Tot�I Open Water Lnpacts for Arojeet Sections R-3329 and R-2559: 2.56 acres The application provides �dequate �ssurance that the discharge of fill material into the waters of the Yadkin River Basin and associated wetl.mds, in conjunction with the proposed development will not result in a violation of applicnble Water Quafi[y Standards and discharge guidelines. '1'herefore, the State of North Carolina certifies that this activity will not violate the applicable portions of SecYions 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with thc applieation a�id conditions hereinafter set forth. 1"his approval is only valid for the purpose and clesign that you submitted in your application dated August 31, 201 Q and received September 9, 2010, with ndditional information submitted elecp�onically on November I, November 8, and December I, 2010. Should your project ehange, yo�� are required to notify the NCDWQ and submit a new application. If the property is sold, the new owner must be given a copy oP this Certification and approval letter, and is thereby responsible for complying with ali thc conditions. If any addiiion�l wetland impacts, or stream impacts, for this project (now or in the flihire) exceed one acre or I50 lii�ear feet, respectively, additional compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you are required ro comply with all the conditi��ns listed below. in addition, you should obtain alI other federal, state or Ioeal permits before procceding with your pro��ct inclutling (but not limiteci to) Sediment and Erosion control, Coastal Siorimvater, Non- discharge and Water Stippiy watcrshed regulatia�s. "I'his C ertification shall expire on the same day as the expi�ution date of tha corresponding Corps of Engineers Permit. Conditions of Certifcation: 1'his certification cices not authorize consd�uction of the project. Authorization for construction shall be granted when revised design plans for R-2559C and final design plans far the remaining sections of R-2559 and R-3329 are received, and approved by NCDWQ. Please be advised that when revised design plans are completed for R- 2559C and final design plans for the remaining sections of R-3559, and R-3329, modificetions to ihe 40I Water Quality Certification shall be submitted with five copies and fees to t(�e NC Division of Water Quality. Revised �nd final designs shall reflect aIl appropriate avoidance, minimization, revised jarisdictional impact tables and mitigation Por impacts to wedands, streams, and other sw�face waters. No constniction activities that impact any wetlands, sh�eams, or surface waters locatcd within any portion of Sections R-2559 or R-3329 shall begin unti) after the permittee applies for, and receives a written modification of this 401 Water Quality Ceitifiication fi�om the NCDWQ. 2. The NC'T A shall consp�uct hazardous spill basins along the project corridor at stream crossings Iocated within the Lake I�witty �vatershed as per the coinmitment in the Record of Decision (ROD) dated August 2010. Compensalory miugaitioii for 17,886 lioear fect of impact to streams is required. We understand that the North Carolina Gcosystem Enhancement Vrogram (E�GP) has agreed to implement t6e stream midgation for the project. EEP has indicated in a(etter dated June 24, 2010, [hat they will assume responsibility for satisfying the federal Clean Water Act compensato�y mitigation requirements for the above-referenced project, in accordanee �eith the Cri-Party MOA signed on July 22, 2003 and the Dual-Party MOA signed on April 12, 2004. However, as per the �pplicHtion submitted by the NCTA, the NCTA will evaluate the 1'easibiiity of implementing sh�eam enhancement projects n[ four (4) sites identified by thc NCTA's constdtant in JAnuary 2010. Prim• to the inikiatiou of any stre�m impacts, the NCTA mnst adequately demonstrate that the stream enhancement oppm•tunities iclentifieA by the consultant 6ave been fidly investigated. Tliis shall include the submission of the feasibility studies to NCDWQ for revicw and approval. 4. Canpensatory mitigntion for Z66 acres of impacts to wed�nds is �equired. We understand that you hava chosen to perCorm compensatory mitigation for imp�cts to wedands through the North Carolina Ecosystem Lnhancement P�rog�am (L.1�P), and that the CIaP has agreeci to implemcnt the mitigation for the project. EEP has inclicated i� a letter dated J�me 24, 2010, that they will assume responsibility f�r satisfying the federal Clean Water Act compensatory mitiga[ion requirements for the above-referenced project, in nceordancc with the'iri- Pr�rty MOA signed on July 22, 2003 and the Dual-Parry MOA signed on April 12, 2004 5. Stormwater shall be treaicd using appropriate best management practices (e.g., vegetated conveyances, construeted wetlands, detention poiids, eta) pria� to discharging to siu'face waters. 8. lf any consA'uction staging, s[orage, refueling, borrow pit or spoil areas are chosen within the Goose Creek or Sixmile Q'cek watersheds, NC'1'A's represe��tatives will coorclinate with the NCDOT Lnvironmental Officer and tl�e U.S. Fish ai�d Wildlite Seivice [o develop }3MPs for cach site to avoid a�id mii�imize potential �dverse effccts. ndditionally, the NC"1'A's representatives shflll coordinate with NCDWQ fa� activities located wiihin the Goose Creek waYershed to ensure compliance with the Goose Creel< I3uffer ftules. Ccitain activities Iocated within the Goose Q'eel< watcrshed may require a modification to the permit and s��bscqucnt riparian buffer mitieation. 9. Unless otherwise flpproved ii� this ceRification, placement of ciilverts and other structures in open waters and streams shall be placed below the elevation of the su�eambed by one foot for all eulverts with a diameter greater than 48 inches, and 20 percenl of the culvert di2meter fa culverts havin� a diameter less than 48 inches, to allow low flow passage of water and aqiiatic life. Design and placement of culverts and other structures including temporary erosion control measures shall not be conclucted in a manner that may result in dis-equilibrium of wetlands or su�eambeds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide cvidence that the equilibrium is being maintained if requested in writing by NCD4VQ. lf this eondition is unable to bc met due to bedrock or other limiting features encountered dm�ing construciion, pleasc contact NCDWQ for guidance on ho�v to proceed and to determine whether or not a permit modification will bc required. 