PROJECT SUMMARY: The Town of Swansboro is applying for a Major Modification to Major Permit 58-12 to expand an existing No Wake Zone. This will be accomplished by adding three additional buoys along the AIW W. Field Investigation Report: Swansboro, Town of Page 02 9. NARRATIVE DESCRIPTION: The Town of Swansboro project is located along the AIW W just offshore of the downtown area. This area is located by traveling on Hwy. 24 and turning onto S. Water St. The three proposed buoys are located offshore of Caspers Marina. There are no SAVs in this area and the bottom substrate consists of fine sand with some silt. This area is classified as SA-HQW and is closed to the harvesting of shellfish. It is not a Primary Nursery Area. This shoreline in Swansboro is classified as commercial and residential in the LUP. 10. PROJECT DESCRIPTION: The applicant is proposing to install three additional "No Wake" markers along the AIWW. These buoys are labeled as Proposed No. 4,5,&6 on the associated drawings. This area is formally designated as a "No Wake Zone" by 15A NCAC IOF .0369. The No Wake Buoys would be of Standard NCWRC size and markings. They would be anchored to the bottom by concrete block. 11. ANTICIPATED IMPACTS: Approximately 12ft2 of deep bottom benthic habitat would be disturbed during placement of the concrete anchors for the No Wake Buoys. The placement of the buoys and associated anchors should pose no environmental impact. No impacts to SAVs or wetlands would occur as a result of this project. This portion of the No -Wake Zone is currently marked/permitted with three buoys located within the Town's riparian corridors associated with the street ends (Moore, Main, and Church Streets) and landward of the federal channel setbacks. Three additional buoys are proposed for placement within the riparian corridors of properties located at 219 and 313 S. Water Street and an island in the White Oak River, locally known as Pelican Island. The additional buoys will be placed landward of the federal channel setback. The No -Wake Zone is designated in 15A NCAC 1 OF .0320 (copy attached). The Town of Swansbom is designated a suitable agency for placement and maintenance of the markers implementing this rule in 15A NCAC 1 OF .0369 (copy attached). c. Give complete description: Major CAMA permit 58-12 authorizes the Town of Swansboro to place three No -Wake Zone buoy markers in the White Oak River at the ends of Moore, Main, and Church Streets along the Town's downtown waterfront area. Specific locations of the three permitted buoys are shown on project plans and include latitude and longitude coordinates. The permitted locations are outside the federal channel and federal channel setbacks and within the Town's riparian corridors associated with the public streets. The current submittal requests a modification of the permit to authorize placement of three additional No -Wake Zone buoy markers in the White Oak River. The Town of Swansboro proposes to place markers within the riparian corridors associated with 219 S. Water Street, 313 S. Water Street, and an island in the White Oak River known locally as Pelican Island. The three additional markers will also be located outside of the federal channel and federal channel setbacks. The location and coordinates of the three proposed buoy markers are shown on project plans. Included is a drawing provided by the North Carolina Wildlife Resources Commission of the standard No -Wake Zone buoy. The buoy includes appropriate markings and is secured with a concrete anchor. The permit authorizes placement of the markers at the ends of Moore, Main, and Church Streets. The permit was renewed in December 2015 and is effective through 2017. The purpose of the buoys is to mark a section of an existing No -Wake Zone previously established by the North Carolina Wildlife Resources Commission (WRC), as described in 15A NCAC 10F .0369. The WRC designated the Town of Swansboro as a suitable agency for placement and maintenance of the markers implementing the No -Wake Zone, as specified in 15A NCAC 10F .0369(c). The Town desires to modify the permit to include installation of three additional buoys, for a total of six buoys. The new buoys are proposed for placement in the vicinity of Casper's Marina and will mark a section of the existing No -Wake Zone. The buoys will be placed outside the US Army Corps of Engineers (USACE)-designated federal channel setbacks and within the riparian corridors of properties located at 219 S. Water Street, 313 S. Water Street, and an island in the White Oak River known locally as Pelican Island. Site Description The original project site consisted of the riparian corridors of the ends of Moore, Main, and Church Streets in downtown Swansboro. Permitted buoys in these locations are labeled on project plans as Existing Numbers 1, 2, and 3. All three Town -owned street ends provide for public water access, with Town -owned docks located at the end of Main