This email serves to let you know that the utility line impacts in Zone 2 in the Jordan Lake Watershed for the subject
project are exempt from these rules and do not require written authorization from the Division of Water
Resources. During the 2013 General Assembly Session, SL 2013-395 was passed, and the following language pertains to
Zone 2 utility line riparian buffer impacts in the Jordan Lake Watershed:
Notwithstanding the Table of Uses set out in subdivision (9) of the Protection of Existing Riparian Buffers Rule, utility,
nonelectric, other than perpendicular crossings that have impacts only in Zone Two shall be categorized as exempt.
