(SEGi) has been retained by Stevens Home Investments, Inc. and Mallory Creek Land and Timber, Inc., to pursue DA approval to permanently impact 0.031 -acre (1,349 square feet) of 404 jurisdictional wetlands. The fill is necessary to facilitate the construction of Salter Path Way and Jasper Forest Road, which will be turned over to the Town of Leland. The project is located off Old River Road (NC -133), south of Jackey's Creek, in Leland, Town Creek Township, North Carolina. The proposed project is located within a Planned Unit Development (PUD), known as Mallory Creek Plantation. In 2016, the USACE and DWR issued a NWP 14 for the extension of Mallory Creek Drive. This permit authorized 0.05 acre of Section 404 wetlands. To date, the project has authorization to cumulatively impact 0.39 -acre of USACE 404 jurisdictional wetlands and 24 linear feet of stream. Project Description 3a Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application Parts of the PUD have been developed. The subject project area consists of approximately 43 acres of parcel 0590001008 (see Appendix C for details of its location). The subject site is undeveloped, mostly wooded and contains a few ditches (RPWs) that bisect the project area. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property- None 3d Explain the purpose of the proposed project - The purpose of the project is to construct two roads (i.e. Salter Path and Jasper Forest Trail), within The Retreat at Mallory Creek, which is part of the Mallory Creek Plantation PUD. These roads will provide access to future lots within the proposed development. 3e Describe the overall project in detail, including the type of equipment to be used. The Applicant is proposing to construct two roads within The Retreat at Mallory Creek, which will provide access to single family residential lots, within the residential community referred to as Mallory Creek Plantation, off Old River Road (NC - 133) in Leland, Brunswick County, North Carolina. The proposed development plans will conform to high density residential zoning designations for the subject parcel and will be consistent with Brunswick County Uniform Development Ordinances. Utility corridors, sewer areas, fire hydrants and roadways will be put into service to meet the needs of future residents. Utility lines will be laid beneath the roadway, within the right-of-way. Please refer to Appendix D for details of the work. Prior to construction commencing, sedimentation and erosion control structures will be erected. The project area will then be cleared of vegetation. Large machinery, such as backhoes, dump trucks, and graders, will be used to construct the proposed roads and install utility lines. 4. Impact Justification and Mitigation 1. Avoidance and Minimization la Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Due to the configuration of the RPWs (i.e. ditches) and wetland, impacting the features is unavoidable. Where possible, road crossings were situated to bisect cross the features perpendicularly, thus reducing the impact. The Applicant designed the site to avoid impacting wetlands for the purpose of lot fill. 2b Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques Silt fence and other S&EC best management practices will be utilized during the construction of the roads and infrastructure. This is necessary to ensure sediment does not discharge outside the limits of disturbance. 2 Compensatory Mitigation for Impacts to Waters of the U S or Waters of the State While mitigation is not required for the impact to the RPW's, the Applicant proposes to offset those impacts by increasing the width of the RPWs within the subject site. In total, the Applicant intends to create 0.028 acre of RPW bottom (see Appendix D for details). With the extension of Mallory Creek Drive, other portions of the PUD project will be developed. Prior to future impacts taking place, appropriate permits will be obtained. Impacts to downstream water quality are not anticipated, because each individual phase of the PUD will be required to implement its own sedimentation and erosion control measures and stormwater best management practices (BMPs), which, if installed correctly, will assist keeping pollutants, in the form of sediment, from entering North Carolina's waterbodies. 4.
