Dear Ms. Dotson:
On October 12, 2007, your office issued an approval to Len Bealer of Kenneth Bealer Homes to
construct a proposed septic repair area in the 50-foot protected riparian Catawba buffers at the
subject property. This approval for the proposed nutrient bearing waste system within the
protected riparian buffer is in direct violation of the Catawba Buffer Rules (15A NCAC
213.0243).
Please see the attached Catawba Buffer Rules (15A NCAC 213.0243) for your review. If a use is
not listed in the table of uses in 15A NCAC 2B.0243(6), the use is considered prohibited in the
protected riparian buffers. Please call Ms. Cyndi Karoly or MS. Amy Chapman at 919-733-1786
