She asked everyone present to introduce themselves and their company affiliation. The Contractor submitted his letter naming persons authorized to sign Supplemental Agreements. ~~ S.. w 4,~~~~xwill act as Project Superintendent for the Contractor. He was advised that it would be checked, and he would be advised if satisfactory. By copy of these minutes, we are advising the Contractor that his progress schedule has been checked and is approved as submitted. RIGAT OF WAY Lloyd Johnston covered this portion of the contract. All of the right of way and easements necessary for this project have been acquired with the exception of Parcel 1, Angelyn E. Coley; Parcel 2, June Shearin; Parcel 3, L. Earnest Sridger, Jr.; and Parcel 4, Village in Westry Crossing Owners Association. Right of Way Agreements were given to the Resident Engineer. These agreements cover all of the right of way and easements necessary for this project that were acquired by negotiation. We should have signed Agreements for Parcels 1, 3 and 4 within the next two weeks (Permit of Entry has been secured for these parcels). Parce126, Arrow, Inc., was acquired by condemnation, but has been settled by a consent judgment. There are no 200 Series Items on this project. There is no known asbestos contamination, underground storage tanks, nor any known soil contamination within the right of way of the project. The Contractor is advised not to exceed the right of way or easement areas during construction without written permission from the property owner. UTILITY CONFLICTS Progress Energy -They are trying to verify right of way throughout the project. They have four or five poles to be relocated. Their work orders have been written and forwarded to Sheila Talton. NCDOT will meet in the field to determine if some of the conflicts can be eliminated. Progress Energy will submit cost estimates to NCDOT for approval and authorization. Progress Energy conflicts should be complete by the first week in March. City of Rocky Mount (Water and Sewer) -Only water services and meters wilt need to be relocated. This will need to be accomplished in conjunction with the storm drain installation. City personnel will be on site to coordinate this operation with the Contractor. No delays should occur to Contractor's operations. One manhole is located in the curb line and may be a problem. The City should resolve this by re-orienting the manhole opening. There are nine fire hydrants to be adjusted vertically and three to be moved outside the construction limits. The City will begin relocating these two weeks in advance of the Contractor's operations. City of Rocky Mount (Gas) -Conflicts should be relocated by the end of this week. Gas services will be relocated in conjunction with the storm drain installation. City personnel will be on site to relocate the services as they are encountered. This should not create delays for the Contractor. Sudden Link Communications -There are no underground conflicts noted (everything is overhead). They will relocate in conjunction with Progress Energy. + Preconstruction Conference Minutes 37748 Page 3 Time Warner Cable -All utilities are overhead at the west end of the project. No problems anticipated with their facilities. Embarq -They are 99% complete with their underground relocation. There are some trees in conflict with some overhead facilities on the east (Halifax Road) end. The cutover of the new underground installation should begin Monday, February 11, 2008 and take about two weeks. There is a pole and a pedestal to be adjusted at the intersection of Sunset Avenue and T ree uests that the Contractor blegineceanng these areas some clearing before poles can be moved. NCDO q soon to expedite relocation. PROJECT SPECIAL PROVISIONS GENERAL Contract Time acid Liquidated Damages -The date of availability for this contract is February 4, 2008. The completion date for this contract is December 1, 2008. Except where otherwise provided by the contract, observation periods required by the contract will not be a part of the work to be completed by the completion date and/or Intermediate Contract Times stated in the contract. The acceptable completion of the observation periods that extends beyond the final completion date shall be a part of the work covered by the Performance and Payment Bonds. The liquidated damages for this contract are $800.00 per calendar day. Intermediate Contract Time Number 1 and Liquidated Damages -The Contractor shall complete the work required of removing the existing two 30-inch pipes at -L- Station 18+25, replacing the two 30-inch pipes, repairing the pavement on SR 1770 (Sunset Avenue) as shown in the contract, and place and maintain traffic on same. The time of availability for this Intermediate Contract Time will be the Friday at 9:00 