We have spoken with Ian McMillan of your office and we believe we have supplied the materials necessary to respond to your request. We will address each point in your letter herein. On March 10, 2008, Jamie Shern of the USACE stated that he would approve the sewer project under a Nationwide Permit 12, and then approve the housing development later under a Nationwide >;ermit 29. The project has logical termini and can be considered a single and complete project. However, jurisdictional area impacts will be considered cumulative when the housing development permit is applied for 2. Our original site plans, depicting jurisdictional area impacts associated with the sewer alignment, were submitted at a scale of 1" = 50'. However, we have submitted additional plans attached to this letter at various scales, with detail sheets at the requested scale or larger. The additional plans are described below. 3. Although we do not have finalized plans for the entire housing subdivision project, we have supplied those elements that are available. a) Cross section detail for culvert crossings are not available at this time. b) The plans for two stormwater retention ponds and other stormwater management practices arP~ included in the enclosed Drawings CS through C8, C19, and E1. c) Plans and profiles for stormwater management devices are enclosed in the enclosed Drawings CS through C8, C19, and E1. Some proposed footprints for townhomes are depicted on Drawing C2. g) Proposed lot layouts are shown in the enclosed Drawings C 1 and C2. h) Detailed drawings of stream impacts throughout the proposed subdivision are not available at this time. A generalized depiction of impacts is shown in Figure 1 and Drawings C2 and C4A. i) Detailed drawings of wetland impacts throughout the proposed subdivision are not available at this time. A generalized depiction of impacts is shown in Figure 1 and Drawings C2 and C4A. j) Detailed drawings of riparian buffer impacts throughout the proposed subdivision are not available at this time. A generalized depiction of impacts is shown in Figure 1 and Drawings C2 and C4A. k) Isolated and non-isolated wetlands, streams, and other waters are shown in the overview in Figure 1. The Town of Wake Forest is the review and approval authority for Stormwater management for the project. Diffuse flow provision worksheets and an Operations and Maintenance Agreement are not required and are not available. Please note that a large impact to Austin Creek and adjacent wetlands is depicted on the construction drawings at the western edge of the proposed development. This roadway crossing is still under review. We hope that this information is sufficient to address your questions. If you need any additional information, please let me know. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide verification from the USACE that they will be permitting your project first under a NW 12 and then later under a NW29. 2. Please re-submit your site plans on full plan sheets at a scale of no smaller than 1 "=50' with topographic contours. 3. Please include all proposed building footprints, roads, driveways, sidewalks, grauel-surfaced areas, amenity areas, etc. f) Please provide building envelopes for all lots with wetlands, streams or buffers on the site plans. g) Please indicate proposed lot layout as overlays on the site plan. h) Please indicate all stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. i) Please indicate all wetland impacts including fill slopes on the site plan. j) Please indicate all riparian buffer impacts on the site plan and clearly label impacts (Buffer Impact 1, etc.). k) Please locate all isolated or non-isolated wetlands, streams, and other waters of the State as overlays on the site plan. 1) Please locate all of the protected riparian buffers as overlays bn the site plan, clearly showing Zone 1 and Zone 2. m) Please indicate the diffuse flow provision measures on the site plan and submit diffuse flow provision measure worksheets and signed and a notarized Operations and Maintenance Agreement. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This-letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
