Please note that the "Effluent Limitations and Monitoring Requirements"section of the subject permit is teared into three (3) sections,A. Berry, City Manager Catawba WWTP(NC0025542) Notice of Violation (NOV-2015-MV-0136) December 11, 2015 Page 2 expansion to 1.5 MGD; A. (2) Beginning upon expansion above 0.225 and lasting until expansion to 1.5 MGD; A. (3) Beginning upon expansion above 1.5 MGD until expiration. On September 2, 2015 this Office received a copy of the Engineer's Certification for the Catawba WWTP (NC0025542) dated August 25, 2015 and signed by Mr. Danny M. Ware, P.E. on behalf of the City of Hickory. In the certification it states "We understand that the new limits associated with the modifications to expand to 1.5 MGD now apply." It is therefore required to immediately start 4 monitoring under Section A. (2) of the subject permit. Please note that this Office may consider enforcement actions for the above noted violations pursuant to G.S. 143-215.6A, a civil penalty of not more that twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional information regarding the noted violations, request technical assistance, or discuss overall compliance please respond in writing within 10 days of receipt of this Notice. A review of your response will be considered along with any information provided on the September 2015 Discharge Monitoring Report(DMR). You will then be notified of any civil penalties that may be assessed regarding these violations. If no response is received in this Office within the 10-day period, a civil penalty.assessment may be prepared. Remedial actions, if not already implemented, should be taken to correct any noted problems. The Division of Water Resources may pursue enforcement actions for this and any additional violations. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by Consent(SOC).
