Sullins, Director Division of Water Quality March 5, 2008 Mecklenburg County DWQ Project #08-0350 Mr. Mark Hunter Erickson Retirement Communities 1 Cedar Village Dr. Prompton Plains NC 07444 Subject: Erickson Retirement Communities Campus Dear Mr. Hunter: The Division of Water Quality (DWQ) received your application for a 401 Water Quality Certification for the subject project on February 26 2008. 1 have reviewed the application and the following information/comments are needed by this office (copies submitted to Raliegh) in order to complete our review: a) There are two agent authorization forms included in the application, one for Mr. Tim Fincher, another for Mr. David Destino. The applicant as stated in the application is Mr. Mark Hunter with Erickson Retirement Communities. A proper applicant page must be submitted or for with either Mr. Fincher or Mr. Destino or another agent authorization form for Mr. Hunter. b) Minimization & Avoidance. In Section VII of the application you state that impacts have been avoided to the maximum extent practicable, yet you also state that the impacts are unavoidable in order to maximize the developable space. In addition, approximately 1/3 of the site shows no development. The east side of the proposed project bordered by McKee Rd. and Pleasant Plains Rd., as well as out parcels along McKee Rd. near the located in the center of the project site. Given this the impacts could easily have been avoided. Please provide comments or c) How is it planned to maintain the hydrology of the stream and wetland below the proposed impacts. d) If the pond is located at/on a stream headwaters, mitigation may be required. This will need to be determined during a site visit. Pursuant to 15A NCAC 2H .0507(h), please be advised that this project will be placed on hold. Failure to submit the requested information by March 21, 2008 will result in the application being withdrawn from consideration. You may reapply, but a new fee and application will be required. In addition, this office is requesting that the Army Corps of Engineers withhold processing the 404 permit until the requested information is provided.
