PROJECT DESCRIPTION: The project site is located along the property lines of Lots 57 & 58, Section 13 of the Seawatch at Sunset Harbor subdivision, adjacent to the AIWW, in Oak Island ETJ, Brunswick County. To get to the property take NC Hwy 17 south from Wilmington and turn left onto Southport-Supply Road (NC HWY 211). Continue on Southport-Supply Road approximately 4-S miles and turn right onto Sunset Harbor Road. Continue south on Sunset Harbor Road for approximately 4.7 miles (from intersection ofSouthport-Supply Road and Sunset Harbor Road) and turn left into Waterway Villages at Seawatch (dirt road). Continue along the dirt road for approximately 800 ft. and turn right onto Oceano Passage. Follow Oceano Passage and the road runs directly into Lots 57 & 58. The subject properties total approximately 0.89 acres and are currently undeveloped. High ground vegetation at the site consists of Live Oak and Pine. The understory vegetation has been cleared. The high ground is bordered to the south by a variety of coastal wetland species including: Smooth Cordgrass (Spartina alterni ora) and Black Needle Rush (Junius roemarianus). High marsh coastal wetland species including, Spike Grass (Distichlis s ip cata), Black Needle Rush (Juncus roemarianus), and Salt Meadow Grass (S artina patens) complete the transitional zone to the high ground. The applicants (Jeffrey and Cheryl Beale) and co-applicants (Edward and Annie Dougherty) have requested a joint filing for this CAMA Major Permit application. The proposal includes the construction of a four-slip docking facility on the subject property, listed with the Brunswick County Tax office as Lots 57 & 58, Section 13 of the Seawatch at Sunset Harbor subdivision. The applicant and co-applicant have provided documentation granting permission for Coastal Communities, Inc. to lease the subject pier and docking facility for sales and marketing purposes of the Seawatch at Sunset Harbor S/d. The Brunswick County Land Use Plan classifies the area as Conservation. The waters of the AIEE, in the vicinity of the subject properties, are classified SA, by the Division of Water Quality. The Division of Marine Fisheries does NOT designate the area as a Primary Nursery Area (PNA) and the area is CLOSESD to the taking of shellfish. PROPOSED PROJECT: The applicant's are proposing to construct a shared pier with a fixed "horseshoe" shaped dock, two gazebos, two floating docks and two boatlifts. The pier structure (6' x 174') would originate from the high ground portion of the property and extend towards the south, crossing a 400' section of coastal wetlands, and terminating just short of the Corp of Engineers 80' Federal Channel setback. The pier would connect to a fixed "horseshoe" shaped pier, comprised of a 6' x 32' spine and two, 4' x 18' fingers. Two, 12' x 12' gazebos would be constructed at opposite ends of the fixed spine. A gangway would connect to each of the covered gazebos, providing access to the proposed 8' x 16' floating docks. Two, 13' x 13' boatlift would be constructed within the footprint of the fixed piers ("horseshoe"). Water depths in the areas surrounding the proposed boatlifts and floating docks would average approximately 2.6' to 3.6', relative to Normal Low Water (NLW). Additionally, the proposed structure does not appear to extend beyond, or into, the edge of the adjacent channel, nor does it appear to exceed I/4 of the width of the waterbody. The construction of the proposed finger piers and boatlifts would incorporate an additiona12,028 sq. ft. of estuarine waters and public trust area. The site is located adjacent to the Atlantic Intracoastal Waterway (AIWW) in Brunswick County, North Carolina. The proposed project is within the Town of Oak Island extra-territorial jurisdiction and is zoned as R-20, single family residential lots. Waters of the AIWW in the vicinity of the subject property are classified as SA, HQW by the NC Division of Water Quality; however, the NC Division of Environmental Health Shellfish Sanitation Branch classifies this water as a "prohibited" shellfishing area. According to the NC Division of Marine Fisheries, this area is not considered a primary nursery area. The site is currently undeveloped. Vegetation or_ the tract includes native trees, shrubs, and grasses. Soils on the property are mapped by the Natural Resource Conservation Service as Carteret loamy fine sand (CA). Individual property owners are not planning to begin residential construction for several years. Coastal Communities, Inc has entered a contractual agreement with the property owners to construct the proposed structure immediately following CAMA approval and lease the access pier and boat slips for sales and marketing purposes of the Seawatch at Sunset Harbor Residential Community. When sales are complete the structure will remain private use. A copy of the lease agreement is included in the CAMA Major Application package.