p.m. that the Contractor begins work. The Contractor shall provide written notice to the Engineer a minimum of 14 consecutive calendar days prior to the time that the Contractor plans to begin this work. State Forces will install the detour signing for the road closure of SR 1770 (Sunset Avenue) before this work begins. The completion time for this Intermediate Contract Time will be the following Monday at 6:00 a.m. after the time of availability. The liquidated damages are $300.00 per hour. MINORITY BUSINESS ENTERPRISES AND WOMEN BUSINESS ENTERPRISES Wendi Johnson covered this portion of the contract. It is the policy of the North Carolina Department of Transportation that Minority Business Enterprises and Women Business Enterprises shall have equal opportunity to compete fairly for and participate in the performance of contracts financed in whole or in part by state funds. Preconstruction Conference Minutes 37748 Page 4 The Contractor is also encouraged to give every opportunity to allow MB/WB participation in Supplemental Agreements. The Contractor and any subsequent subcontractor shall take all necessary and reasonable steps to insure that Minority and Women Businesses have the maximum opportunity to compete for and perform a portion of the work included in this contract and shall not discriminate on the basis of race, color, national origin or sex. Failure on the part of the Contractor to carry out the requirements set forth herein shall constitute a breach of contract and, after proper notification, may result in award disqualification, termination of the contract, disqualification from bidding, or other appropriate remedy. The Contractor's EEO Officer is Mark Proctor and the Minority Liaison Officer is Sim Wooten. The Contractor shall exercise all necessary and reasonable steps to insure that Minority Businesses participate in at least 5% of the contract, and Women Businesses participate in at least 5% of the contract. The contract was awarded with 3.97% participation for Minority Businesses and 6.73% participation for Women Businesses. The Resident Engineer furnished the Contractor with required posters for his bulletin board. The Contractor's EEO Policy Statement is to be posted on the project's bulletin board, which should be weatherproof, along with the following posters: 1. Davis-Bacon Minimum Prevailing Wage Rate Schedule 2. Wage-Rate Information - F/A Project, Form PR-1495 3. Notice Relating to False Statements, Form PR-1022 4. EEO Poster - Discrimination is Prohibited The Contractor is urged to document, in writing, all actions taken in complying with Equal Opportunity of Employment Provisions, Training Provision, and Minority Business Enterprise Provision. This includes applicant referrals, meetings with employees, on-site inspections, wage evaluations, etc. All subcontractors and suppliers are responsible for meeting the same requirements as the prime contractor, and it is the prime contractor's responsibility to oversee that both are in compliance. All alleged discriminatory violations should be brought to the attention of the Resident Engineer. The State will conduct a Contract Compliance Review sometime during the life of this contract. Therefore, fair employment practice should be maintained at all times. Replaeeme~rt of MBs and WBs - If any MB or WB subcontractor indicated on the form for listing of MB and WB subcontractors does not perform satisfactorily to the extent indicated or anticipated, the Contractor shall take all necessary, reasonable steps to replace the MB subcontractor with another MB subcontractor, and the Contractor shall take all necessary, reasonable steps to replace the WB subcontractor with another WB subcontractor. Any changes need to be submitted to the Resident Engineer. Preconstruction Conference Minutes 37748 Page 5 Reporting Minority Business Enterprise or Women Business Enterprise Participation -When payments are made to Minority Business Enterprise firms or Women Business Enterprise firms, including material suppliers, Contractors at all levels shall provide the Engineer with an accounting of said payments. This accounting shall be furnished to the Engineer for any given month by the end of the following month. The Contractor shall report the accounting of payments through the Department's MBNVB Payment Tracking System, which is a web-based application. The System can be accessed through the following web link: i~ltps'''i~~s dot st tt, nc usV;;~,dor:`Pa=. n~cntT;~;.ki~a%. The Contractor shall also provide the Engineer an affidavit attesting the accuracy of the information submitted in the Payment Tracking System. This, too, shall be submitted for any given month by the end of the following month. Retainage and Prompt Payment -The Department will not deduct and hold any retainage from