This letter is to request remission.of the Civil Penalty assessed -under the subject Violation; Case No. LV-
2016-0144-Limit_Exceed"a6'ce V'iolation(s). - _;w -
According,to the Justification for Remission Request, "Pursuant -to N.C.G.S. § 1438-282.1(c), Remission of
a civil penalty may be granted only -when one -or -more -of fhe46116wing=five-factors_apply. It is the Town's
contention that three of the five -factors apply; (a) one or more -of the civil penalty�assessment factors in
N.C.G.S. 1436-282.1(b) were wrongfully applied to`the detriment of the petitioner (the assessment
factors are listed in the civil -penalty assessment document; -(b) the -violator promptly abated continuing
environmental damage resulting from the violation (i; e.- explain the steps that you took to correct the
violation and prevent -future occurrences);-and=(c) the violation was inadvertent or a, result of an
accident (i.e. explain why the violation was unavoidable or something you could n'ot prevent or prepare
for).

Assessment Factors
(1) The degree and extent of harm to -the: natural resources of the State, to the public health, or
to private property resulting from the violation;
The Town of Fairmont February DMR shows that the town never exceeded any maximum daily
limits for Effluent Discharge. Therefore, we don't believe there was any harm to the natural
resources of the State, or to the public health, or to private property resulting from the
violation.
(2) The duration and gravity of the violation;
The Town contends that since the DMR shows no violation of maximum limits for Effluent
Discharge, the gravity of the violation was minimal at best.
(3) The effect on ground or surface water quantity or quality or on air quality;
Again, the effluent discharge limits were never exceeded. The town contends that there was no
negative effect on ground or surface water quantity or quality or on air quality.
(4) The cost of rectifying the damage;
The Town contends that there was no cost associated with to rectify damage because there was
no damage. If there is damage that the Town has not been made aware of, we ask that it be
identified and that the town be allowed to rectify that damage.
(5) The amount of money saved by noncompliance;
The violation was inadvertent, beyond the town's control and unpredictable. Therefore the
Town couldn't have intentionally failed to comply in an attempt to save money.
(6) Whether the violation was committed willfully or intentionally;
As explained in the June 14, 2016 letter requesting that no civil penalty be assessed, the town
suffered a record amount of rain; 11.3 inches. (See copy of the Town's hand written Sewer Plant
Log, demonstrating Rain Fall in inches and a copy of the February eDMR.) Even a system that
typically does not have substantial inflow and infiltration issues will experience higher than
normal water levels if inundated by the rapid influx of rain water. In addition, our records show
that our regional Columbus County partners experienced rainfall totaling 8.6 inches for the
month of February. Record levels of rainfall are the result of natural causes and can't be
predicted. That being the case, the Town contends that it did not commit the violation willfully
or intentionally.
(7) The prior record of the violator in complying or failing to comply with programs over which
the Environmental Management Commission has regulatory authority; and
The Town's record shows that we routinely comply with the programs over which the
Environmental Management Commission has regulatory authority.
(8) The cost to the State of the enforcement procedures.
The Town can't contest the cost to the State to enforce procedures and it realizes that the State
must proceed with enforcement action when there are violations, even if those violations were
not intentional. The fact that enforcement actions cost the State can't be denied.
(b) the violator promptly abated continuing environmental damage resulting from the violation (i.e.
explain the steps that you took to correct the violation and prevent future occurrences)
The Town acknowledges that it has inflow and infiltration problems and we have and are taking
additional steps to rectify these issues. Even though our system is regional, doesn't negate the
fact that we are a small town with limited funds. That being said, we rely heavily on assistance
through loans and grant funding sources to handle issues that require large sums of money to
abate. As you know the state provides most of the available grant funds and a lot of those funds
are made available under timed funding cycles. In order to qualify and receive those funds,
towns must operate within the time constraints of the state. The following represents our
efforts to resolve these issues to date:
Since 2014, the town has been taking steps to correct the inflow and infiltration of water coming
from all systems connected. One project, funded through the sale of revenue bonds and a
CWMTF grant was completed in November of 2014. The grant was in the amount of $600,000,
the revenue bonds totaled $385,000 and the town obligated a local match in the amount of
$15,000. This project replaced approximately 1,416 linear feet of 10" sewer lines, rehabilitated
approximately 1,700 linear feet of sewer lines, and 37 manholes were either replaced or
repaired.
The Town has solicited the help of the North Carolina Rural Water Association (NCRWA) to
perform smoke tests on our system and the systems of our regional partners. The two larger
systems have received grants to help eliminate much of the I&I. The Proctorville smoke test is
complete, corrective measures are currently underway pursuant to the findings and the smoke
tests for the other smaller systems are being scheduled at the convenience of the NCRWA.
The I&I grant currently underway with the Town of Fairmont, is in the amount of $1.765 million
and was awarded in 2015. The Town has already been approved by NC DEQ to begin the design
and construction phase. The field work, in terms of surveying, is essentially complete and the
Town will be submitting a request for design review sometime in the fall. A copy of the Updated
Letter of Intent to Fund Milestone Requirements is attached. Also, the most recent status
report from the Town's Consultants, LKC Engineering, PLLC, is attached. The Town took a good
hard look at our system and determined that due to the amount of work needed, we would
have a three-phase project. Phase I is complete, Phase II is in progress and we fully intend to
continue on to Phase III to make sure we have done everything possible to improve our system.
We have also encouraged our regional partners to pursue funding as well. Hopefully, the state
will see the merit in approving funding for our partners, as the health of our system is fully
integrated with their ability to simultaneously correct any problems they are experiencing.
The Town of Fair Bluffs grant was also awarded in 2015 in amount of $3 million. The project
will replace sewer collection lines in much of the low/moderate income areas of Fair Bluff and
involves the rehabilitation of 18,550 linear feet of sewer lines and 52 manholes. The
environmental requirements for the Fair Bluff grant are basically met now, and the engineers
are also wrapping up their surveying. They expect to submit the finished plans to the state in
September. Hopefully the state approval of the plans will be attained by January 2017, which
will allow the project to be bid out in March of 2017.

