According to our rules [15A NCAC 2B.0233(8)(b)], if final action is not taken within 60 days, the Authorization is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement for a Buffer Authorization for your plans to fill or otherwise impact 175 square feet of Zone 1 protected riparian buffers and 7,200 square feet of Zone 2 protected riparian for the purpose of constructing the proposed shopping center at the subject property. However if additional impact occurs or your development plans change, this waiver is no longer valid and a Buffer Authorization will be required.
