Are you familiar with this process? This assumes >24% and/or piped conveyances. Seems like if there is potential that a historical site exists on the site, then there is potential we would disturb it with our construction and should therefore verify whether or not one exists. MI Homes almost always errs on the side of caution if a little extra due diligence will minimize their risk so we're pretty sure if given these options, they will want to go with option #1. There are records dating to the 1970s that the UNCC Archaeology Dept. logged back then that occur within the project limits. The SHPO wants a survey to confirm/deny those sites as well as the rest of the site. If these sites are considered for listing in the national register, then formal consultation may be required. There are 2 options: 1. Go ahead and tee up a certified archaeologist survey; or 2. Still submit the permit and let the USACE determine the "area of effect" which is usually the area of the aquatic resource impact and their immediate adjacent uplands. This area of effect would allow the Corps to determine whether or not SHPO needs to be consulted. The outcome of #2 has chance for the Corps to require nothing, which by law would eliminate the need for SHPO consultation and subsequent survey. Or he may decide that SHPO consultation is required and a survey would be needed. I've already inquired about his thoughts on what he may do, and his response is that he can't say anything until he sees a permit. I think #2 is the best option, however, if a survey is required, the timeline for getting the permit is pushed back while waiting on results. If #1 is chosen, that could potentially be in the works prior to submitting the permit. I've just received the 1 st permit draft to review FYI.
