The current request is for 102 If of permanent stream impacts and 7,474 sf of permanent Neuse River riparian buffer impacts. The proposed modification will result in an additional 12 If of permanent stream impacts and an additional 95 sf of riparian buffer impacts above the previously authorized impacts. The proposed project consist of the improvements to ±600 If of Chapel Hill Road (NC Hwy 54) at the intersection of Chapel Hill Road and Fairbanks Rd, in Cary, Wake County (Latitude: 35.040°N; Longitude: - 78.8052°W). The project is located in the Neuse River basin and onsite waters drain to Coles Branch. The Water Quality Classification for Coles Branch is C; NSW and the Stream Index Number is: 27-33-3. The cataloging unit for the site is 03020201. Proposed Project The purposed of the proposed project is for improvements to widen Chapel Hill Road (NC Hwy 54) at the existing curve at Fairbanks Rd to meet the requirements of the American Association of State Highway and Transportation Officials (AASHTO), NCDOT and Town of Cary. Currently, the existing curve in Chapel Hill Road (NC Hwy 54) is too sharp/tight and does not meet the minimum curve radius requirements. Meritage Homes is being required to construct the road improvements to bring Chapel Hill Road (NC Hwy 54) into compliancewith the requirements of AASHTO, NCDOT and Town of Cary. The proposed road improvements are being required by the Town of Cary as part of the site plan approval for the Park West Townes project (AID SAW-2015-01667). However, the proposed road improvements do not include a turning lane or storage lane for the Park West Townes project, and does not serve the Park West Townes project in any way or affect the feasibility or function of the Park West Townes project. Therefore, the impacts from the Chapel Hill Road improvements are not considered cumulative with the Park West Townes project. The proposed improvements to Chapel Hill Road are simply improvements to a public road that are being constructed by Meritage Homes per requirements by the Town of Cary. The Corps of Engineers previously determined that the proposed improvements to Chapel Hill Road (NC Hwy 54) has independent utility from the Park West Townes project, which is documented through previous issuance of the NWP 14. The Corps of Engineers issued a Jurisdictional Determination in conjunction with issuance of the NWP 29 for the adjacent Park West Townes project (AID: 2015-01667), which includes the Chapel Hill Road Improvements project area. NCDWR issued a Buffer Determination for the Park West Townes project (NBRRO#15-234) on 06/01/15, which includes the Chapel Hill Road Improvements project area. A copy of the buffer determination letter has been provided as an Appendix. On April 28, 2016, the Corps of Engineers issued a NWP 14 for the Chapel Hill Road Improvements project which authorized 90 If of permanent stream impacts (75 If of total loss of Waters of the US). A copy of the previously issued NWP 14 has been provided as an Appendix. On April 15, 2016, NCDWR issued a 401 WQC and Buffer Authorization for the Chapel Hill Road Improvements project which authorized 90 If of permanent stream impacts and 7,379 sf of permanent impacts to Neuse River Riparian Buffers. A copy of the previously issued 401 WQC & Buffer Authorization has been provided as an Appendix. Coordination with the NCDOT was ongoing concurrent with both the Town of Cary Site Plan approval and 404/401 permitting. The previous design for the culvert extension utilized an endwall that minimized the stream and buffer impacts by limitingthefill slope that is created from the required Chapel Hill Road (NC Hwy 54) widening. NCDOT deemed this endwall to be a retaining wall that they will not maintain. In order to rectify this, the design had to be revised to provide a standard NCDOT endwall that is shorter in height, which requires the fill slope to be extended further downstream, resulting in additional buffer impacts and stream impacts. Therefore, we are requesting a modification to the previously issued permits to authorize the addition stream and riparian buffer impacts resulting from the design revision required by NCDOT. Historic or Prehistoric Cultural Resources The NC State Historic Preservation Office's online database identifies one known historic structure adjacent to the proposed project limits, approximately 100 If west. The occurrence consists of the Richards House (WA0719), located at address 9475 Chapel Hill Road. The Richards House is being preserved as a requirement of the Town of Cary and therefore will not be affected by the proposed development. The previously issued NWP 14 serves as documentation that the proposed project will not affect historic, cultural or archeological resources. Proposed Impacts As a result of the design revisions required by NCDOT, the proposed impacts consist of 107 If of permanent stream impacts and 7,474 sf of permanent Neuse River riparian buffer impacts. Impact 1 will result in 15 If of permanent impacts to Stream 1 from installation of rip-rap within the stream below the culvert to prevent erosion of the channel and undercutting of the culvert. The proposed impacts for the rip-rap