and Moore Streets. A highground waterfront gazebo was recently built in the Church Street right-of-way to provide opportunities for visual access to the water. The properties surrounding the original project area contain a mix of residential and commercial uses, including restaurants, boutiques, and gift shops. The original project area is included in the National Register Historic District and contains many historic buildings. The Town of Swansboro zones this area as B-2 HDO (Historic District No -Wake Zone Buoys Town of Swansboro Major CAMA Permit #58-12 Modification July 11, 2016 Page 1 CEN .s Overlay). The project site is also included in an urban waterfront redevelopment area JUL 13 7016 designated by the Town of Swansboro. DCC— NAHD C��j FY Proposed buoy Number 4 will be placed in the riparian corridor of two adjoining properties located at 219 S. Water Street. The two parcels are owned by Charles and Carol Lanier and contain a residence, office, and dock. This site is zoned B-2HDO and is included in the historic district and urban waterfront redevelopment area. Proposed buoy Number 5 will be located in the riparian corridor of 313 S. Water Street, owned by Billie Jean and Harmon Simpson. This property is zoned as R-6SF and is located outside the historic district. It does not appear to be located in the urban waterfront redevelopment area. A residence and dock are located on the property. Proposed buoy Number 6 will be located in the riparian corridor of an island in the White Oak River known locally as Pelican Island. The island is owned by Donald Suggs and others. The Town zones Pelican Island as Conservation. It is used for water-based recreation, with a boat dock located on the island. The Swansboro Side Channel and Basin is a federally maintained channel located in the White Oak River adjacent the project site. Normal Low Water (NLW) depths in the locations of the proposed new buoys range from -12.0' to -14.7'. Research of historical USACE hydrographic mapping and previous conversations with agency staff indicate that shoaling is not a problem in the federal channel and basin. Dredging has not been required in recent years. Fringes of coastal wetlands located at several locations along the project site will not be impacted by the project. The Highway 24 Corbett Avenue Bridge crosses the White Oak River just east of the project area. The NC Department of Transportation Right -of -Way associated with the bridge, as shown on project plans, is not impacted by this project. Project Description The US Army Corps of Engineers (USACE) enforces setbacks for all structures from the federal channel in the entire project area. Additionally, CAMA regulations require all structures to be No -Wake Zone Buoys Town of Swansboro Major CAMA Permit #58-12 Modification July 11, 2016 Page 2 located a minimum of 15' from the adjacent riparian corridors, unless a waiver is provided by the adjacent riparian neighbor. Waivers to the 15' CAMA setback were required for placement of two of the original buoys. Port O'Swannsborough provided a waiver for the Church Street buoy and MooreCoastaIR E IV ED Investments, LLC waived the CAMA setback for placement of the Moore Street buoy. JUL 13 2016 The proposed locations of the three new buoys meet the 15' riparian corridor setbacl-ONVU111- Ian D UT) waiver will be required. The buoys will be placed outside the federal channel setbacks, consisting of 42' for Number 4 and 100' for Numbers 5 and 6. Specific latitude/longitude coordinates for the buoy locations are shown on project plans, in association with the riparian corridors, federal channel, channel setbacks, and NLW depths. Normal Low Water depths shown on the project plans are based on hydrographic surveys previously provided to the Town by the USACE and performed in association with a separate major CAMA permit request associated with the end of Moore Street. Depths for the proposed buoy locations were recently obtained by a local engineer. Construction Methods Buoys constructed to uniform standards will be installed at the approved locations. The buoys will be appropriately marked and secured on the river bottom by chains and concrete anchors. A detail drawing of the buoy markers is included on project plans. A pontoon boat will be used to set the anchors, chains, and buoys. Summary Major CAMA permit 58-12 authorized installation of three No -Wake Zone buoys to mark a section of an existing No -Wake Zone in the White Oak River along the Swansboro waterfront. The current proposal requests a permit modification to authorize installation of three additional buoys, for a total of six buoy markers. The buoys constructed will be installed outside the required setbacks to the federally designated Swansboro Side Channel and Basin and within the riparian corridors associated with 219 S. Water Street, 313 S. Water Street, and Pelican Island. Project impacts will be minimal, with no other proposed development activity.
