No. 2006-41496-043 Approval of 401 Water Quality Certification with Additional Conditions Dear Mr. McMillan: This is in reply to DWQ's issuance of Certification No. 3726 (dated January 28, 2008) to Mr. Bruce Blackmon of the Carolina Lakes Development Company (CLDC). While CLDC is pleased in general to abide by the additional conditions of the certification, we wish to note that there is one condition listed that should not be applicable according to NC Certification Standards, viz., Condition 6, "Written Stormwater Management Plan." Per the state certifications for residential developments, a SMP is required whenever a relevant project "contains one or more drainage areas that has or is anticipated to have impervious cover of equal to or greater than 24 percent." Based on our calculations ofproject-related impervious cover resulting from housetops, roads, driveways, utility features, etc, the expected impervious surface for the subject project will be only 19.8%. Consequently, a SMP should not be required for this project. On behalf of CLDC, AWCK, Inc. is requesting that DWQ please acknowledge to CLDC that Condition 6 of Certification No. 3726 does not apply. Please feel free to contact Mr. Bob Bracken of AWCK, Inc. if you have any questions regarding the calculations of impervious surface for the subject project.
