Here is the recent history of that area at the lower part of Broad Creek outside Wanchese Harbor. I have attached "Hl—History" which will show you the changes in shellfish closures through the years. The area in question was open to shellfish harvest until 6/29/07 when changes were made via Proclamations PA -52-07 and PA -53-07. These changes opened approx. 245 acres in one area while closing approx. 37 acres near the dockage area in question (See attached Figure 6) for a graphic of this change. The current closure line was moved northward at the time due to concerns of potential pollution sources (see attached H- 1 Sanitary Survey 2006) in the area... namely the "wetlands area" that was created (I believe as a mitigation project) on the outside of Wanchese harbor. There were massive bird areas and waste (see Figure 4 in Sanitary Survey) that potentially discharged from the pipe or otherwise affected adjacent surface waters. Finally, I have attached "Doc1" which shows the current closure line close up. Let me know if you need anything else. Summary of Bacteriological Sampling Data 39 The H-1 area of coastal North Carolina, which includes the Roanoke Sound area of Dare County, lies in the northern portion of the state off the Atlantic Ocean. Review of the bacteriological data since the last triennial survey of 2002 indicates little overall change in bacteriological water quality in most areas of H-1. Some areas have shown improvement in bacteriological water quality. Two areas will be reclassified as a result of this survey. Approximately 45 acres in the Manteo area will be reclassified from Prohibited to Approved. Additionally 240 acres will be reclassified to Approved in the Wanchese area. Finally, approximately 34 acres will be reclassified to Prohibited east of Wanchese Harbor. 1.0 SANITARY SURVEY li11111■1►19d*lBills] 9Is] 0I Area H-1 is composed of all those waters in Roanoke Sound north of a line from Smith Island to South Point at Oregon Inlet and south of a line from Northwest Point to Mann Point. The area includes those waters in Shallowbag Bay, Broad Creek and Mill Creek. See Figure 1 for an area map and sampling station locations. Table 1 contains sampling station descriptions. Roanoke Sound is bordered on the east by the Outer Banks (Nags Head area) and on the west by Roanoke Island. The Outer Banks portion of the survey area is comprised of all areas west of Highway (Hwy) 158 and Hwy 12 from the Nags Head -Kill Devil Hills town limits south to Oregon Inlet. The Roanoke Island portion of the survey area consists of all areas on the island east of Hwy 64/264 and Hwy 345 and includes eastern Wanchese and Manteo and the residences on the island's northeastern shore. H-1 is located in Dare County, which is one of the most rapidly growing counties in the state. Nags Head has a permanent population of approximately 3,200 but this number increases to approximately 60,000+ during the summer months. Manteo has approximately 1,400 permanent residents. These population figures were acquired from census records and from the respective municipalities. It should be noted that roughly half the residents of Manteo and Roanoke Island live outside the H-1 survey area. Much of the survey area is uninhabited marshland. 1.2 SHORELINE SURVEY OF SOURCES OF POLLUTION A comprehensive shoreline survey of the H-1 area began 5/13/05 and was completed on 7/08/05. Annual surveys were completed in 2003, 2004 and 2006 as well. Prior to the survey, the Dare County Health Department was contacted and informed of the intended route and survey area. All homes, businesses and places of public assembly within proximity of the open waters of Roanoke Sound were surveyed except homes and businesses connected to wastewater treatment plants. Subdivisions make up a large portion of the survey area (See Figure 2 and Table 2 for specifics and subdivision locations). One of these subdivisions, Pirate's Cove, continues to see significant development of both single-family residences and condominiums. Currently there are close to 566 residential units within the subdivision. There are condominiums under construction with one condominium building being completed last year. All residences and businesses within Pirate's Cove are connected to the Manteo Municipal Waste Water Treatment Plant. Manteo Waterfront is replacing its bulkhead and backfilling the east side of the waterfront. This could cause some run-off until vegetation is established. In Nags Head, South Ridge Subdivision is adding another phase of about 16 lots. This added about 300 yards of paved road. Nags Head Elementary is still under construction. The school will have a 7000 gallons per day (GPD) low-pressure pipe system with a Bioclere system used for pretreatment. The Army Corp of Engineers is currently constructing wetlands in Wanchese at the mouth of the Industrial Park. A 1,500 -foot rock jetty has been completed. The next step of the construction will be filling that area with dredge spoils and planting wetland vegetation. Significant run-off should be expected until the vegetation is established. The central Nags Head area continues to see steady and significant construction of seasonal residences and retail businesses. Much of the construction is in the Village at Nag's Head subdivision, and even though it is occurring