Dear Mr. Weber:
On February 29, 2008, the Division of Water Quality (DWQ) received your application dated February
27, 2008 to impact 149 linear feet of perennial stream to construct the proposed road through the site that
is to be developed as a residential subdivision and to upgrade an existing dam. Your application was
unacceptable due to the following items:
1. For the DWQ to consider this project a "separate and complete project you will need to bridge
all the crossings and apply for the impacts that facilitate the dam improvements only. Please
note, bottomless culverts require approval from the DWQ or NCDOT if they will ultimately
assume maintenance of the culvert. Alternatively, you may submit your proposed impacts for
Phase I of your project and conceptual impacts for the remaining phases through built-out.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. McMillan at 919-733-
