Narrative Description: This proposal is a modification request to CAMA Major Permit #49-15. It was issued to the applicant on April 17, 2015 for the construction of a public park, kayak launch, and pedestrian bridge. It is set to expire on December 31, 2018. The property is located adjacent to Slocum Creek at 120 Church Road in Havelock, Craven County. This 2.59 -acre parcel is undeveloped. The adjacent properties are wooded and undeveloped. The elevation of the high ground of the parcel is about 22' above the normal water level (nwl). Vegetation on the lot mainly consists of native deciduous trees and shrubs. There are no Coastal Wetlands in the vicinity of the project area. This parcel has approximately 260' of continuous shoreline along Slocum Creek. Immediate offshore water depths adjacent to the parcel range from —1' to —15' normal water level (NWL). The subaqueous substrate is soft without shell. There is not a cultural resource in the nearby vicinity of the project area. This waterbody is approximately 120'across at this location. These inland waters are classified as a Primary Nursery Area and the presence of submerged aquatic vegetation is unknown at this time. This area is closed to shellfish harvest and is classified as SC; Sw, Nutrient Sensitive Waters. There is not a defined Federal Channel in the nearby vicinity of this project area. This project area is subject to the Neuse River Riparian Buffer Rules. Proposed Development: The applicant wishes to expand an existing kayak launching facility and designate a No Wake Zone adjacent to Slocum Creek, in Havelock. The proposed development will take place adjacent to 120 Church Road, Craven County. The proposed development will serve the public at large. The proposed No Wake Zone (NWZ) will begin adjacent to the public boat ramp near Highway 70 and extend downstream approximately 1,000 feet. This NWZ would be defined by an entry and exit sign as well as three buoys. The signs and buoys are proposed to be approximately 10 feet from the shoreline at equidistant intervals spanning the NWZ. The proposed expansion of the kayak launch by installing a second vessel launcher on the north side. The proposed floating launcher would be 5' wide and 19' long. It would increase the existing kayak launching facility to a total of 527 square feet. Anticipated Impacts: The proposed NWZ will not pose a hazard to navigation. The proposed kayak launcher will extend 20' waterward into this east section of Slocum Creek. Traditional marine construction methodology will be utilized during the construction of this public No Wake Zone and kayak launch. Temporary turbidity impacts are not anticipated during construction. The purpose of the modification is to include: (1) No Wake Zone (NWZ) signage for an area on Slocum Creek, and (2) expansion of the kayak launch. The application fee of $100.00 is enclosed. The City is pursuing the No Wake Zone as a safety precaution for all users in the creek, particularly including new recreational users at the Slocum Creek Park on Church Road with the addition of the kayak launch. The City has applied to the NC Wildlife Resources Commission for the NWZ from the existing WRC boat ramp on the south side of US 70 and associated No Wake Zone that extends 50 yards to the north approximately'/4 mile. It is anticipated that the NWZ will go into effect on July 1, 2016. A copy of the completed application is attached (Exhibit A). As illustrated in the attached maps and diagrams, the City is proposing to post enter/exit signs at each of end of the NWZ and install 3 floating buoys. The proposed locations are based on a site visit with the local NC Wildlife Resources Officer several months ago. The decimal degree coordinates of the enter/exit point on the northernmost extent of the NWZ are N-34.892791 W-76.920953. The signs and buoys are proposed to be located 10' from the edge of the creek bank. The size and dimensions of the signs and buoys are shown on the attached quote from the NC WRC (Exhibit B). In addition to the No Wake Zone regulatory signs, the City is requesting to install a cautionary sign (High Paddle Sport Activity, 36"x48") at the head of the SW prong of the creek to alert boaters entering the creek of paddle sport activity in the area. The signs and buoys, as provided in Exhibit A, are proposed to be purchased from the NC WRC or a marine construction supplier and a local marine contractor will install them. One of the enter/exit signs and the cautionary high paddle sport activity signs will be installed on pile -driven posts. The other enter/exit signs are proposed to be posted on the US 70 bridge by the NC DOT. The buoys will be floating with anchors. The City is also requesting a permit modification to enlarge the permitted area for the floating platform to include a second kayak launch to be installed on the north side of the floating platform running perpendicular to the shoreline (see Exhibit C). The proposed area would include the floating platform (10'x26') with a 40' entry plank for a total of 300 sq. ft., the kayak launch parallel to the shore (5'x24') and the second kayak launch (5'x12.5'). Each waterway marker (buoy) required shall comply in color, size, shape, and structural design with the U. S. Aids to Navigation System and the supplementary standards for such markers adopted by the North Carolina Wildlife Resources Commission pursuant thereto. No other waterway marker will be placed or allowed to remain in waters in which the U. S. Aids to Navigation System has been fully implemented without approval of the Wildlife Resources Commission. 5. It is understood that the regulations promulgated by the North Carolina Wildlife Resources Commission for placement of waterway markers may be subject to approval by the United States Army Corps of Engineers and in coastal counties by the Division of Coastal Management of the Department of Environment and Natural Resources. The recommending governmental unit agrees to submit applications for such approvals to the appropriate agencies with copies to the Wildlife Resources Commission. Final approval by the North Carolina Wildlife Resources Commission for placement of such markers is contingent upon Division of Coastal Management and U.S. Army Corps of Engineers approval where required. 6.
