Dear Mr. Landon Davidson,
This is in response to the letter received for the notice of violation and recommendation for
enforcement due to the failure to monitor for quarterly Total Nitrogen and Total Phosphorous on
our September 2014 Discharge Monitoring Report(DMR). The non-compliance issue was
partially an oversight by the Forest City WWTP laboratory and a mistake by Pace Analytical
Services, INC(Commercial Lab). There was an update received on the plants long term
monitoring plan schedule that allowed for the parameter Total Phosphorous to be removed.Our
laboratory personnel mistakenly believed that the plant would no longer be sampling and testing
for this parameters and wasn't thinking about this parameter continuing to be on our NPDES
permit and allowed the quarter to go by without sampling.On September 31,2014, laboratory
personnel sent out LTMP samples to Pace Analytical in Asheville,NC which included the
parameter of Total Nitrogen for testing. While reviewing the final report total nitrogen was
omitted and testing not performed. This mistake was realized while compiling data for the
monthly Discharge Monitoring Report but was too late to correct. A copy of the Chain of
Custody is included with this letter. Once the mistake was realized, the mishap was reported to
Ms.Janet Cantwell of the Asheville Regional Office on October 24,2014 and also noted on the
monthly DMR. We apologize for the oversight and problem has been resolved and corrected. If