10. Floodplain benches, where proposed for construction to maintain the existing stream dimension, shall be constructed as depicted in the revised drawings received electronically on November 16, 2010. I l. If conerete is used during construction, a dry worl< area shall be mai�tained to prevent direct contact behveeii curing concrete and stream wa[er. Water that inadvertently contacis uncured concrete shall not be clischarged to swtace ��aters due ro the potential for elevated pH and possible aquaCic Iife and fish kills. 12. During the construclion of the project, no staging of equipment of any I<ind is permitted in waters of the U.S., or protectcd riparian buff'crs. 13. '1-he dimension, pattcrn and profile of the stream above and bclow the crossinb shall not be modifietl. Disturbed floodplains and streams shall be restored to i�atural geomorphic conditions. 14. The use of rip-rap above theNormal High Water Marl< shali be miuimized. Aiiy rip-rap placed for stream stabilization sh�l) be placed in sLeam channels in such a manner that it does not impede aquatic life passnge. 15. 'I'he Permittee shall ensure that tl�e final design drawings adhere to the permit and to the permit drawings submitted i'or approval. 16. All ���ork in or adjaeent to stre�m waters shall be conducted in a dry «�ork area. Approved I3MP measures from the most current ve�sion ofNCDOT Consp�uction and MainYenanee Activities manual such as sandbags, rock berms, cofferd�ms and other diversion structiu�es shall be used to prevent exc2vation in tlowing water. 17. 1Teavy equipment shall He operated fi'om the banl<s rather than in the sh'eam channel in order to minimize sedimentation and reduce the introduction of od�er pollutants into thc sh�eain. I8. All mechanized equipment oper2ted near surfaee ��aters must be regullrly inspected and maintained to prevent contamination of su�eam waters fi�om fuels, lubrican[s, hydraulic fluids, or other toxic materials. 19. No rocic, sand or other materials shall be dredged from the sU�eam channel except where authorized by this ccrtiFication. 20. Discharging hydroseed mixlures and washii�g out hydroseeders and other equipment in or �djacent to surface waters is prohibited. 21. Tl�e permittce and its' authorized agents shall conduct its aciivities in a mnnner consistei�t with State waler qu�lity standards (including any mt�uirements resulting 6�an com�lianee with §303(d) of the Clean �Vater AcQ and any othcr appropriate rcquirements of State and Pederal Iaw. If NCllWQ determines that such standards or lews are not bcing met (including the failure to sustain a designated or achieved use) or that State or federal I��a� is being violatcd, or that further coi�ditions are necessaiy to assure compliance, NCDWQ may reevaluate and modify this certification. 22. AII fill slopes located in jurisdictional wetlands shall be placecl a[ slopes no flatter than 3:1, unless otherwise authorired by this certitication. 23. A copy of this Water Quality Certification shall be maintained on the construction site at alI times. The outsidc buffer, ��vetland or waier boundary located within the construction corridor approved by this authorization shall be clenrly markeci by highly visible fencing prior to any land disturbing aclivities, Impacts to areas wi[hin the fencing are prohibiteci unless otherwise authorized by this certification. 25. The issuance of this certitication does not exempt the Permittee froin complying with any and all statutes, rules, regulatiais, or ordinances that may be imposed by other �overnmen[ agencies (i.e. Iocal, state, and federal) havingjurisciiction, ineluding but not Iimited to applicable buffer rules, stormwater managemei�t rules,soil erosion and sedimentation ca�trol requirements, etc. 26. The Pennittee shall report any violations of this certiiicltion to t6e Division of Water Quality withio 24 how's of discovery. 27. UE�on completioii of ihe project (incli�ding any impacts nt associated bon�ow or waste sites), the NCTA (ortheir authorired agent) shall complete and return the enclosed "Certification of Completion Fa�m" io notiiy NCDWQ when all worl< induded in the 40I Certil��cation has been compieted. 28. Native riparian vcgetation must be reestablished in the riparian arens within the construction limits of the project by the end of the growing season following completion of construction. 29. There shall be no excavation from, or waste disposal into, jurisdicUonal weflands or waters associated with this permit without lppropriate modification. IPmidtiplc pipes or barrels �rc reqoired, they shall be designed to mimic natural stream cross section as dosely as possible including pipes or barrels at flood plain elevation andlor sills where appropriate. �Videning the stream channel should be avoided. Stream channel widening at the inlct or oudet end of struchires typically decreases water velocity causing sediinent deposition that requires increased maintenaiice and disrupts aquatic life p�ssage. 39. Pipes and culverts used exclusively to maintain equilibriam in wetlands, where aquatic life passage is not a conoern, shall not be btu'icd. These pipes shall be installed at natural ground elevation. 40. All portions of the proposed project draining to 303(d) listed watersheds that are impaired due to biological m�iteria exceedances shall nol discharge stormwater directly to surfacc waters. Stormwater shall be treated using �ppropriate best managemenl practices (e.g., vegetated conveyAi�c�s, consG'ucted wetlands, detention ponds, ete.) prior ro discharging to surtace watcrs. 41. Violations of any eondition herein set forth may result in revocation of this Certitication and may result in crimi�al and/or civil penalties. This Certitication shall become null and void unless the above condidons ai�e made conditions of the l��edcral 404 Permit.