close to the ocean outside of the survey area, the new houses are connected to the wastewater treatment plant that is within the area. There is one 18 -hole golf course in the survey area. The Village at Nags Head Subdivision is built around this course and there are several retention ponds constructed to receive run off from the greens, roads, and houses. Due to the proximity of the course to the sound, some run off could possibly affect water quality in the sound despite the use of the retention ponds. Housing construction along the sound in this development has slowed due to the unavailability of lots. Currently there are approximately 620 houses and condo units located between the sound and highway in this development. There are currently five wastewater treatment plants in operation in the H-1 survey area, with only one discharge into the sound (Figure 2, Table 3). The Manteo Municipal Wastewater Treatment Plant, which has 600,000 GPD capability, utilizes tertiary treatment with post -chlorination and sulfur dioxide dechlorination. The plant's current daily use since the last comprehensive report averaged around 280,000 GPD, but at times exceeded 400,000 GPD. This plant has a history of exceeding its parameters for fecal coliform, petroleum, and NH3 levels in the effluent discharge. Although the plant is physically located in the H-2 survey area, it discharges 3,400 feet offshore into Shallowbag Bay in the H-1 area. Sludge from the plant is stored in an on-site lagoon until it can be transported to Newbern Brothers' Farms in Currituck County for land application. The plant currently provides sewage treatment for all residences and businesses within town limits of Manteo and the Pirate's Cove subdivision even though much of Manteo is outside the survey area. The treatment plant for the Villas Condominiums in north Nags Head is a tertiary treatment plant with a 60,000 GPD capability that services 120 residential units. Average usage fluctuates from 5,000 GPD in the winter to 20,000 GPD in the summer. The plant now discharges into two ponds and no longer discharges into the sound. The Village at Nags Head subdivision uses a 400,000 GPD treatment plant, and they now use their discharge for irrigation of the golf course. The summer peak usage can be over 280,000 GPD. The plant is permitted to upgrade to 1,000,000 GPD and an upgrade may be necessary as plans call for the subdivision to double in number of residences. The wastewater treatment plant for the Tanger Outlet Shopping Center is a package plant capable of treating 17,000 GPD. There are twenty-four stores connected and actual usage is 3,300-15,000 GPD. An LPP drain field is used for final effluent disposal. The Soundside Pavilion package plant in Nag's Head has a design flow of 35,000 GPD. The Soundside Pavilion is no longer in business, but this plant is now used by Windmill Point Restaurant. Effluent disposal is by low-pressure pipe (LPP) distribution. The Wanchese Seafood Industrial Park wastewater treatment plant is not in operation as of this date. The 270,000 GPD tertiary treatment plant has been completed and all existing businesses have been connected but park officials feel that there is not enough wastewater being produced at this time to operate the plant efficiently. The treatment plant is planned to go on-line when a larger amount of wastewater is available such as when a new business opens in the park. This is not expected to take place in the near future. There is a discharge pipe next to Jockeys Ridge Park that discharges into the sound. The pipe drains Soundside Road in Nags Head. This will affect the water quality in the area of the discharge pipe during a rain event. 3 Andy's Travel Park, the only campground within the survey area, has eight septic tanks with a total volume of 13,000 GPD and 28 sewage hookups. There were only three campers present at the time of the survey. There are nine marinas in the survey area. The boat basin at Pirate's Cove Marina is the largest in the survey area with 181 slips. Salty Dog Marina is closed at this time and is being redeveloped. See Figure 2 and Table 4 for information regarding all marinas within the survey area. The Broad Creek extended marina was under construction during the time of the shoreline survey. It has been completed at the time of this report and has 28 boat slips. Condition of the permit says they cannot have over 29 boats and no boats over 24' in length, no boats with heads and no boat with cabins. The marina has two boat ramps. During a rain event run-off from the parking lot can drain into Broad Creek from the boat ramps. Some evidence of bottom paint maintenance has been observed in this area. It appears that runoff after rainfall reaches the waters east of Wanchese Harbor (Figure 3). This was reported to the NC Division of Water Quality. The Umphlett Marina will also have 28 slips under the same conditions as Broad Creek Extended Marina. No construction has started at this time on the marina. There is a Coast Guard station located at Oregon Inlet that supports 34 coastguardsmen and three rescue vessels, two of which have heads with removable holding tanks. The main industry in the survey area is tourism. The majority of the houses in the Nags Head subdivisions are inhabited only during the summer. There are several