Bridge 990130, SR 1146 Cane Branch Road
State Project No. 17BP.13.RJ7
Yancey County, NC
Dear Ms. Beckwith:
PAT McCRORY
ca„o,
NICHOLAS J. TENNYSON
s.rory
I have enclosed a set of plans, a PCN application for NWP #14, and a vicinity map relative to the
proposed bridge replacement project on SR 1 146 Cane Qranch Road, Yancey Counry, NC.
We propose to replace the existing 17'bridge with an I 8' bottomless culvert (bridge). A total of
121 linear feet of permanent impacts will occur for structure footing (61') and rip rap (50`) in
Cane Branch. Temporary impacts of 121 linear feet on Cane F3ranch are necessary for dewatering
during construction. Tlc existing streambed under the structure will not be impacted or modified.
T'he stream is approximately 6-8 feet wide with a predominately cobble, boulder and bedrock
substrate. Cane E3ranch is classified as Class C, Trout.
xisting channel morphology will be maintained upstream and downsUeam of the bottoniless
culvert Riparian vegetation will be reestablished along disturbed areas associated wilh the
project Stormwater will be diverted through grass-lined ditches or vegetated buffers prior to
entering streams.
This project may impact potentially suitable northern long-eared bat (Myotis septenhionalis)
(NLEB) sinnmer roosting habitat via U'ee clearing. Less than 10 trees will be cleared for the
project. However, the project is located outside of the highlighted areas/12-digit HUC's and
does not require prohibited incidental take; as such, this project meets the criteria for the 4(d) rule
and any associated takc is exempted/excep[ed. No effect on the remaining Yancey County list of
federally protected spccies (threatened or endangered) or designated critical habitat will occur.
Andrew I lenderson of US Fish and Wildlife Service is copied on the aplication for review.

As a part of the 401 Certification process, the project was processed through the DOT
Programmatic Agreement for Minor Project as required by Section 106 of the National
Historic Preservation Act of 1966 and GS 121-12(a). No Historic Resources will be affected.
By copy of this Ietter, we request Marla Chambers, North Carolina Wildlife Resources
Commission Western Region Coordinator, to comment directly to the Corps concerning the
permit request.
By copy of this letter, we are asking the Area Roadside Field Operations Engineer, to comment
on the above project. Cane Branch is classified as Class C, Trout. The project will not require a
trout buffer variance.
By copy of this letter, I am forwarding one electronic copy of the application package to Kristi
Lynn Carpenter, NC Division of Water Resources, Transportation Permitting Unit with cc to
Kevin Barnett, NC DWR Asheville Regional Office for review and comment. Please charge the
application fee of $240.00 to WBS element # 17BP.13.R.77. Please forward comments directly
to the Corps with copy to Division 13 Environmental Officer.

 Other information (please specify):
1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation beig reguired or diff_er_ent special conditions_ (3)_ that
the applicant has the right to request an individual permit rafher than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies ail aquatic features on the site that could be
affected by the proposed activity, based on the following information:
IMPORTANT NOTE: The information recorded on this form has not
necessarilv been verified bv the Corps and should not be relied upon for
later iurisdictional determinations.