the Prime Contractor on this project. The Department will withhold an amount sufficient to cover anticipated liquidated damages, as determined by the Engineer. Contractors at all levels, prime, subcontractor or second tier contractor, shall within seven calendar days of receipt of monies resulting from work performed on the project or services rendered, pay subcontractors, second tier subcontractors or material suppliers, as appropriate. This provision for prompt payment shall be incorporated into each subcontract or second tier subcontract issued for work performed on the project or for services provided. Certified payrolls are not required on this project. Twelve Month Guarantee -The Contractor shall guarantee materials and workmanship against latent and patent defects arising from faulty materials, faulty workmanship or negligence for a period of 12 months following the date of final acceptance of the work for maintenance and shall replace such defective materials and workmanship without cost to the Department. The Contractor will not be responsible for damage due to faulty design, normal wear and tear, for negligence on the part of the Department, and/or for use in excess of the design. Where items of equipment or material carry a manufacturer's guarantee for any period in excess of 12 months, the manufacturer's guarantee shall apply for that particular piece of equipment or material. The Department's first remedy shall be through the manufacturer, although the Contractor is responsible for invoking the warranted repair work with the manufacturer. The Contractor's responsibility shall be limited to the term of the manufacturer's guarantee. NCDOT would be afforded the same warranty as provided by the manufacturer. Erosion & Sediment Control/Storm Water Certification -Contractor shall provide a Certified Supervisor, Certified Foreman and Certified Installer on this project. Contractor will notify the Engineer of changes in certified personnel over the life of the contract within two days of change. The Certified Supervisor shall be responsible for insuring erosion and sediment/storm water control is adequately implemented and maintained on the project. The roles and responsibilities of the Certified Supervisor, Certified Foreman and Certified Installer are shown on pages 18-21 of the contract. Preconstruction Conference Minutes 37748 Page 6 The Contractor was reminded that rain gauges are required on this project. Reports should be done weekly and after every U2" rain. These reports should be kept on site at all times. Procedure for Monitoring Borrow Pit Discharge -Water discharge from borrow pit sites shall not cause surface waters to exceed 50 NTUs in streams not designated as trout waters and 10 NTUs in streams, lakes or reservoirs designated as trout waters. For lakes and reservoirs not designated as trout waters, the turbidity shall not exceed 25 NTUs. If the turbidity exceeds these levels due to natural background conditions, the existing turbidity level shall not be increased. If during any operating day, the downstream water quality exceeds the Standard, the Contractor shall do all of the following: (A) Either cease discharge or modify the discharge volume or turbidity levels to bring the downstream turbidity levels into compliance, or (B) Evaluate the upstream conditions to determine if the exceedance of the Standard is due to natural background conditions. If the background turbidity measurements exceed the Standard, operation of the pit and discharge can continue as long as the stream turbidity levels are not increased due to the discharge. (C) Measure and record the turbidity test results (time, date and sampler) at all defined sampling locations 30 minutes after startup and, at a minimum, one additional sampling of all sampling locations during that 24-hour period in which the borrow pit is discharging. (D) Notify DWQ within 24 hours of any stream turbidity Standard exceedances that are not brought into compliance. No additional compensation for monitoring borrow pit discharge will be paid. The Contractor advised that he would use a pit at Wake Stone or a site adjacent to the project. PROJECT SPECIAL PROVISIONS ROADWAY Shoulder acrd Fill Slope 1~iaterial -Required shoulder and slope construction for this project shall be performed in accordance with the requirements of Section 226 of the 2006 Standard Specifications except as follows: Construct the top 6" (150mm) of shoulder and fill slopes with soils capable of supporting vegetation. Provide soil with P.I. greater than 6 and less than 25 and with a pH ranging from 5.5 to 6.8. Remove stones and other foreign material 2" (SOmm) or larger in diameter. All soil is subject to testing and acceptance or rejection by the Engineer. Material shall be obtained from within