I need to correct / expand upon a couple of items: 1) Blue "PDE" boundary stake: This does include the stream banks and stream bed itself. 2) Red "end of pipe" stake: This is inside the stream bank. 3) There is no doubt that the project incorporates access to the Bailey Camp Creek trout waters, based on the the colored stakes that have been set. The project plan/map sent to me and forwarded to you yesterday does not have Bailey Camp Creek noted on it. It is definitely a PDE project and it is clear in the documentation that DOT will maintain what is within the PDE boundary. My concern is that the whole point of the PDE is to get the 24" CSP near enough to the creek for the storm water to drain away. If I or anyone disturbs the stream/steambank below the high water mark, then it is an issue. I don't think they are planning to do that per se. If I or anyone creates a new flow of water "near a stream" that we all know will enter the trout stream along with whatever is in that flow at whatever rate of flow, who is going to be responsible for the impact of any erosion or contaminates as a result of that flow? DOT wants to focus on the piece of land necessary to bury the pipe and a proposed "dissipation pad" containing 12 SY of fabric and 4 tons of rip rap (I estimate about 10ft x 10ft). My concern is what is coming from a 24" pipe flowing from a 4 lane highway at 18000 gallons per minute or 40ft3/sec which makes it way into a 6 inch deep x 8 foot wide trout stream with est flow <26ft3/sec. The stream is supposedly beyond the PDE. I will tell you that the stake that says end of pipe/PDE is as close as it can be without technically being in the stream. The stream has to suitable to handle the proposed outflow. I don't know if or how this has been evaluated at this point. 1 Thank you for your help. I look forward to hearing back from you.
