The proposed water system will replace existing service through individual wells and provide a reliable source of quality drinking water to the area. To construct this project as proposed, it is necessary to impact zone 1 and zone 2 buffers in various locations as shown in the attached application package. No permanent impacts are proposed for this project and the preconstruction grade (contours) of streams will be reestablished after disturbance. Please note that we are requesting written approval solely for Buffer Rules and do not need written approval for 401 Certification. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps maybe included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. Impact Justification (Avoidance and Minimization) Expected pond surface area: Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. 1 The waterline has been located to minimize impact to streams. It is located primaril iy n the r~hts-of-way and S feet from the edge o~'pavement. All perennial streams will be directionally drilled as to avoid any impact to these areas. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Page 10 of 14 If mitigation is required for this project, a copy of the mitigation plan must be attached in order I for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strnlgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restnctions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. It as our understanding that we are beneath the threshold requiring mitigation for streams and wetlands due to the avoidance and minimization efforts. However, we will have some required mitigation for Zone 1 buffer disturbance (Note: applyin~ for "No Practical Alternative "for both Zone 1 and Zone 2 disturbances and Zone 2 if approved requires no ' mitigation). For the miti ation e ort for Zone 1 bu ffer disturbances, we propose to may into the North Carolina Ecosystem Enhancement Program. An "In Lieu Fee Request Form "was submitted to NCEEP and the acceptance letter from NCEEP is attached in Appendix A. 1 2. Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. The proposed project consists of a distribution system consisting of approximately 115 nines of 4", 6", 8", 12"; and 16" water lines along with the associated appurtenances such as hydrants, valves, etc. The project will also include two elevated water storage tanks (300,000 & 200,000 gallons), three booster pump stations, and two master meters and vaults. 'The project will be broken down into four separate phas~s for the purposes of construction. As required by the National Environmental Policy Act, the Rural Utilities Service has assessed the ' pote~.tial environmental effects of the proposed project and has determined that the proposal will not l~.ave a significant effect on the human environment and for which an Environmental Impact Statement will not be prepared. The basis for this determination is a thorough review and analysis ' of tl>~e environmental information reported in the environmental assessment including public and regulatory agencies' comments regarding the proposed project. It has been determined that the proposed project may cause some minor direct conversion of important farmland on the sites of the elevated storage tanks, the booster pump stations, and the master meter vaults. The amount of farmland conversion is a relatively small area in relation to the total amount of important farmland in the area, and is not significant in terms of the total land available for farm use. It has been ~ determined that there is no practicable alternative to avoiding this conversion. In order to avoid or minipnize any adverse environmental impacts, most of the construction area will be within the rights-of--way of public wads where laced disturbing activities have previously occurred. Washington Street, Suite 3072 Nashville, N.C. 27856 (252) 459-9800 Activity: Construction of Water Mains Project for Central Nash Water and Sewer District Location: County: Nash Map: See Appendix B for Vicinity Maps Ex lanation: The ro'ec p p i twill construct water mains throughout Central Nash Water and Sewer District. The water mains will be installed to replace existing service through individual wells The proposed water system is intended to provide a reliable source of quality drinking water to the area The project is located within rights-of-wav with some easements needed to minimize stream impact. The water main will be located 5 feet from the rights-of--way along major roadways and 5 feet from the edge of pavement along all other roadways. To construct this project it is necessary to intrude into zone 1 and zone 2 buffers. The buffer intrusions are a result of the many buffered streams which are directed under existing roadways. The location of the water lines was determined based on the demand and reauired service throughout the area. The water lines will be within the rights-of--wav thus impact to these streams is unavoidable. To minimize intrusion into buffered areas all perennial streams will be directionally drilled The majority of the ' crossings are cconsidered exempt or allowable although there are five streams which fall under allowable with mitigation due to the an lg a of crossing. To avoid mitigation additional easement acquisition would be ' reauired from private landowners and result in a disturbance to their property and undisturbed environmental areas In some areas the reroute of the water line to provide a peroendicular crossing would increase environmental impacts by intruding into heavily wooded areas Considering the extra costs for land and additional construction as well as the potential reduction in environmental impacts changing the alignment ' of the water main to ensure perpendicular crossing was not considered practical.
