Division of Water Quality October 13, 2005 CERTIFIED MAIL: 7004 2890 0002 3418 0985 RETURN RECEIPT REQUESTED Ogden Highway, LLC Attn: Mr. Dennis Silvester 1630 Military Cutoff Road, Wilmington, NC 28403 SUBJECT: PROJECT ON HOLD FOR ADDITIONAL INFORMATION Sterling Farms Subdivision DWQ Project # OS 1766 Onslow County Dear Mr. Silvester: This Office has reviewed your 401 application for the Sterling Farms Subdivision for constructing a residential subdivision within a 396 acre tract located off Old 30 Road in Jacksonville in Onslow County. The proposal is to subdivide the parcel into residential lots and to permit eight road-crossing for a road access to these lots. DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: Please provide profile drawings (to scale) of each wetland impact you are proposing (show the fill area and how fill will be retained by grading it to a 3:1 slope or by a retaining wall or some such mechanism). 2. You have indicated on your application that you will be placing the remaining onsite wetlands into preservation. Please provide a draft copy of the preservation language for the wetlands that will be recorded, the language must reference exact areas. 3. On some of the proposed lots, it seems that additional wetlands will need to be impacted for the housepad and driveways (Lots # 43, 45 & 122 are the only numbered lots) there are additional lots that are not numbered and a copy of the drawing has been included and the lots/wetlands in question have been highlighted in yellow. Please provide information that these lots are buildable without additional wetland impacts and if not, include the wetland impacts. 4. On the proposed road layout you have indicated two small finger wetlands that are not to be impacted (highlighted in green). DWQ considers these cutoff type wetlands as impacted and they need to be included in the impact calculations.
