Brian,
Yes, sort of. Although no survey reports are technically required to be provided to me for a "No Effect"
determination, it would be good practice for her to provide them to you and the USACE. Since the USACE is
the federal action agency in this case for Section 7, it would be best for David to have the survey reports so that
he is comfortable with the "No Effect" determination.

Good morning! After much digging, and chasing my own tail, I think I’ve got what you need.
From NES: Marginal habitat for smooth coneflower and Michaux's sumac in powerline ROW in southwest quadrant of
bridge. Most of the other roadside habitat is mowed too regularly. Surveys were completed on 9/2013.

I agree with David. A "no effect" biological conclusion is appropriate for the dwarf wedgemussel due to the
project location being in the Roanoke basin. However, there is insufficient information to document the
biological conclusion for smooth coneflower and Michaux's sumac. February is not the appropriate time of
year to look for these species.
With regard to going from a bridge to a culvert at this location, I have no objections.

threatened and endangered species and need clarification.
No Effect for dwarf wedgemussel makes sense given its location in the Roanoke River Basin.
Your proposed determination for smooth coneflower and michaux's sumac appears to be based on a field
scoping in February 2014. However, there is no information on whether habitat for these species is present or
not, or if USFWS had already weighed in on the project's effects on these species. Per usual, if habitat for
either of these species was present then surveys should have been done during flowering season. Any
additional information you have would be helpful. Thanks.
