Box 190 Albemarle, North Carolina 28002-0190 Subject: Notice of Violation and Notice of Recommendation for Enforcement Tracking Number: NOV-2015-LV-0200 Tuckertown VVWTP NPDES Permit NCO075701 Stanly County Dear Mr. Allen: A review of the October 2014 self-monitoring report for the subject facility revealed violations of the following parameters at Outfall 001: Date Parameter Reported Value Permit Limit 1017114 TSS 1,718 mg/L 45.0 mg/L (Daily maximum) 10/28/14 TSS 58.0 mg/L 45.0 mg/L (Daily maximum) 10/31/14 TSS 888.0 mg/L 30.0 mg/L (Monthly average) A Notice of Violation and Notice of Recommendation for Enforcement (NOV/NRE) is being issued for the noted violations of North Carolina General Statute (G.S.) 143-215.1 and NPDES Permit No. NC0075701. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional information regarding the noted violations, request technical assistance, or discuss overall compliance please respond in writing within 20 days of receipt of this Notice. A review of your response will be considered along with any information provided on the October 2014 Discharge Monitoring Report. You will then be notified of any civil penalties that may be assessed regarding these violations. If no response is received in this Office within the 20- day period, a civil penalty assessment may be prepared. The Division of Water Resources may pursue enforcement actions for this and any additional violations. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by Consent.
