Jason We request exception to the condition that all work in or adjacent to stream waters shall be conducted so that the flowing stream does not come in contact with the disturbed area. This exception is requested in order to provide for efficient construction with minimal time of site disturbance. Best management practices shall be used to minimize excavation in flowing water. Equipment work will be done only in low -flow conditions. The first activity will be to excavate a diversion channel lined with native river cobble to carry stream flow to the left side of the stream restoration site during channel realignment and construction of in -stream structures. Final grading will be done from the banks. At the end of each day, disturbed areas will be stabilized. All our Certifications require work to be done in the dry. The specific wording of the condition is below. If you propose to dewater the work area while installing the structures and realigning the stream, you'll need to specifically request exemption from the condition and provide justification. In addition, please specify any specific measures that will be taken to ensure downstream water quality protection such as "all equipment working from the bank, working only in low flow conditions, diverting the thalweg or majority of the flow away from work area, only disturb an area that can be stabilized at the end of each day, use of a turbidity curtain downstream, etc. (these are just examples and not everything you could consider). I'm copying the USACE and WRC on this email because I believe both agencies will want to receive a copy of the request if you submit one. All work in or adjacent to stream waters shall be conducted so that the flowing stream does not come in contact with the disturbed area. Approved best management practices from the most current version of the NC Sediment and Erosion Control Manual, or the NC DOT Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams, and other diversion structures shall be used to minimize excavation in flowing water. Exceptions to this condition require application submittal to and written approval by the Division.
