Dear Mr. Dorney:
This letter is in response to your letter dated Dccem.bo~r l7, ?003 (copy attached), which
requested additional information for the proposed Rutledge Landing Subdivision- The
following restates your questions as shown on your letter and then provides our response-
1. Stream Feature o)s Inset A
You are proposing to pipe. mzd fil! over 400 feet o/~su~ face water depicted as a
"stream '" on your "Inset .4 "impact Wrap. It appear s that the future is shown as
an inlermiitent stream on the ttake County Soil Stt)vey. The D11/Q Raleigh
Regional Once staff have informed it:c D63't~ Wetlands/Unit staff that this stream
was not evaluated during their March 3, ,2000 on-site determinative. Please
contact Mr. Steve Mitchell with the Raleigh regional U~ce to request arr ort-site
determination o(this stream feature as to its subjecti>•'ity to the IVel.rsc jiuffer Rule.
Although SBcEC did not conduct the buffer determination field meeting or da any of
the fieldwork, a buffer deternination was conducted on site. Mr. Steve Mitchell of
the Raleigh Regional Office met with Mr- Mac Meintyrc on March 8, ..000. The ~~
results of that meeting are discussed in the attached letter from h4r. Mitchell artd
shown on the attached map. Both the letter and the map were provided to me by Mr. ~ I~5
McIntyre and were referenced in the original cover letter for the PCN_ According to ~~ ~~~
Mr. Tvlclntyre the featurc in question was evaluated and determined not to Ue subject ~~
to the buffer rules.

If the stream is not determined to be subject !o the Neese Buffer Rides, IJten pJcasc
provide additional justification as to why there is no practical alternative to ar•oi~~!
or nrinimize the proposed impacts.
Please see the attached response from Mr. )/1cIntyre. In brief, the road crossing is
required to provide an outlet for the northern section of the subdivision. The location
of this crossing is being determined by the location of the existing road stub withirA
the existing portion of Rutledge Landing. Also, according to Mr. McIntyre Wake
County and the "(.'own of Knightdale have already approved this plan. except for
culverted driveway crossings the intermittent stream is being avoided within the
individual Iota (i.e. no lot fill)
