A copy of this application has also been sent to the US Army Corps of Engineers. We have enclosed a wetlands and endangered species report, a vicinity map, a USGS ri'opographic Quad Map and a portioil of the Roadway Construction Plans showing the location of the stream impact. Also enclosed is the onsite evaluations of the potential endangered species in the area, and website reparts concerning essential fish habitat, and historical structures. Based on the reports, the project should not have an impact on any endangered or threatened species, essential fish habitat, or historic structures. Habitat Description: Bog turtle habitat consists of open, groundwater supplied (spring fed), graminoid dominated wetlands along riparian corridors or on seepage slopes. These habitats are designated as mountain bogs by the North Carolina Natural Heritage Program (NCNHP), but they are technically poor, moderate, or rich fens that may be associated with wet pastures and old drainage ditches that have saturated muddy substrates with open canopies. These habitats, found between 700 and 4,500 feet above mean sea level in the western Piedmont and mountain counties of North Carolina, often support sphagnum moss and may contain carnivorous plants. Soil types (poorly drained silt loams) from which bog turtle habitats have been found include Arkaqua, Chewacla, Dellwood, Codorus complex, Hatboro, Nikwasi, Potomac—lotla complex, Reddies, Rosman, Tate-Cullowhee complex, Toxoway, Tuckasegee- Cullasaja complex, Tusquitee, Watauga, and Wehadkee. Biological Conclusion: Not Required Species listed as threatened due to similarity of appearance do not require Section 7 consultation with the USFWS. However, this project is not expected to affect the bog turtle because no suitable habitat is present within the study area. A review of NCNHP records, dated October 14 2015, indicates no occurrence of bog turtle within 1.0 mile of the study area. Please refer to the enclosed package from NCNHP. Northern long-eared bat USFWS Recommended Survey Window: April 15 — October 15 Habitat Description: During summer, northern long-eared bats (NLEB) roost singly or in colonies underneath bark, in cavities, or in crevices in both live and dead trees and/or snags (typically >3 inches diameter at breast height [dbh]). Males and non-reproductive females may also roost in cooler places, like caves and mines. This bat seems opportunistic in selecting roosts, using tree species based on suitability to provide cavities or crevices or presence of peeling bark. It has also been found, rarely, roosting in structures like barns and sheds when suitable tree roosts are not available. During the summer, NLEB emerge at dusk to forage in upland and lowland woodlands and tree-lined corridors. In North Carolina, it is reported that the NLEB hibernation season is October 15 — April 15. The bats spend winter hibernating in caves and mines, called hibernacula. They typically use large caves or mines with large passages and entrances; constant temperatures; and high humidity with no air currents. Specific areas where they hibernate have very high humidity, so much so that droplets of water are often seen on their fur. Within hibernacula, surveyors find them in small crevices or cracks, often with only the nose and ears visible. These trees are in residential settings adjacent to the existing roads. No known, occupied maternity trees were identified within 3 miles of the project study area based on review of NCNHP records (updated lanuary 2015). No known, occupied hibernacula were identified within 3 miles of the project study area based on review of NCNHP records (updated April 2015). The proximity of subsurface mines within 3 miles was examined using the Mineral Resources Data System hosted by U.S. Geological Survey (USGS). No subsurface mines were identified within 3 miles of the project study area. No bridges or large culverts are present in the project study area. No other structures that could qualify as suitable habitat for NLEB are in the areas anticipated to be cleared for the proposed action. Please refer to the enclosed package from NCNHP. A review of NCNHP records, updated October 2015, indicates no known occurrence of northern long-eared bat within 1.0 mile of the study area. The closest known occurrence of NLEB is in Burke County (NCNHP 2001 mist net records) approximately 42 miles west of the project study area. Because the trees to be removed are limited in number and located in residential settings, the trees to be removed are within 100 feet of existing road surfaces, the trees to be removed are not documented maternal roosting sites or foraging habitat, and no known summer roosting sites or winter hibernacula sites are documented within 3 miles, the project shouid result in a biological conclusion of May Affect — Not Likely to Adversely Affect for NLEB if tree-cutting occurs between August 15 and April 15. If tree clearing cannot be accomplished during the August 15 to April 15 period, additional consultation would be required with USFWS to determine the project effect. Dwarf-flowered heartleaf USFWS Recommended Survey Window: March through May Habitat Description: Dwarf-flowered heartleaf is endemic to the western Piedmont and foothills of North and South Carolina. This herbaceous evergreen is found in moist to rather dry forests along bluffs; boggy areas next to streams and creek heads; and adjacent hillsides, slopes, and ravines. Requiring acidic, sandy loam soils, the species is found in soil series such as Pacolet, Madison, and Musella, among others. Occurrences are generally found on a north facing slope. Undisturbed natural communities such as Piedmont/Coastal Plain Heath Bluff, Dry-Mesic Oak Hickory Forest, and Mesic Mixed Hardwood Forest hold the most viable occurrences. However, less viable remnant occurrences are found in disturbed habitats, including logged, grazed, mown, and residential/commercial developed lands; areas converted to pasture, orchards, and tree plantations; roadside rights-of-way; and on upland slopes surrounding manmade ponds or lakes.