businesses along the sound on Hwy 158 and extend along the causeway on Hwy 64/264. This commercial zone has restaurants, go-cart tracks, miniature golf courses, gas stations, water sports rental stores (jet skis, air boats, etc.), and two strip malls, a campground and a small crab picking operation. Many of these businesses are connected to WWTP's and/or LPP systems. Manteo also has a commercial area on the waterfront that includes restaurants, retail stores and Roanoke Festival Park. The park consists of a 230 -seat movie theater, exhibit hall, visitor center and an outdoor amphitheater that holds 1,000. The park and the adjacent businesses are connected to the municipal sewage plant. Seafood is another big industry in the H-1 survey area and Wanchese Harbor is the central location for this enterprise. The Wanchese Seafood Industrial Park consists of 20 businesses on the eastern side of Wanchese Harbor. On the western side of the harbor there are approximately 12 other businesses. Most of the businesses along the harbor are seafood packing and processing plants or businesses such as marinas, outfitters and marine repair shops that support the park's large fishing fleet. The fleet consists of several large trawlers (4 above 50 4 feet in the harbor at time of survey) and many smaller vessels such as long -liners and gill net boats. There are also several large trawlers abandoned and half - submerged within the harbor. A large area around the mouth of the harbor is closed to shellfishing. The U. S. National Park Service maintains two conventional septic systems at the northwestern end of the Oregon Inlet Bridge to dispose of sewage from throughout the national seashore. One system consists of three tanks (a 5,000 and a 1,000 gallon tank for the Oregon Inlet Fishing Center and a 2,000 gallon tank for the comfort station also at the fishing center) and a drain field consisting of six 90' conventional drain lines. The other system, which sits adjacent to the fishing center system, is used for treating sewage pumped from the pit privies within the Bodie Island Wildlife Refuge and from the dump station at the federal campground at Oregon Inlet (not within the survey area). This system consists of a 32' x 40' conventional drain field and a 3,000 -gallon tank. This system was found to be failing during time of inspection. Park officials were unable to give any daily usage estimates or design capacities for either system. Poisonous or deleterious substances are not a major concern in most of this survey area due to the lack of industry. There may however be the possibility of these substances entering the waters around Wanchese where bottom paint removal is performed and several old trawlers and barges have been left abandoned around the mouth of the harbor basin. There are no large concentrations of livestock within the survey area. There is a small cow pen located in Manteo and a horse pen in Wanchese that both occasionally flood during periods of high water (Figure 2). There is a substantial wildlife population in the survey area that could affect water quality. An estimated 25-30,000 waterfowl can be found in Roanoke Sound during the winter months. The largest concentration of these birds is found in the marshes and freshwater compounds of Bodie Island Wildlife Refuge (Figure 2). The entire eastern and western H-1 shoreline south of Hwy 64/264 is marshland so large numbers of wading birds, nutria, raccoons and other large animals could be expected. A large population of seagulls would be expected around the Wanchese Seafood Industrial Park. A constructed wetlands has been completed and is located in the mouth of the Broad Creek. The wetlands consist of a 1,500 -foot rock jetty with a drain located at the north end of the wetlands. The next step of the construction will be filling that area with dredge spoils and planting wetland vegetation. Several hundred seagulls, pelicans and a large amount of fecal matter were observed on several occasions inside the wetlands. Significant run-off should be expected during any rain event. Refer to Figure 4 for pictures of the spillway pipe from the wetlands project and waterfowl. 5 During this survey, there were 420 visits made, 390 inspections, 71 conferences, and one violation was noted. The area was also surveyed one day by boat with 150 additional inspections completed. The violation was located at Oregon Inlet Fishing Center, as mentioned above, and the Dare County Health Department was notified and the problem has been corrected. All violations from previous surveys have been corrected. This area has had significant flooding from the heavy rainfall associated with Hurricane Alex and Charlie. The rainwater flooded low-lying areas flooding septic systems and some homes. The run-off from this should have been significant. 