PROJECT SUNLVIARY: The applicant is proposing to maintenance excavate Cow Channel and place spoil material on Bear Island and ACOE Island 88. NC Parks and Recreation Page 02 9. Narrative Description: The NC Division of Parks and Recreation are requesting maintenance and new excavation of Cow Channel, which connects the AIWW at Hammocks Beach State Park to Beaz Island at the location of the ferry dock. Additionally, the excavated material is proposed to be placed on Bear Island and on ALOE spoil island #88. The ACOE spoil disposal island #88 is 33 acres in size and vegetated with sparse Smooth Cordgrass (Spartina alterniflora) at the NHW, and sea oats, as well as indigenious shrubs. The elevation of the tract ranges from 0' to 30' NHW. There is an existing weir and outfall pipe in the spoil disposal area. Bear Island is a 1,014-acre island that is part of the NC State Parks and Recreation. The island is vegetated with maritime shrubs and the coastal dunes containing sea outs. Presently on Bear Island, there is a boat dock for the ferry, service road, bathhouse, picnic area, barracks and septic tanks. The Bear Island dune system was re-enforced with dredge materials from the emergency permit issued in 2007, and the beach has a 4-foot average rate of erosion. Bear Island ranges in elevation from 0' to 30'. Additionally, it is an Inlet Hazard Area at a portion of the project location. The project portion of Cow Channel is 8,156 linear feet and 50' wide and connects to the AIWW. The substrate characteristics of the existing channel is sand. Water depths in the existing channel average -6' at NLW. A site visit suggested there were no SAV's in the vicinity and there was no visible shellfish resource in the project area. The Division of Water Quality classifies this area as SA-ORW waters. This area is not a Primary Nursery Area. This portion of Bogue Sound is open to the taking of shellfish. The Onslow County Land Use Plan classifies the project area as Conservation. There are no shellfish leases in the project area. The proposed project involves the maintenance excavation of Cow Channel, the placement of spoil materials on Bear Island, the installation of a permanent underground pipeline on Bear Island, to aid in future beach nourishment projects, and the disposal of non-compatible sand on ACOE island 88. 10. Project Description: The applicant is proposing to dredge an existing channel that connects Hammocks Beach State Park to Bear Island. Cow Channel is a very high-energy area and consequently the channel meanders. The NC Division of Parks and Recreation was issued a permit to maintenance dredge Cow Channel for a distance of 8100' X 67' to a depth of -7 feet with a 25' bottom width and 3:1 side slopes, under permit #16-94. It was also issued emergency permit #45-07 to maintenance dredge a 2000' X 25' existing channel. The applicant is proposing to excavate an existing channel from an average depth of -6' NLW to -9' NLW. The channel will connect to the AIWW at the -9' contour. The substrate material is sand. The channel measures 8,156' x 50' NC Parks and Recreation Page 03 and will be excavated using a hydraulic dredge. The applicant is requesting to widen the channel to a 50' bottom width. This will require 203,900 square feet of new excavation and a 203,900 square feet of maintenance excavation. The reason for the new dredging is to follow the natural movement of the channel and dredge deeper areas, requiring less dredging. The excavation will disturb 407,800 square feet of sandy bottom and will remove 77,561 cubic yards of material. The proposed excavation is a minimum of 10' from the marsh edge with the exception of two locations. Adjacent to survey marker 56+00 and 72+00, the excavation is shown to be approximately 11' from the marsh edge. Adjacent to survey marker 66+00 and 72+00, the excavation is shown to be within 10' of the marsh edge. NC Parks and Recreation has consented to stay a minimum of 10' off the marsh edge with all proposed excavation. The location of the new channel will require the removal and relocation, as well as the installation, of new channel markers. Presently, there are 11 channel markers delineating Cow Channel. The 11 existing channel markers will be removed and placed at the location of the new channel, and there will be 6 new channel markers installed. The beach compatiable dredge spoils will be deposited by pipeline to Bear Island to re-enforce the primary dune system and the non-compatiable sand will be piped to the ACOE spoil island #88. The spoil island has a capacity of 50,000 cubic yards and the project requires a total of 30,000 cubic yards of capacity. As site preparation, the ACOE spoil disposal island requires grading of the walls and berms in the existing spoil disposal area as well as the placement of the dredge material inlet pipe, supported by posts, and replacement of the existing permanent outfall pipe. The materials will be deposited in an area encompassing 8.8 acres or 383,328 square feet of disturbance. These impacts figures will be included in the totals of highground disturbance. The compatable material will be placed on the beach at Bear Island. Bear Island will require some site preparation in the form of creating a trench and berm to hold the excavated material. The berm will be constructed at the Normal High Water Line per the submitted work plats. The reconstructed berm will have a slope of 16:1 and will have a maximum spoil deposit of 9 cubic yards per linear foot of shoreline. The disposal area at Bear Island is 75' x 5,000' or a total of 375,000 square feet of Ocean Hazard AEC fill. In order to facilitate future excavation projects related to Cow Channel, the NC Parks and Recreation are proposing to install a permanent dredge pipe on Bear Island, immediately adjacent to the existing service road. The pipeline will be installed in the first 5 feet immediately adjacent to the road for a distance of 2,400 feet. There will be 12,000 square feet of disturbance associated with the installation of the permanent pipeline. 