REQUEST FOR MORE INFORMATION
Dear Mr. Perry:
On October 29, -2003, the Division of Water Quality (DWQ) received your application dated October 29, 2003
to impact 0.105 acres of wetlands, 466.5 feet of stream and 8,608 square feet (ft2) of protected riparian buffers
to construct the proposed residential subdivision. On March 15, 2004, the DWQ received a response to the
DWQ request for additional information dated January 22, 2004. The DWQ has determined that your
application (including the March 15, 2004 additional information) was incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we
receive the additional information requested below, we will have to move toward denial of your application as
required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may continue to review
your project.
Additional Information:
You are proposing to pipe and fill over 400 feet of surface water depicted as a "stream" on your "Inset A"
impact map. The feature is shown as an intermittent stream on the Wake County Soil Survey. The DWQ
Raleigh Regional Office (RRO) has informed the DWQ Wetlands/Unit staff that this stream was not.
evaluated during their March 8, 2000 on-site determination. It is our understanding that an on-site
determination of this feature was performed by the RRO on April 22, 2004. The RRO determined that the
stream is subject to the Neuse Buffer Rules.
As such, the plans proposed within your application will need to be redesigned to avoid the prohibited
uses (e.g., lot fill, houses in the buffer, etc.). Also, the plans will need to be redesigned to avoid/minimize
the parallel road impacts (e.g., Road "A"). Please redesign your plans and revise your application to
avoid/minimize the buffer impacts and submit seven copies of the revised plans and application to this
office and one copy to Mr. Steve Mitchell of the RRO.

Please respond within three weeks of the date of this letter by sending this information to me in writing and
Steve Mitchell of the DWO Raleigh Regional Office. If we do not hear from you within three weeks, we will
assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
this time) by the DWQ. Please call Mr. Steve Mitchell at 919-571-4700 if you have any questions regarding or
