminal end. The entire structure will be elevated a minimum of 4' above the NWL as measured to the bottom of the decking except for a ±4' by ±18' and ±4' by ±16' section of platform that will be stepped down giving access to the Sound for kayak launching. These two sections of platform will be constructed using synthetic lumber, with the deck boards running longitudinally, with 1.5" gaps between the decking, to allow for some light penetration through the decking. A ±12' by ±20' uncovered boatlift is proposed adjacent the back or inside section of the platform to provide a slip for a shallow draft chase boat. The applicant proposes to use a portable generator or hand crank lift for the proposed boatlift. The water depth at the proposed boatlift location is ±3' below the NWL. Two additional ±2'7" wide by ±8' long cantilevered kayak racks are proposed at this location off the pier to provide storage for 14 kayaks. The applicant proposes to provide parking by utilizing existing parking spaces ±200 yards to the north of the project site on Corolla Village Road in an area of restored historic buildings and commercial shops that are currently owned by the applicant. No impervious surface is proposed within the 75' Coastal Shoreline Area of Environmental Concern (AEC). No utilities are proposed for the project. Anticipated Impacts The project as proposed will result in the shading of ±1,995 ft2 of Sound and "pond" bottom. Approximately ±8,970 ft2 of Coastal Wetlands will be shaded by the construction of the boardwalk. No impervious surface is proposed within the 75' Coastal Shoreline Area of Environmental Concern (AEC). The proposed development will result in localized short-term turbidity. David W. Eadus cc Coastal Explorations file enc bulleted Coastal Explorations Twiddy Family Partnership, LLC Major CAMA Permit Application-Express March 19, 2008 PROPOSED PROJECT DESCRIPTION Introduction The proposed project involves the construction of 1,495 linear feet of elevated wooden walkway from existing uplands (USAGE approved wetlands delineation-01/09/08 attached) over USACE and DCM jurisdictional wetlands to access a proposed 315 sf wooden educational platform and kayak launch (adjacent to the pond on site), 2001f of six feet wide wooden pier over the Currituck Sound to access a 480 sf wooden educational platform and kayak launch and one 12 feet by 20 feet boat slip with lift for a support skiff. The proposed walkway and platforms will provide an outdoor classroom and direct public water access to the Currituck Sound and adjacent coastal waters for purposes of offering an Ecology (Eco) Tour of the area by water. The site is an approximately 10 acre parcel centered around latitude 36.3773935 ° north and longitude 75.8343340° west. A copy of the relevant portion of the USGS topographic quadrangle-Corolla, with the site identified has been included this CAMA Major Permit Application Package. Site Operation/ Structures The site is currently undeveloped. The applicants propose to construct 1,495 linear feet of a 6 feet wide slotted wooden walkway extending from the uplands on site to the Currituck Sound. A 14 feet by 22.5 feet education platform and kayak launch will be constructed at the location of the "pond" and a 20 feet by 24 feet education platform and kayak launch will be constructed at the end of a 200 linear feet by six feet wide pier in the Currituck Sound. Each platform will be equipped with cantilevered kayak racks attached to the walkway leading to the respective platforms as shown on the attached site plan. The primary function of each platform is providing and area for an outdoor classroom associated with the Eco-tour. Each platform will have a lowered walkway/platform necessary for safely launching kayaks. Water depths at the waterward end of the proposed 200 linear feet of pier and the one proposed boat slip are three feet below normal water level. Water depths were measured relative to normal water level on January 31, 2008 and are shown on the attached site plans. The boat slip and lift will be used for the support of the Eco-tour. A small generator or hand crank will be employed to power the small lift. There are no proposed utilities on either of the platforms or walkway. The walkway over coastal wetlands will be elevated four feet above the substrate. The pier and platforms will also be elevated four feet above normal water with the narrow kayak loading piers approximately six to eight inches above normal water. At approximately 300 feet intervals along the walkway, a cantilevered kayak and gear rest (shelf) will be installed to allow for the passage of foot traffic and a place to rest while transporting any kayaks or gear out to the platforms. A permanent cantilevered kayak rack will be installed adjacent to each platform as shown on the attached site plans. The kayak racks will be capable of storing approximately 14 boats at each of the platforms. Each platform will have steps down to a kayak access pier that will allow for safe kayak launching and unloading. Each kayak launching platform will be 4 feet wide and the decking will be constructed with Trex® or similarly manufactured synthetic lumber on end with gaps to allow sunlight to penetrate to the maximum extent possible while still retaining functionality (estimated at 40 percent sunlight penetration by marine contractor). Parking and ticket sales will be available at the existing retail shops located approximately 200 yards north of the site just off Highway 12. The retail shops and existing parking (shown on the attached aerial photography) are also owned by the applicants. Stormwater Management There are no proposed impervious surfaces associated with this development. Therefore, no stormwater management plan is required. Water and Sewer Existing bathrooms at the retail shop owned by the applicants and in close proximity to the site will be available for the Eco-tour customers. Wastewater is disposed of via a permitted on site septic system. Water is provided by the Currituck County water distribution system. This request would facilitate the construction of a pier on the subject property, from which kayak tours would be available to the general public. There are several policies in the Currituck County 2006 Land Use Plan that support this type of endeavor. Some are as follows: • POLICY OB5: Currituck County, through its actions and decisions, shall seek to preserve the historic character and heritage of the Corolla Village area of the Outer Banks. • POLICY PA1: Public access to the sound and ocean waters of Currituck County is essential to the quality of life of residents and visitors, as well as the economy of the area. The County supports the establishment of additional public and private access opportunities to the waters of Currituck County. • POLICY PA2: The County supports many forms of "access" to the water, including scenic outlooks and boardwalks, boat ramps, marinas and docks, fishing piers, canoe and kayak launches, and other means of access. Whenever possible, such facilities shall be designed to accommodate the needs of handicapped individuals. • POLICY ES5: Uses allowed in estuarine waters must be water dependent (public access, docks, piers, erosion control, and other CAMA-approved uses) and must not interfere with the proper function, cleanliness, salinity, and circulation of the resource. • POLICY WQ5: Development that preserves the natural features of the site, including existing topography and significant existing vegetation, shall be encouraged. • POLICY ED1: new and expanding industries and businesses should be especially encouraged that: 1) diversify the local economy, 2) train and utilize a more highly skilled labor force, and 3) are compatible with the environmental quality and natural amenity- based economy of Currituck County. • POLICY HP3: Development of the tourism and educational potential of the areas architectural, historic and cultural resources shall be encouraged. It does appear this request as presented is consistent with the policies and objectives of the Land Use Plan. The Planning Department is particularly encouraged to see a growing emphasis on eco- tourism industries that expose the general public the natural resources of Currituck County. For the reasons listed above, Planning staff is inclined to recommend approval of the required Special Use Permit for an outdoor recreational use at 1118 Corolla Village Road. 1118 Corolla Village Rd.
