The following restates your request and is followed by our response. You are proposing to pipe and fill over 400 linear feet of surface water depicted as a "stream" on your "Inset A" impact map. The feature is shown on as an internittent stream on the Wake County Soil Survey. 'The DWQ Raleigh Regional Office (RRO) has informed the DWQ Wetlands/Unit staff that this stream was not evaluated during their March 8, 2000 on-site deterniination. It is our understanding that anon-site determination of this feature was performed by the RRO on April 22, 2004. The RRO determined that the stream is subject to the Neuse River Buffer Rules. As stated in the original submittal, SSzEC did not conduct the original field work associated with the wetlands and stream delineation on-site and likewise did not conduct the site meeting with RRO staff to determine the buffer locations. We were however provided with a letter from Mr. Steve Mitchell of the RRO that discussed the buffer deterniination on the site (see attached copy) and was attached to a site map. Mr. Mitchell's March 28, 2000 letter states that " It was determined that there is a named creek (Poplar Creek), an unnamed tributary and a pond represented on the maps that are present on the ground and therefore subject to the Neuse River Basin ..." It also states that "It was determined that the feature that emanates from the pond becomes an intermittent stream and therefore subject to the Neuse River Basin..." This letter in combination with the map that it refers to indicates that the feature in question was in fact reviewed by the RRO and was determined to be lacking characteristics required of buffered streams. The site plan was developed to avoid and minimize impacts to the buffered features outlined in the March 28, 2000 buffer letter. The previous consultant did not determine the feature with proposed impacts exceeding 400 linear feet to be jurisdictional. At the time of the March 8, 2000 site meeting this feature may not have had the characteristics required of a buffered stream and may have become more defined due to offsite stormwater from the adjacent residential neighborhood. According to 15A NCAC 2B.0233 section 3a, "Upon request, the Division or delegated local authority shall make on-site determinations. Any disputes over on-site determinations shall be referred to the Director in writing." According to the March 28, 20001etter the on-site determination was made. S&EC is not aware of any written disputes requesting that the feature be reevaluated for subjectivity to the Neuse Buffers. The revised permit submittal showing the drainage feature as jurisdictional was submitted on October 29, 2004 and was reviewed by DWQ staff. A letter dated January 22, 2004 was received from DWQ, which requested additional information. This previous letter made no reference to the feature being determined subject to the buffers. In a meeting with Mr. Mitchell after receiving the January 22, 2004 it was deternined that if lots were reconfigured so as to show avoidance of impacts during home construction, the 401-permit could be obtained. The site planner made the necessary revisions, which resulted in the loss of lots in good faith that the permit could be obtained. Given the existing road stub and constraints with curving the road crossing over the perennial stream, redesigning the road so as to entirely avoid the previously determined unbuffered stream is not feasible. We feel that the determination that an additional feature now be buffered four years after a letter from the RRO says that it is not is arbitrary and contrary to the regulations.