the project limits or an approved borrow source. Preconstruction Conference i~iinutes 37748 Page 7 ASPHALT PAVEMENTS Gary Starling asked the Contractor if he had any questions of the Special Provisions outlined on pages 27 thru 36. Mr. Starling advised that the Special Provisions in this contract are dated 7/18/06 (Rev. 12/18/07). Attention was called to page 27 of the contract. The Contractor should revise the 2006 Standard Specifications as follows: Page 6-12, Subarticle 609-5(C)2, Required Sampling and Testing Frequencies, first partial paragraph at the top of the page, delete the last sentence and add the following: If the Engineer allows the mix to remain in place, payment will be made in accordance with Article 105-3. Mix for 9. SB will change to 40 degrees air temperature and 50 degrees at the surface. Contractor will be allowed to design and run 20% Rap rather than 15%. Attention was called to page 30 of the contract. Page 623, Subarticle 609-5(D)(5), Limited Production Procedure, delete the first paragraph, including (a), (b) and (c) and substitute the following: Proceed on limited production when, for the same mix type and on the same contract, one of the following conditions occurs (except as noted in the first paragraph below): (a) Two consecutive failing lots, except on resurfacing* (b) Three consecutive failing lots on resurfacing* (c) Two consecutive failing nuclear control strips. *Resurfacing is defined as the first new uniform layer placed on an existing pavement. Incidental Milling is discussed on pages 33 and 34 of the contract. Density testing may be required for wedging (depending on the depth). The Contractor advised that Rose Brothers would perform paving on this project. SHPO Documentation for Borrow;`Waste Sites -The Department's borrow and waste site reclamation procedures for contracted projects are available on the NCDOT web site and shall be used for all borrow and waste sites on this project. ' Preconstruction Conference Minutes 37748 Page 8 TRAFFIC CONTROL Maintain traffic in accordance with Divisions 10, 11 and 12 of the Standard Specifications, the latest revisions thereto and the following provisions. Use a lane closure or aslow-moving operation as shown in details of this contract. Use a moving operation only if the minimum speed maintained at all times is 3 mph with no stops that narrow or close a lane of travel. If the moving operation is progressing slower than 3 mph at any time, install a lane closure. Maintain the existing traffic pattern at all times, except in the immediate work zone where lane closures are allowed as determined by the Engineer. Refer to attached details and the Roadway Standard Drawing Nos. 1101.02, 1101.03, 1101.04, 1101.05, 1101.11, 1110.01, 1110.02, 1115.01, 1130.01, 1135.01, 1145.01, 1150.01, 1165.01, 1170.01 and 1180.01 when closing a lane of travel in a stationary work zone such as pavement patching, resurfacing or pavement marking removal. Properly ballasted cones may be used instead of drums for lane closures during daylight hours. However, drums are required for the upstream taper portion of lane closures in all applications. The stationary work zone shall be a maximum of three miles in length at any given time unless otherwise directed by the Engineer. A pilot vehicle operation may be used in conjunction with flaggers and the appropriate pilot vehicle warning signing as directed by the Engineer. During periods of construction inactivity, return the traffic pattern to the existing alignment and remove or cover any work zone signs. When covering work zone signs, use an opaque material that prevents reading of the sign at night by a driver using high beam headlights. Use material which does not damage the sign sheeting. Replace any obliterated markings as required by other sections of the Standard Specifications and the Engineer. when personnel and/or equipment are working on the shoulder adjacent to an undivided facility and within five feet of an open travel lane, close the nearest open travel lane using the Roadway Standard Drawing No. 1101.02 unless the work area is protected by barrier or guardrail. When personnel and/or equipment are working on the shoulder, adjacent to a divided facility and within 10 feet of an open travel lane, close the nearest open travel lane using the Roadway Standard Drawing No. 1101.02 unless the work area is protected by barrier or guardrail. When personnel and/or equipment are working within a lane of travel of an undivided or divided facility, close the lane according to the Traffic Control Plans, Roadway Standard Drawings or as directed by the Engineer. Conduct the work so that all personnel and/or equipment remain within the closed travel lane. Do not work simultaneously, on both sides of an open travelway, within the same