11. Anticipated Impacts: The dredging of the channel will disturb 203,900 square feet of previously excavated sandy bottom and will require new excavation of 203,900 square feet of sandy bottom. The spoil disposal will fill 383,328 square feet of highground on ACOE spoil island #88 and 375,000 square feet of Ocean Hazard AEC on Bear Island. The installation of the permanent dredge NC Parks and Recreation Page 03 pipeline will disturb 12,000 square feet of highground. There will be a minor increase in turbidity during the excavation of the channel and installation of the channel markers. There will be no wetlands excavated or filled with this project. Vegetation on tract The dominant plant communities on Bear Island are maritime shrub and coastal dunes. Principle shrub species eastern red cedar (Juniperus virginiana), yaupon (Ilex vomitoria), wax myrtle (Morelia cerifera), and groundsel-tree (Baccharis halmifolia). Dune plants include sea oats (Uniola paniculata), pennywort (Hydrocotyle bonariensis), seaside goldenrod (Solidago sempervirens), and prickly pear cactus (Opuntia compressa). Salt marsh areas around the islands and along the sides of the channel are dominated by smooth cordgrass (Spartina alterniflora), sea oxeye (Borrichia frutescens), and glasswort (Salicomia spp.). Upper marsh is dominated by salt meadow grass (Spartina patens) and black needlerush (Juncus roemerianus). USACE Island 88 is sparsely vegetated with grasses such as sea oats (Uniola paniculata) and shrubs such as groundsel-tree (Baccharis halmifolia). f. Man-made features and uses now on tract Bear Island has a boat dock, a covered waiting area, a bathhouse, a picnic area, personnel barracks, and septic tanks. The only man-made features on USACE Island 88 are the weir and the outflow pipe for the dredge deposit area. g. Identify and describe the existing land uses adjacent to the proposed project site. Bear Island and USACE Island 88: Because these are islands, "adjacent" areas are marshes and waterways. However, land closest to these islands uses include a military firing site owned by Camp Lejeune; the Hatteras Yacht company (boat builders); and a second home on the island adjacent to Island 88 (the owners of this home are the Warren family, who own Island 88 [registered as Finn's Island in the Onslow County Tax database]). The remaining nearby propery is residential, second homes, beach rentals, and undeveloped land. h. How does local government zone the tract? i. The purpose of the project is to provide ferry access from the mainland visitor center at Hammocks Beach State Park to Bear Island, the main park attraction. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. Cow Channel: The channel will be dredged with a hydraulic dredge. The dredge will be kept at the boat dock at Bear Island when not in use. Equipment will also include service boats to get to and from the dredge and may include a booster pump. Bear Island: Preparation of the island and placement of dredged material will require basic construction equipment such as a bulldozer and a backhoe to move sand and create berms, and an ATV to carry personnel and equipment around the island. These will be stored on the island. Installation of a permanent underground pipeline to move dredged sand from the channel side of island to the ocean-side dunes will require a barge and basic equipment used to lay a pipeline, such as a bulldozer and a backhoe. The barge will be kept at the boat dock on Bear Island; the rest will be kept on the island. Preparation of Island 88 will include moving of sand to grade walls/berms in the disposal area as necessary, [temporary? permanent? placement pf dredge spoil intake pipe,supported by posts, and and replacement of existing permanent outfall pipe in the dredge spoil area.Equipment will again include a barge and basic construction equipment such as a bulldozer and a backhoe. Movement of channel markers will require acrane/pile driver with water jet unit positioned on a barge. The existing pilings will be removed using this equipment. Once the channel is dredged to the new width, 17 new pilings will be installed using the crane/pile driver with water jet unit on a barge to bury the pilings in the channel. The new pilings will be installed along the length of Cow Channel in appropriate locations shown on the engineered drawings by Andrew Consulting Engineers. Dune-compatible dredge material will be used to shore up dunes damaged in recent hurricanes, to protect existing structures. A permanent underground dredge pipeline will be installed alongside the existing service road on Bear Island. Eleven channel markers will be removed and 17 will be placed, as navigational aids to reflect the new channel after dredging. e. Saltwater discharge will occur as water drains from the spoil site into the nearby waterbodies. On Bear Island, saltwater will be directed by the berms set up to hold the spoil. As the sand settles into the disposal area, saltwater will travel along the hollows formed by the berms and be guided into the Atlantic Ocean. On Island 88, saltwater will run through an outlet pipe on the west side of the island, shown on the engineering drawings. It will drain into the Intracoastal Waterway. i. Location of hammocks Beach Mate Yark PROJECT