Sullins, Director Division of Water Quality March 14, 2008 DWQ Project # 08-0067, Ver. 2 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Jeffrey Smerko North Broad Street, LLC 14600 Weston Parkway Cary, NC 27513 Subject Property: Alston Pond/North Broad Street Ut to Basal Creek [030403, 27-43-15-3, B, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Smerko: On February 27, 2008, the Division of Water Quality (DWQ) received your application dated February, 2008, to fill or otherwise impact 0.06 acres of 404/wetland, 196 linear feet of perennial stream (147 linear feet permanent impact and 49 linear feet temporary impact), and 8,999 square feet of Zone 1 Neuse River basin protected riparian buffers and 5,210 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential development. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. On March 13, 2008, the DWQ met with your agent, personnel from the Town of Fuquay- Varina, and the USACE at the USACE Regulatory Field Office in Wake Forest, North Carolina. It is our understanding that a final determination regarding how your project will be permitted will be forthcoming. Therefore, your project will be placed on hold until we receive this information. Please submit this information within 30 calendar days of the date of this letter.