location, on a two-lane, two-way road. Do not perform work involving heavy equipment within 15 feet of the edge of travelway when work is being performed behind a lane closure on the opposite side of the travelway. Perform work only when weather and visibility conditions allow safe operations as directed by the Engineer. Do not exceed a difference of two inches in elevation between open lanes of traffic for nominal lifts of 1. inches. Install advance warning "Uneven Lanes" signs 500 feet in advance and a minimum of once every half mile throughout the uneven area. r Preconstruction Conference Minutes 37748 • Page 9 Backfill at a 6:1 slope up to the edge and elevation of existing pavement in areas adjacent to an open travel lane that has an edge of pavement dropoff as follows: (A) Dropoff that exceeds two inches on roadways with posted speed limits of 45 mph or greater. (B) Dropoff that exceeds three inches on roadways with posted speed limits less than 45 mph. Backfill the unacceptable dropoff with suitable, compacted material as approved by the Engineer, at no expense to the Department. This work is not considered part of shoulder reconstruction. When utilizing aslow-moving operation for such items as pavement marking placement, pavement marker installation and pesticide spraying, the slow-moving operation caravan shall consist, at a minimum, of the vehicles and devices shown on the Moving Operation Caravan Detail(s) herein. Traffic cones may be used when necessary to provide additional protection of wet pavement markings. Ballast all traffic cones so they will not be blown over by traffic. Notify the Engineer, in writing, a minimum of 14 consecutive calendar days prior to beginning the work of replacing the two 30" pipes on SR 1770 (Sunset Avenue) and the work of replacing the 54" pipe on SR 1667 (Freight Road). State Forces will install the detour signing for the road closures. Coordinate all road closure operations with the Engineer. (Arrow Road will be used for detour from Freight Road.) Notify the Engineer 48 hours before milling or resurfacing will interfere with the existing signal loops. Loops may need to be placed in milled surface before resurfacing occurs. Coordinate all signal loop operations with the Engineer. Notify the Engineer 1 S consecutive calendar days before resurfacing a bridge or its approaches. Patch and make repairs to bridge surface and its approaches before resurfacing occurs. Coordinate all operations on the bridge and its approaches with the Engineer. Notify the Engineer 48 hours before resurfacing the areas of existing pavement that require patching. Patch these areas before resurfacing occurs. Allow full depth asphalt patching to cool to the point of supporting traffic without displacement or rutting before reopening the closed lane. Coordinate the resurfacing operations of the patched areas with the Engineer. During a resurfacing only operation, bring all newly-resurfaced lanes to the same elevation within 72 hours. 1~'orth Carolina 11~fovirrg Ahead Sigfts -The Department will furnish the Contractor with the NC Moving Ahead logo signs. The Contractor shall procure these signs from either the local Traffic Services Office or directly from the Bunn Sign Plant. NCMA signs shall be installed as shown in the contract and left in place at the completion of the project. NCMA signs and supports shall remain the property of NCDOT and will be removed by Division Forces. The Contractor shall have a sign fabricated with the name of his company, which will be mounted under the NCMA logo sign. The Contractor shall remove and keep the signs with the name of his company after final project acceptance, leaving the supports and NCMA logo signs in place. Preconstruction Conference Minutes 37748 Page 10 EROSION CONTROL Environmentally Sensitive Areas -This project is located in an Environmentally Sensitive Area. This designation requires special procedures to be used for clearing and grubbing, temporary stream crossings and grading operations within the Environmentally Sensitive Areas identified on the plans and as designated by the Engineer. This also requires special procedures to be used for seeding and mulching and stage seeding within the project. The Environmentally Sensitive Area shall be defined as a 50-foot buffer zone on both sides of the stream or depression, measured from top of stream bank or center of depression. Clearing and Grllbbillg - In areas identified as Environmentally Sensitive Areas, the Contractor may perform clearing operations but not grubbing operations until immediately prior to beginning grading operations as described in Article 200-1 of the Standard Specifications. Only clearing operations (not grubbing) shall be allowed in this buffer zone until immediately prior to beginning grading