Forest Hills of Hampstead
Dear Mr. Sanders:
On July 25, 2016, the Division of Water Resources (Division) received your application dated
July 18, 2016, requesting an Individual 401 Certification from the Division for the subject project.
The Division has determined that your application is incomplete and cannot be processed at this
time. The application is on -hold until all of the following information is received:
A Public Notice issued by the U.S. Army Corps of Engineers (USACE) will be necessary to
begin the proper consideration of an application (pursuant to 15A NCAC 02H .0503). The
Division will be notified by the USACE when a Public Notice is issued for your project. No
action is necessary by you regarding the Public Notice. This item is to serve as
notification to you that your application cannot be processed until a Public Notice has
been issued.
2. Page 2 of 8 of the Individual Permit Application Form carries the signature of Dana A.
Luthern. Pursuant to 15A NCAC 02H .0502(f), in order for Dana A. Luthern to sign, the
application package requires an agent authorization form from the applicant. The
application states that an agent authorization form is provided in Attachment C, but the
form is missing.
Please respond in writing within 30 calendar days of receipt of this letter by sending three copies
of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail
Service Center, Raleigh, NC 27699-1617.