dissipator are the same as previously permitted. Impact 2 will result in 87 If of permanent impacts to Stream 1 from extension of the existing culvert as needed for widening of the existing road. This results in an additional 12 If of permanent stream impacts above the 75 If of previously permitted permanent stream impacts. The proposed 7,474 sq ft of permanent riparian buffer impacts (Zone 1: 4,657 sq ft; Zone 2: 2,817 sq ft) will occur from widening of the road, which is a perpendicular road crossing impacting less than 1/3 acre of buffers, which is "Allowable". The required revision to the design will result in an additional 95 sf of riparian buffer impacts above the 7,379 sf of previously permitted riparian buffer impacts. The proposed project consists of the widening of Chapel Hill Road (NC Hwy 54) to bring the curve at Fairbanks Rd into compliance with AASHTO, NCDOT and Town of Cary road design requirements. Therefore, design alternatives to further minimize impacts to streams and buffers were not possible. Additionally, NCDOT requirements have resulted in design revisions that now require additional stream and riparian buffer impacts above what was previously permitted. The rip-rap dissipator at Impact 1 has been designed for the rip-rap to be installed so that the top of the rip- rap matches the pre-construction elevation of the stream bed. This design allows for the impacted stream areas to continue functioning as a natural stream by maintaining natural water depths and allowing for passage of aquatic life, which will not result in a loss of stream function. Mitigation Stream Mitigation The proposed permanent intermittent stream impacts are less than 150 If, and therefore, stream mitigation is not proposed. Buffer Mitigation The proposed 7,474 sq ft of permanent riparian buffer impacts will occur for a perpendicular road crossing, which will impact less than 1/3 acre of buffers. Therefore, this activity is "Allowable", and mitigation is not required. The current request is for 102 If of permanent stream impacts and 7,474 sq ft of permanent Neuse River riparian buffer impacts (see the attached maps and PCN for details). All riparian buffers impacted by the p!acement of temporary fill or clearing activities shall be restored to the preconstruction contours and revegetated. Mainhained buffers shall be permanently revegetated with non-woody species by the end of the growing season following completion of construction. For the purpose of this condition, maintained buffer areas are defined as areas within the transportation corridor that will be subject to regular NCDOT maintenance activities including mowing. The area with non-maintained buffers shall be permanently revegetated with native woody species before the next growing season following completion of construction. [ 15A NCAC 2B..0233] 2. Pursuant to 15A NCAC 2B.0233(6), sediment and erosion control devices shall not be pIaced in Zone 1 of any Neuse Buffer without prior approval by the NCDWR At this time, the NCDWR has approved no sediment and erosion controI devices in Zone 1, outside of the approved project impacts, anywhere on this project. Moreover, sediment and erosion control devices shall be allowed in Zone 2 of the buffers provided that Zone 1 is not compromised and that discharge is released as diffuse flow. 3. For any streams being impacted due to site dewatering activities, the site shall be graded to its preconstruction contours and revegetated with appropriate native species. [15A NCAC 02H.0506(bx2)] 4. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact between curing concrete and stream water. Water that inadvertently contacts uncured concrete shall not be dischazged to surface waters due to the p�tential for elevated pH and possible aquatic life and fish kills. [15A NCAC 02B.02001 5. During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S., or protected riparian buffers. [15A NCAC 02H.0506(b)(2)] 6. The dimension, pattern and profile of the stream above and below the crossing shall not be modified. Disturbed floodplains and streams shall be restored to natural geomorphic conditions. [ I SA NCAC 02H.0506(bx2)] 7. The use of rip-rap above the Normal High Water Mark shaIl be minimized. Any rip-rap placed for s�eam stabilization shall be placed in stream channels in such a manner that it does not impede aquatic life passage. [1 SA NCAC 02H.0506(b)(2)] 8. Al1 work in or adjacent to stream waters shall be conducted in a dry work ��ea. Approved BMP measures from the most current version of NCDOT Construction and Maintenance Activities manual such as sandbags, rock berms, cofferdams and other diversion structures shall be used to prevent excavation in flowing water. Heavy equipment shall be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the introduction of other pollutants into the stream. All mechanized equipment operated neaz surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fi:els, lu�ricants, hydrauiic fluids, or other toxic mate:ials. If the NCDWR determines that such standards or laws aze not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necess2ry to assure compliance, the NCDWR may reevaluate and modify this certification.