operations. Erosion control devices shall be installed immediately following the clearing operation. Contractor was advised to only clear and grub where absolutely necessary. Grading -Once grading operations begin in identified Environmentally Sensitive Areas, work shall progress in a continuous manner until complete. All construction within these areas shall progress in a continuous manner such that each phase is complete and areas are permanently stabilized prior to beginning of next phase. Failure on the part of the Contractor to complete any phase of construction in a continuous manner in Environmentally Sensitive Areas will be just cause for the Engineer to direct the suspension of work in accordance with Article 108-7 of the Standard Specifications. Contractor was reminded to only pump clean water to clean water. If the water is not clean, it must be treated before it is discharged. MI117nIlZe Removal of b'egetatiort -The Contractor shall minimize removal of vegetation at stream banks and disturbed areas within the project limits as directed. Waste and Borrow Sources -Payment for temporary erosion control measures, except that made necessary by the Contractor's own negligence or for his own convenience, will be paid for at the appropriate contract unit price for the devices or measures utilized in borrow sources and waste areas. No additional payment will be made for erosion control devices or permanent seeding and mulching in any commercial borrow or waste pit. All erosion and sediment control practices that may be required on a commercial borrow or waste site will be done at the Contractor's expense. Safety Felrce -The Safety Fence shall be installed prior to any land disturbing activities. The person who will actually be doing the clearing should meet with the Contractor and the Resident Engineer on site prior to any clearing being performed. PERI~iITS Mrs. Johnson advised that the US Army Corps of Engineers and NCDENR have issued a permit for this project. The Contractor shall comply with all applicable permit conditions during construction of this project. Agents of the permitting authority will periodically inspect the project for adherence to the permits. Should the Contractor propose to utilize construction methods (such as temporary structures or fill in waters and/or wetlands for haul roads, work platforms, cofferdams, etc.) not specifically identified in the permit (individual, general or nationwide) authorizing the project, it shall be the Contractor's responsibility to coordinate with the Engineer to determine what, if any, additional permit action is required. The Contractor shall also be responsible for initiating the request for the authorization of such construction method by the permitting agency. The request shall be submitted through the Engineer. The Contractor shall not utilize the construction method until it is approved by the permitting agency. The request normally takes approximately 60 days to process; however, no extensions of time or additional compensation will be granted for delays resulting from the Contractor's request for approval of construction methods not specifically identified in the permit. Where construction moratoriums are contained in a permit condition which restricts the Contractor's activities to certain times of the year, those moratoriums will apply only to the portions of the work taking place in the waters or wetlands, provided that activities outside those areas are done in such a manner as to not affect the waters or wetlands. Within 15 working days of the pipe replacement, all coffer dams will be entirely removed and natural stream contours will be restored and seeded. Temporary silt screens placed in intermittent channels will be cleaned and removed following vegetation establishment. During construction of the project, no staging of equipment of any kind is permitted in waters of the U. S. or protected riparian buffers. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. ` Preconstruction Conference Minutes 37748 Page 12 A copy of the Water Quality Certification shall be posted on the construction site at all times. In addition, the Water Quality Certification and all subsequent modifications shall be maintained with the Division Engineer and the on-site Project Manager. Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by the Certification. Drawings were given to the Contractor that show- areas to be impacted. i~iake certain that employees know not to go beyond the orange safety fence. OTHER COMMENTS The Resident Engineer and the Contractor will hold monthly construction meetings. The Contractor's monthly estimate will be done the last day of the month. The Contractor stated that he would not have an office on site. The Contractor submitted a proposed Traffic Control Plan.