NEED AND DESCRIPTION In summer 2006 park operations were seriously hampered by shoaling in Cow Channel, which was impassable at low tide. A planned dredging event in winter 2006-2007 was delayed because of unexpected logistical problems, but in April-May 2007 emergency measures were taken to dredge the shallowest 2000 feet of the channel to make it passable in the 2007 season. About 20,000 cubic yards of sand were dredged from the channel and were disposed of along approximately 1000 linear feet at the base of the dune/the upper beach on Bear Island. Upper beach disposal served in reestablishment of the primary dune and retention of compatible sand in the sand-sharing system, as preferred by the NC Division of Coastal Management's Coastal Resources Commission. This emergency dredging event served as a short-term solution for the 2007 summer visitation season. Shoaling is expected to continue. The Division of Parks and Recreation (DPR) proposes to undertake a more extensive dredging project beginning in winter 2007-2008. The purpose of the project is to provide safe and consistent access to Bear Island for a longer period of time, while minimizing environmental impacts over the long term by reducing the frequency of dredging. The project will require disposal ofbeach-compatible sand on the base of the dune/upper beach at Bear Island, as well as disposal of incompatible material on an upland disposal site. The spoil island previously used to dispose of dredged material has reached capacity and is no longer available for disposal. Because the project will require disposal of about 30,000 cubic yards of beach- incompatiblematerial, DPR has obtained a consent agreement with the US Army Corps of Engineers about using this disposal area on USACE Island 88. This site, which has been used in the past for dredge material disposal, would be able to hold all of the estimated 30,000 cubic yards of material. The project will include: Dredging: -8,156 linear feet of Cow Channel; -depth of 9 feet and width of 50 feet; -77,561 cubic yards of material to be removed; -a marsh buffer of ten feet will be retained from the top of the cut to the marsh line to minimize wetland impacts, and the marsh will be monitored after dredging for signs of marsh retreat; -studies indicate there will be no negative impacts to shellfish or submerged aquatic vegetation, and -dredging will occur within the approved winter dredging window (10/1 to 3/31, as set by the NC Department of Marine Fisheries. This window may be modified in response to comments received from other regulatory agencies. Beach Nourishment: -5,000 linear feet of the Bear Island upper beach will receive approximately six to nine cubic feet of dredged material per linear foot to augment/reestablish the primary dune system; -material to be dredged from marker 40 + 00 to the basin (4156 linear feet) is compatible with beach sediments and, thus, in combination with placement on the upper beach, will minimize impacts on intertidal/subtidal species. Installation of Permanent Dredge Disposal Pipeline on Bear Island: -2,400 linear feet of underground pipeline will be installed alongside the existing service road on Bear Island -pipeline will be installed within 5 feet of the existing road -erosion control measures will be taken and the strip will be revegetated with native species, by natural processes or (if necessary) with an active restoration effort Upland Dredged Material Disposal: -About 30,000 cubic yards of material, to be dredged from marker 0+0 to marker 40+00, is incompatible with beach sediments. This incompatible material will be deposited on an upland disposal site, as discussed above. Locations of the channel, the Bear Island disposal area, and the upland disposal site(s) are depicted in Figure 2. USACE Island 88 will be used for the initial dredging project; Finn's Island maybe available for future maintenance but will not be prepared or used at this time. PROJECT ENVIRONMENTAL REVIEW An Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) were prepared for this project. Hammocks Beach State Park Location of Proposed Dredging, Beach Nourishment, and Upland Disposal In 2005, before preparing the EA, DPR conducted testing of dredge spoil and beach material, using the Coastal Resources Commission's 2004 Draft Sediment Criteria Recommendations for Beach Nourishment Projects in North Carolina. This testing included laboratory gradation of 10 soil test borings from Cow Creek Channel and of 12 soil samples at the proposed renourishment area on the ocean side of Bear Island. This testing indicated that sediment dredged from the first 4,000 feet of the channel (from marker 0+0, at ICWW, to marker 40+00) would be unsuitable for deposition on Bear Island, and that sediment dredged from the remaining 4,156 feet of the channel (marker 40+00 to marker 81+56) would be suitable for deposition on the upper beach/toe of the dune. Additional testing in 2007 measured grain size and chemical toxins in 16 sediment samples collected from Cow Channel in June 2007. In early 2007 the Coastal Resources Commission made effective rule 15ANCAC 07H.0312, Technical Standards for Beach Fill Projects. Section (3)(b) of that rule states, "Sediment used solely to establish or strengthen dunes shall not be considered a beach fill project under this Rule." In May 2007, DPR consulted Jeff Warren, Coastal Hazards Analyst with NC DCM, and in this discussion it was determined that the Bear Island renourishment project should be considered exempt from this Rule, since sediment deposited there will be used solely to reestablish the damaged dune rather than for expanding or rebuilding the beach.