In previous correspondence with NC DEQ, the town demonstrated the history of rainfall events from
2014 to present and to reiterate that rainfall events, particularly for Southeastern North Carolina, I
submit the following:
A review of historical rain events for the last three years shows a steady increase. The month of
February alone there has been progressively higher amounts of rain: February 2014 — 6.5", February
2015 —10.2", February 2016 —11.3." Even a system that typically does not have substantial inflow and
infiltration issues will experience higher than normal water levels if inundated by the rapid influx of rain
water.
In recent years, the Town of Fairmont has experienced financial hardships that, at one time, rendered
our fund balance as low as 4%, which, as you know, is 4% lower than recommended by the North
Carolina Local Government Commission. We have struggled to climb up from this downward financial
spiral. We have explored and continue to explore every available resource to help improve our system.
The Town respectfully requests that you weigh the evidence and data provided, along with the
attachments and that the assessment set forth in your letter dated August 2, 2016 for Case No. LV -2016-
0144 is remitted.

Design plans (see attached) and specifications for the above referenced project have been completed,
and we are preparing to submit the design for permitting. As you are aware, the final design must also
be submitted to CDBG-I for their approval before we can advertise the project for bid. We are preparing
the design review package for CDBG-I and expect to send that out early next week. The remaining
project deadlines set by CDBG are listed below. We do not foresee any difficulty meeting this schedule
provided agency reviews are completed in a timely fashion. We will make every effort to stay ahead of
schedule.

SECTION IX TAX RATE ESTABLISHED
An Ad Valorem Tax Rate of .73 per $100 full valuation is hereby established as the
official tax rate for the Town of Fairmont for the fiscal year 2015-2016. This is based
on an estimated valuation of $99,131,557.00 and an estimated collection rate of 90%.
SECTION X SPECIAL AUTHORIZATION - BUDGET OFFICER
A. The Budget Officer shall be authorized to reallocate departmental appropriations
among the various OBJECTS of expenditures as she believes necessary.
B. The Budget Officer shall be authorized to execute interdepartmental transfers,
in the same fund, not to exceed 10% of the appropriated monies for the department
whose allocation is reduced. Notation of all such transfers shall be made
to the Board on the next succeeding financial report.
C. He/she may make interfund loans for a period of not more than 60 days.
D. Interfund transfers, established in the budget document, may be accomplished
without recourse, to the board. '
SECTION XI RESTRICTION - BUDGET OFFICER
A. The interfund transfer of monies, except as noted in Section X, Paragraph C and D,
shall be accomplished by Board authorization only.
B. No salary increase may be made without Board approval.
C. No contributions to any agencies shall be made without board approval.
SECTION XII UTILIZATION OF BUDGET AND BUDGET ORDINANCE
This Ordinance and the Budget Document shall be the basis of the 2016-2017 Fiscal Year.
The Budget Officer shall administer the Budget and shall insure that operating officials are
provided guidance and sufficient details to implement their appropriate portion of the
budget. The accounting section shall establish records which are in agreement with the
Budget and this Ordinance and the appropriate statutes of the State of N.C.

INSTALL EITHER A NEW MANHOLE OR DOGHOUSE MANHOLE AS DIRECTED.
THE CONTRACTOR SHALL INSTALL 8 LF OF NEW SANITARY SEWER MANS
TO MATCH EXISTING FOR RECONNECTION TO THE NEW MANHOLE. ALL
COSTS ASSOCIATED WITH THE PIPE INSTALLATION SHALL BE INCLUDED IN
THE UNIT PRICE BID ITEM FOR MANHOLE INSTALLATION ANY ASPHALT