1.3 HYDROGRAPHIC FACTORS RESPONSIBLE FOR THE SPREAD OF POLLUTION Area H-1 is influenced by both wind and lunar tides. Oregon Inlet affects current movements mainly in the southern half of the area, although it can affect the entire area during certain weather conditions. Freshwater runoff is generally not a problem in this area unless there is an unusual storm event. Albemarle Sound, located to the immediate north of Area H-1, greatly influences the area during periods of northerly winds. With a combination of heavy rainfall and northerly winds, the H-1 area will receive a large volume of fresh water from Albemarle Sound and its associated river systems. Rainfall amounts are recorded for this area at the Shellfish Sanitation office (Table 5). Salinities are generally low and ranged from zero parts per thousand (ppt) to 31 ppt during the time frame of this report (Table 6). Rainfall is not generally a problem in the area due to the small watershed and sandy soils. Excessive rains can cause temporary closures; however these events are considered emergency closures, which occur during extremely heavy rainfall, hurricanes or other severe storm events. Since the last Sanitary Survey Report, the approved waters of Area H-1 were temporarily closed three times, totaling 43 days, due to Tropical Storm Gustav in September 2002, Hurricane Isabel in September 2003, and Hurricane Ophelia in September 2005 (Table 7). 1.4 BACTERIOLOGICAL SURVEY OF SHELLFISH GROWING WATERS The monitoring of Area H-1 adheres to the systematic random sampling strategy outlined by the National Shellfish Sanitation Program (NSSP). Currently, the monitoring consists of 30 sample sets from 32 sampling stations located throughout the area (Figure 1, Table 1). The bacteriological survey covered for the preparation of this report included water samples from 10/8/2001 through 7/12/06. During that time period, a total of 960 water samples were collected and analyzed for fecal coliform bacteria in compliance with the systematic random sampling regime. Table 8 lists, for each individual sampling station, the date the sample was obtained, the tidal cycle upon which the sample was taken, and ambient salinity. Fecal coliform Most Probable Number (MPN) and summary statistics are listed as well. Of the 32 sampling stations located in Area H-1, three stations currently exceed National Shellfish Sanitation Program (NSSP) criteria for approved shellfishing waters. Each of these stations is located in waters that are closed for shellfish harvest. Station #9A is located at the entrance to Pirates Cove Marina, has a geometric mean of 11.67 and exceeds standards with an estimated 90th percentile of 109. Station #21 has a geometric mean of 13.56 and exceeds standards with an estimated 90th percentile of 86, which is an increase from 67 in 2002. Station #32 off the National Park Service Canal at Bells Island Bay exceeds approved standards with an estimated 90th percentile of 53. This is an improvement from 2002 when the estimated 90th percentile was 98. Many sampling stations have shown an improvement in bacteriological water quality since the last Sanitary Survey of 2002. Station #22 has shown the most dramatic improvement. In 2002, the station exceeded approved standards with a geometric mean of 14.76 and an estimated 90th percentile of 130. On 9/12/00, station #22 had a MPN of 1600 with no apparent explanation, which skewed the data. Currently, the station meets approved standards with a geometric mean of 5.65 and an estimated 90th percentile of 29. Several stations that are in closed shellfish areas now meet approved standards. Station #8 has a geometric mean of 3.42 and an estimated 90th percentile of 12 and meets approved standards. Stations #13 and #14 outside of Wanchese also meet approved standards. 1.5 SUMMARY OF BACTERIOLOGICAL DATA ANALYSIS Review of the bacteriological data for area H-1 indicates little overall change in bacteriological water quality since the last Sanitary Survey of 2002. Although most stations remain unchanged, some stations have shown slight improvement. Three sampling stations currently exceed NSSP standards for approved waters. These stations are located areas that are closed for shellfish harvest. Refer to Table 9 for summary and descriptive bacteriological statistics. 1.6 OVERALL EVALUATION AND RECOMMENDATIONS Analysis of the last five years of data gathered from sampling stations in the Roanoke Sound area indicates little overall change in bacteriological water quality since the last triennial Sanitary Survey of 2002. Although most stations remain unchanged, some stations have shown an improvement. As a result of this survey, the Prohibited area between stations #7 and #8 will be reclassified to Approved. A recommendation will be made to the Division of Marine Fisheries to open the approximately 45 acres to shellfish harvest (Figure 5). An opening will also be recommended in the Wanchese area as a result of this survey. Approximately 240 acres will be reclassified to Approved. A Prohibited area will remain 500 yards offshore from the current northern closure line to a point approximately 500 yards south of Thicket Lump Marina and the horse pen (Figure 6). Approximately 34 acres of Approved waters will be reclassified to Prohibited east of Wanchese Harbor due to pollution sources (Figure 6). In recent years the east side of the harbor area has developed. Industrial pollution sources such as bottom paint runoff, etc. has been observed. Also, the wetlands project and associated fecal loads in this area is of concern after rainfall. The treatment plant for the Villas Condominiums no longer discharges to Roanoke Sound. This closure will be evaluated in the future when sufficient depuration time has occurred. The potential for heavy metals, toxics, etc. will be evaluated as well.
